A TVA spokesman has stated said he could not provide details about John Sevier Combined Cycle Generation LLC because of a nondisclosure agreement. Chief Financial Officer John Thomas said of the LLC, "it is a group made up of large, institutional investment companies." John Sevier Combined Cycle Generation LLC is a corporation registered in Delaware. The sale of the combined cycle gas plant was complete in September of 2011 in secret. Specific details of the sale are secret due to the signing of a non-disclosure agreement. Details such as the terms of the contract and what determines a default are secret. This is a slap in the face to accountable, open government and what appears to be a violation of the Federal Sunshine Act.

Browns Ferry Nuclear Plant near Athens, Alabama has 3 GE Mark 1 series of nuclear reactors.

A defective residual heat removal (rhr) system flow valve was found defective in October 2010. However, the defective component had been defective for more than a year and the management at Browns Ferry did not correct the problem.

TVA Executives and managers were given an opportunity to respond to the NRC's presentation. Keith Polson (seated second from left), Vice President of TVA Browns Ferry Nuclear Plant stated: "We concur with the NRC's findings. We strive for excellence, our goal is to be the best nuclear plant operating in the United States."

I met with Mr. Polson (photo above) after the meeting to discuss management communications at the facility. He told me he had been at the plant for 2 years and it has been a challenging task to overcome negative attitudes and behaviors related to the safety culture. He stated he meets with different sections each week and there is a daily "morning report" which is reviewed by Browns Ferry Managers to identify and resolve any problems.

Members of BREDL and BEST/MATRR (BREDL- Blue Ridge Environmental Defense League, BEST/MATRR-Bellefonte Efficiency and Sustainability Team, Mothers Against Tennessee River Radiation http://www.matrr.org ) spoke to the NRC and the TVA to express their concerns about the Browns Ferry Nuclear Plant. Ms. Jackie Posie, Ms. Gretel Johnston, Mr. Stewart Horn and Mr. Garry Morgan discussed their concerns relative to plant safety, deficiencies of design and the lack of a secondary containment structure above the cooling pool level.

There are approximately 1 million people who reside within a 50 mile radius of the Browns Ferry Nuclear reactors. Browns Ferry has over 3.5 million pounds of highly radioactive spent fuel at the facility. The large majority of the radioactive spent fuel is contained within the fuel pools of which there is no required reinforced secondary containment above the cooling pool level, a serious design defect.

The Goose Pond Colony/Plantation Pointe Board Meeting and Audit Review by George Anderson

All Goose Pond Colony Board members, except Mike Baggett-prior engagement conflict, were present; Jim Olyniec presided.

The audit for 2011 was presented by the Mr. James C.Smith, lead auditor from TUCKER, SMITH & ASSOCIATES P.C., the regular auditing firm for the board. Mr. Smith said that their audit was 'unqualified' or did not disclose any items they would have concluded that were not in compliance with Generally Accepted Accounting Procedures. In other words, they gave the Goose Pond operations and management an 'attaboy' and said they were doing great. Mr. Smith also praised the Board for their decision to curtail Plantation's ops and opined the decision should show big savings in 2012 since the course will only be open about 35% of the days the Colony  course is open.

Overall the 2011 audit showed:
Revenues decreased $42,946 (-1.4%) from 2010; Expenses decreased $150,614 (-5.2%) from2010; $153,034 PROFIT (Increase in Net Assets) - resulting from lower expenses as compared to last year's $13,295 LOSS.

Ending Net Assets for 2011 increased 14.4% to $1,217,087 from 2010's $1,064,053

$29,690 LOSS for the Snack Bar at the Colony. Board leased the Goose Pond Colony course Snack Bar to Stevarino's starting 1/1/2011.
TOTAL ASSETS on balance sheet decreased $195,930 (-3.2%) from 2010's $6,088,971 due mostly to recognition of depreciation of capital assets.

Cash available decreased $32,786 from 2010

The Plantation Pointe course course may open either 2/17 or 3/17. If 3/17/2012 it will be open for 10 days straight because Spring Fling is being played at the Colony. Thereafter - Fri, Sat, Sun - 3 days per week!!

The Board is going forward with their plan to move into the [Plantation Pointe] Clubhouse and close the Pro Shop building. Interior modifications are needed, but final details are still being discussed. The board approved $3000 to purchase gravel for the new cart path layout.

The Bait and Tackle Shop was leased to a new lessee. Sounds like the new lessee is the owner of Airport Marine of Alabaster, Al. General Manager Lyle Sosebee indicated he is the same person who ran the last Snag-Proof tournament at the marina.

The first tournament is 2/7/2012;  the current plan is to hold 8-9 tournaments each year. They pay no lease fees till May or June, then $500 per month + $1 per vehicle launching a boat and parking at the Bait and Tackle Shop.

Monday Jan. 23, 2012 was a regular meeting of the Jackson County Commission, the agenda was approved.

The consent agenda consisted of 2 items: a) $20,334.88 was approved for payment to Meadowbrook Insurance for Audit Adjustment for Workers Coimpensation fund. b) $460.00 was approved for the Coosa Valley Youth Services for juvenile detention for the month of December 2011.

Personnel Board appointments: Carolyn Carter from Hollytree was selected by Commissioner Clemmons; Jenni Carter from Scottsboro was selected Commissioner Stone and David Kennamer was selected by Commissioner Allen. (My comments: It is a disservice for citizens not to be informed of the background and qualifications of Personnel Board appointees. It demonstrates arrogance, laziness and closed government on the part of commissioners. Qualifications should be discussed and based on applications announced and selected in a process of open deliberations. The current process is not in the best interests of the citizens nor representative of Open Government in our Republic.)

Last night was a joint Work Session and Regular City Council Meeting.

Work Session- More taxes in the form of licensing fees.
In the work session there was 1 item discussed. Business License Code adjustment. a) Alcohol sales: The Alcohol Beverage license for the city may be adjusted to reflect a fee increase of up to 50% of the Alabama alcohol Beverage License Fee. b) More business license fees. The City of Scottsboro may increase the city business license fees through an increase in the issuance fee. (My comment: The City of Scottsboro is out of touch with the realities of struggling small businesses in Scottsboro. Additional fees equate to hidden taxes which will be passed on to citizens thus increasing the cost of goods. This also increases inflation and decreases the value of the dollar. Our illustrious and distinguished city council would not be reelected by raising taxes outright, so they think up of ways to increase their revenue to pay for the city's massive debt by license fee increases, just another hidden tax.)

UPDATE: Jan 26, 2012 - From city Attorney: The ABC Board rule modification recommended will actually result in a cut of $50 per year in license fees for businesses under that particular schedule. The issuance fee apect of the recommended changes will result in a possible $2 per year increase in 2013.

A sale by the TVA, then a leaseback to the TVA by the John Sevier Combined Cycle Generation LLC, registered in Delaware on Jan 3, 2012. It is reported the new LLC is to receive 1 billion dollars in revenue proceeds for their troubles. We the ratepayers will foot the bill. The TVA reports the decision to sell the plant was made at the executive level with the TVA Board delegating the authority for the sale and leaseback of the power generation asset at the August 2011 board meeting. The sale and leaseback deal was accomplished secretively in September 2011. A review of the August 2011 meeting video reveals no specific authority stated in the public meeting regarding a delegation of selling power generation assets then leasing them back. It was discussed but not specifically authorized in the public meeting.

What is to prevent the sale and leaseback of all of TVA's assets? I wonder if the shill corporation scheme could be used to reduce the Federal Deficit? The TVA is not a corporation which may operate beyond the authority of the laws governing the governmental entity's operations. Allowing its corporate executives to sell and lease property without the direct approval of the board of directors appears to violate the intent of the TVA Act concerning the sale of its generation assets.

Next shill corporation, Watts Bar Nuclear, LLC. Instead of a $900 million scheme it will be near a $3 billion scheme costing the ratepayers. Where and when will the debt circumvention schemes stop?

Why is the TVA acting like ENRON? The Congressional mandated $30 billion debt limit is the answer. TVA can't afford to build Bellefonte due to its $28 billion actual debt value. It must create a schemes to circumvent law for the enrichment of the multinational nuclear corporations and their political puppets. Who will pay for the Bellefonte nuclear sinkhole and the enrichment of politicians and the multinational corporations - we the citizens and businesses of the TVA area will pay the additional debt load with ever rising electrical rates.

LICENSE INSPECTOR TERMINATED, Jackson County Commission Meeting

The hot topic at this afternoon's County Commission meeting was the termination of the temporary Jackson County License Inspector, 25-year-old Bradley Tyler Smith of Higdon, the grandson of Commissioner Jack Smith. The younger Mr. Smith was hired to fill the license inspector position on a temporary basis. The motion to agenda item -I- to terminate was placed forward by Commissioner Allen, Commissioner Stone seconded the motion. A long one sided dissertation singing praises about the license inspector emanated from Ms. Bias.

WAFF-TV was present to video the commission meeting. (When the video becomes available I will post within.) During the long dissertation Ms. Bias took the opportunity to "bad mouth" WAFF, Ch 48's accurate reporting of the situation. No one else commented except Commissioner Smith and a Smith family member about the issue. Chairperson Bias would not allow a request from another citizen to comment who did not agree with Ms. Bias's position. The vote on the issue was 3 votes to terminate, 1 vote no. The lone no vote came from Commissioner Jack Smith, the grandfather of the license inspector. The license inspector was terminated.

Bradley Tyler Smith was present in this afternoons commission meeting (pictured above). The County Commission Chairperson Sadie Bias made a long speech about what a "good job" Mr. Smith had performed while in the license inspector position. However, she did not mention he had been charged with 2nd Degree Theft and 3rd Degree Robbery Criminal Case 2010-0544 and 0545 which involved drugs, the reason he is enrolled in the drug court. Mr. Smith has not completed the drug court program but was hired for this position by Chairperson Bias. Ms. Bias was aware of the pending disposition of Mr. Smith in Drug Court and his entry of a guilty plea to the charges against him, she went ahead and hired him knowing by his own admission he was a convicted felon and he had not completed the drug court program.

The License Inspector position requires a bond to be approved by the Governor of Alabama. Mr.Smith (former license inspector Smith) was not bonded until some time after his employment as a license inspector. The Governor had not approved the bond as required by state law. A license inspector in Alabama is a law enforcement position in regards to licensing and permitting of businesses, mobile homes and issues citations, initiates summons as a Sheriff of an Alabama County would issue legal documents. Other counties require such inspectors to attend and successfully complete the Alabama Peace Officers Course.

Commission Chairperson Sadie Bias allowed Commissioner Jack Smith to make very negative and unsubstantiated allegations as a verbal attack pointed at Commissioner Jack Allen due to his request to place the issue of the Temporary License Inspector's termination on the agenda.

Ms. Bias also allowed a female relative of the Smith's to make unsubstantiated negative comments pointed at Commissioner Allen. The Chairperson refused to control the very negative allegations and the attacks being issued. Ms. Bias created an intimidating, threatening, hostile atmosphere of negativity.

Commissioner Jack Allen tolerated a structured attack pointed at him orchestrated by Chairperson Bias, Commissioner Smith and Smith family members. It was reported the attack was planned in the Chairperson's office prior to the commission meeting. Mr. Allen replied he had been informed by many Jackson County residents they did not support nor think it was proper that a felon, the grandson of a commissioner, was selected as the license inspector.

Since Ms. Bias allowed a citizen to speak concerning Commissioner Allen I asked to be allowed to speak. My request was: "Madame Chairperson since you are allowing comment from a citizen during this session I am requesting to speak on the issue." Ms. Bias replied, "I will not recognize you, you are out of order, you may not speak"

During last Thursday's work session I requested from Chairperson Bias a document which she provided to each member of the press, all members of the press present were female. I was the only male member of the press present. I informed Ms. Bias of my position concerning a member of the press as a blogger. Ms. Bias is aware of my blog site and its postings. She refused to produce the documents requested. Mr. Jack Allen produced the documents requested.

Taking into consideration Chairperson Bias's comments and actions today, and previous occasions, in the decision making process during her term of office there is evidence the current Chairperson is creating a hostile work site climate which is discriminatory in nature, specifically pointed at males. During an early meeting with Ms. Bias, after her election, I was alone with her in her office. She said to me, "Ohh, you smell good," she hugged me and then said, "mmm." That was power assertion behavior, typical of those persons who practice sexual discrimination in positions of power. Power assertion conduct of males in a position of power is unacceptable pointed toward females and this discriminatory activity is likewise unacceptable conduct presented by females in positions of power directed at males.

Today's Commission Agenda

The other significant issue related to the License Inspector is item -C- on the agenda, the advertising of the license inspector position. It was pointed out by Mr. Clemmons that the advertising of jobs issue was decided in 2006 to advertise in and out of the county personnel system. However, the personnel policy was not updated related to the 2006 change.

This current commissioners changed the personnel policy, removing the recommended point system, early on during the current commission's term of office.

Commissioner Clemmons moved for -C- to be tabled, a second was received and it was tabled.

Commissioner Clemmons' vote was correct yesterday. It saved further embarrassment to the citizens of Jackson County and corrected a wrongful action. This writer says thank you.

I have not agreed with many of Mr. Clemmons' political actions, but I have the utmost respect for his business sense and success along with his business leadership abilities.

My thoughts concerning this latest update and the 6PM WAFF-TV, Ch 48 interview of Mr. Tyler Smith this evening.

Commission Chairperson Sadie Bias and Commissioner Jack Smith refuse to accept responsibility for their actions and error. Instead they take the course of blaming others. A very sad state of affairs.

Sadie Bias and Jack Smith, this mess is your fault, problems and wrongful actions you created concerning the license inspector. The three commissioners vote to terminate Mr. Tyler Smith's employment (Tyler Smith is the grandson of Commissioner Jack Smith) is correcting your wrongful actions.

To make matters worse, the former license inspector followed in the two errant commissioners steps today in an interview on the 6PM evening news on WAFF Ch 48. In the interview shown Mr. Tyler Smith placed blame on politics and the commissioners who terminated him. Saying in reference to Commissioner Clemmons, "he threw me under the bus."

Mr. Tyler Smith failed to take responsibility for his personal actions relating to the theft and robbery. An individual who wishes to make amends for his criminal acts must take responsibility for his actions. No where in the 6PM interview shown did Mr. Tyler Smith display any sign of remorse or an indication to make amends for his crimes. Today in the interview he blamed politics and other people for this current situation. Conveniently failing to mention that he is a convicted felon and that is the reason for his termination.

Jackson County Commission, Commissioner Allen Stands Up For What is Right - County License Inspector and Probate Judge Issue

Today was a work session of the Jackson County Commission. Several important topics were discussed.

Prior to the agenda, Chairperson Bias directed the County Administrator to read a letter from her to the public concerning Probate Judge Hambrick's pay. The following is the letter concerning the issue. The Letter from the Commission Chairperson was also supported by a letter by the County Attorney addressed to the Commission Chairperson. (Ms. Bias refused to produce a copy of the letter upon request after adjournment. She provided all other members of the press present with the letter. I requested the documents from the Chairperson pro-tem, Mr.Jack Allen. Mr. Allen provided a copy of the documents posted below.) Click on image for an expanded view.

Concerning this letter (my comments in red): In my opinion it is double talk to justify an action. Examples: Attorney General's (AG) opinions are used as references. What is not stated is the fact not one of the AG opinions pertain to a Probate Judge or the removal of a Judges pay. AG opinion # 2007-029, which is utilized as an authority to take the judges pay says, "the sheriff must correct the administrative error regarding longevity payments by making the six percent supernumerary contribution to the county general fund based on the total amount of longevity payments received." An AG's opinion is not an authority to withhold or remove pay. AG opinion 2002-216 deals with a county treasurer and states, "The office of county treasurer is not included in the list of county officials entitled to receive cost-of-living raises pursuant to the Omnibus Salary Bill for county officials." The probate judge is not a county treasurer.

The letter also states, "the constitution provides generally that the salary of public officials shall not be increased or decreased during their term of office." That is not what the Alabama Constitution says, quote: "nor shall the legislature or any county of the state in any manner or by any means decrease, or authorize the decrease of, the salary, fees or other compensation of any such officer, during the term for which he is elected or appointed." There are no generalities to the statement. The supreme law of the state FORBIDS the decrease of an elected or appointed officials pay in "any manner or any means." That includes any reason by the commission. AG opinions do not circumvent in any way form or fashion the Constitution of the state; nor does a Commission chairperson circumvent the Constitution of the state. The key to this is the statement in the Constitution "in any manner or by any means decrease or authorize the decrease." There are no ifs, buts or "generalities," the statement is final and may only be ruled upon by a Court of the State, not a county commissioner or the authority of the commission. It is significant in the county's justification they use the words "public official" instead of an elected official. There is a difference as stated in Alabama's Constitution between a classified public official and an elected official.

Another interesting comment in the letter. Quote, "...the issue of the overpayment of the Probate Judge's salary based upon the application of the local act applicable to the Jackson County Probate Judge to the Omnibus Pay Bill was not the subject of the finding and therefore was not specifically addressed." In the previous paragraph the Omnibus Pay Bill and the local law was the reason given for the Judge's reduction and garnishment in pay. This is double talk in the attempts to justify a violation of the state's constitution in reference to an elected officials pay.

It was the county commission which authorized and paid the probate judges pay at the previous level until this year. The judge had nothing to do with the receipt of his salary. The county commission in this case is serving as a defacto judicial court ruling on the validity of a constitutional issue in which they have no authority to make such a ruling. Not only do they decrease the judges pay in violation of the Alabama Constitution, (They conveniently left out the several pay increases received by all officials, including the probate judge.) they now come forward and institute a garnishment action of the judges pay without any authority of law or order of any court.

AGENDA ITEMS:
1) A prescription discount program was presented by Mr. Ron Howard of Welldyne, Coast2Coast Pharmacy discounts. WHNT-TV of Huntsville, Al. covered a previous presentation in Limestone County. http://www.whnt.com/news/morganandlimestone/whnt-limestone-county-offers-new-prescription-drug-discount-card-20111004,0,6755361.story 2) Several issues were covered concerning the Public Works Department by Mr. Phillip Widner, County Engineer. 3) The Personnel Policy needs more work and updates before being approved. Leave without pay is one of the areas which must be looked at and changed. 4) Chairperson Bias stated the commission job advertisement resolution for the County License Inspector position within the county personnel system only would be rescinded. A new resolution is to be submitted before the commission at Monday's meeting to advertise the position within the county personnel system and to the general public. 5) The License Inspector official vehicle is broken down. The current inspector is currently utilizing his personal vehicle. However, there is no money to reimburse the license inspector for mileage. A discussion ensued to allow Ms. Erickson, County Administrator to make payments to cover mileage reimbursement. 6) Commissioner Allen requested an item be placed on the agenda for Monday's meeting to terminate the current temporary license inspector. Chairperson Bias stated she did not agree with Mr. Allen's request. Mr. Allen replied it did not matter if she agreed or not, it is the proper procedure in accordance with the commission agenda rules to place an item on the agenda of the regular commission meeting to be brought forward in the work session for inclusion on the following regular session. Bellefonte, A Continuing Saga of Abuse, Neglect and Bad Government

$8-10 billion dollars the cost of one nuclear reactor.

Vultures await the final disposition of Bellefonte. It seems as if the vultures know death is in the air at this zombie reactor.

Local reports indicate layoffs abound for the contractors at Bellefonte as the TVA runs short on money. The cash strapped TVA apparently is transferring funds to Watts Bar from Bellefonte in the attempt to complete that troubled reactor up river in Tennessee. One nuclear reactor costs between $8-10 billion dollars. With cost overruns it will be more.

Laid off Union contractors report severe corrosion of metal parts and a general state of ill repair of the stripped, reactor at Bellefonte. Pipe fitters, electricians and carpenters report serious degraded conditions at Bellefonte. The nuclear plant's quality control lapsed during the period of the cancelled construction permit where unskilled laborers literally ripped the guts from the nuclear reactor. There have also been reactor containment retaining tendons which have broken due to corrosion.

An antiquated nuclear construction permit which was reinstated by the NRC without one vote of approval from the NRC-1 vote disapproved and 3 votes jointly approved/disapproved. That breach of nuclear safety law landed the NRC and the TVA with their cadre of lobbyists from the Nuclear Energy Institute, NEI, in the Washington D.C. Federal Court of Appeals, where we await the decision of the court.

THE NUCLEAR INDUSTRY IS THE WATCHDOG OVER THE NRC. It has been discovered the NEI, the nuclear industry lobby, has staff working at the NRC's new reactor licensing division. Nuclear Energy Institute, the nuclear industry's lobby, prepares policy, trains and participates in nuclear planing; including safety and security planning and new plant licensing. An Abuse of Power - A Review of the Jackson County Commission's Dog & Pony Show Acts

Lets review ten (10) acts of the current Jackson County Commission which have resulted in costing citizens thousands upon thousands of dollars in unnecessary legal expenses and brought great discredit upon the citizens of Jackson County. There are more despicable and questionable acts of this commission but these are the ten highlights of what could be described as an "abuse of power."

There was the (1) Courthouse Security fiasco and the cancellation of the recommended (2)personnel hiring system which resulted in the resignation of the County Personnel Board President and others. This action by the commission allowed for the hire of commissioner relatives. "Education is discrimination," says Commissioner Smith. A county commissioner only has power when they are sitting as a group. For some reason the commissioners seem to think they have some sort of individual power, they do not. Chairperson Bias was right in the below video concerning Jack Smith's inappropriate intervention into the personnel process. (3) Abuse of Power - "Code of Alabama Section 11-3-11 Powers and duties generally. (a) The county commission shall have authority:" Note the law indicates the "county commission" has authority, not an individual commissioner. The only person on the Jackson county Commission which has authority in day to day operations is the Chairperson of the Commission.

There was the (4) Engineer fiasco involving different organizations in town. Attempts to influence the commission, complete with Chamber of Commerce and religious leader intervention into the show. http://arklite.blogspot.com/2010/01/jackson-county-commission-special.html

When religious leaders and the Chamber become embroiled in local politics (Which is certainly their right to do so and my right to comment.) there is a reason for the outside political involvement. Is it concern or is it a political party move?

Clemmons and Bias attempted to hold their own version of a Special Called Engineer hire meeting outside of the published agenda. Complete with religious and Chamber input. Which leads me to wonder about the political planning involved. They were reminded that law required them to stick to the published agenda. But for such a group apparently law, policy, proceedures and leadership matter naught.

Allow an outside agency to select the engineer said the right wing political party influence. There's more to that act than meets the eye!

Enter more scandalous decission making in the commission's circus. (5) Personnel policy and personnel decision making in secret, outside of the county and calling it mediation. I call it an excuse to conduct county government operations in secret under the color of law. (6) Commission agenda policy was deliberated at the secret mediation sessions.

Bias had no problem muck raking a county engineer applicant through the mud with alleged charges which were not valid. Firing another license inspector for positive drug tests as reported by officials. (7) Now enter a convicted felon, theft 2 and robbery3, the Grandson of a County Commissioner, deals are struck. That is not all in the decision making failures of the circus antics of the county commission costing the tax payers thousands upon thousands of dollars paid to out of county attorneys.

There was the (8) County Park Dog & Pony show, a vote trading scheme? The placement of Commissioner Horace Clemmons on the County Park Board. for what purpose? To end the Jackson County Park Board so the County Commission could control the funds. Jack Smith was the key to the act. Clemmons was placed on the Jackson County Park Board with 2 votes of the commission, Jack Smith and Horace Clemmons.

In my opinion, a trade, a deal was struck. Smith's grandson's job for Clemmons' scheme concerning the park. Control of the park money is necessary for Clemmons' stated goal of a park at the Walls of Jericho Parking area. Clemmons stated early on in his political foray into county politics, "If I accomplish nothing else I want to see a camping area park at the Walls of Jericho parking area." When these issues were brought up to the commission by me, Bias, Clemmons and Smith attempted intimidation and made threats.

The commissioners approach to issues in several cases have been deceitful, secretive and manipulative.

Lets not forget the TVA-in-lieu-of-tax fiasco (9) where closed meetings were scheduled and deals were made between the commission and legislative delegation, in secret.

And now for their closing act of 2011: (10) The county commission decreases and removes part of the Probate Judges pay in the amount of $18,000.00 +. Completely ignoring Amendment 92 of the Alabama Constitution prohibiting such actions. Ignoring the fact it was the County Commission which authorized the Probate Judges pay level during his current term in office.

Looking at the totality of these events involving the county commission, the singular example of bad government which represents the most costly (thus far) in money and principle to the citizens of Jackson County are the court ordered mediation instances relating to the county engineer and the county park.

In these cases decisions were made and deliberated outside of the commission agenda. Deliberations were made out of the county in secret sessions. Personnel policy and the agenda policy were changed in these deliberative sessions in secret. This is an example of why the judiciary should use extreme care in making decisions in which the legislative branch of government would normally make in an open session. Mediation must never be utilized as an excuse for conducting legislative decission making in secret, which apparently occurred in this case.

Jackson County Commission Meeting - Probate Judge issue continues

Today was a Work Session and Regular County Commission Meeting.

The big item during the commission work session was a presentation by Mr.Gary Lackey, Attorney for Judge Floyd Hambrick related to the commission's vote to remove $18,000 in pay from Judge Hambrick to be deducted monthly. The commission has failed to adhere to Amendment 92 of the Alabama Constitution prohibiting the raising or lowering of an elected officials pay while they are in office. Letter presented to each Commissioner, County Attorney and County Administrator from Garry Morgan concerning the issue with Amendment 92, Constitution of Alabama It was noted that Commission Chairperson Bias tore her letter in half. I asked of Ms. Bias, "Is that the way you deal with letters from citizens?" Ms. Bias had no reply.

To complete the "Dog and Pony Show" antics of the county commission during the work session, some on the commission seem to think the court records housed in the basement of the Courthouse are theirs to determine the disposition. A statement was made that office space is needed and the court records should be moved. Apparently some commissioners in their arrogance fail to realize the records are not theirs to determine the disposition.

Scottsboro City Council

Last night was a work session and a regular city council meeting. The big issue was the decision concerning the city radio system. The city will purchase a new digital radio system off of the state bid list. This will cost approximately $213,000. Several companies made presentations at the work session but in the end the city council voted for purchasing the new radios off of the state bid list.

Various area Communications Companies listed spoke about the new city radio system. Some attempted to clarify statements others opposed the issue, items 2-5. Mr. Lewis Pleasant spoke about access issues in the Dear Meadows Estate subdivision located off of Gant Rd. and Shelby Dr. A question of a bond was mentioned. Apparently the city cannot locate any bond concerning the subdivision project. There is a road in the subdivision which was supposed to be complete which is not complete, item 1 on the agenda.

In other business: 1) The city Attorney made a presentation concerning the purchase of additional property for the Cedar Hill Cemetery. This property belongs to Mr. Larry Ward, is approximately 9 ac more or less and it was reported valued at $162,000 per appraisal. Mr. Kennamer, the City Attorney, stated Mr. Ward would sell the property at this time for $120,000. Several council members stated they would like to see the property prior to a purchase. There was no action taken on the issue at this time. Mr. Kennamer stated if the council waited till after the first of the year Mr. Ward would probably sell the property for the amount plus tax cost. 2) Apparently The Impact Learning Center is interested in moving to the old city police station on John T. Reid Parkway; lease, rent or sale options were not discussed. 3) CDG Engineering was awarded the engineering bid for the South Broad St. paving project in 2 parts - Professional Engineering Services, $22,900.00 and Construction Engineering Services $52,500.00 4) Patrick Lumber company was awarded the bid for installation of the City Hall Generator System for $17,194.00. 5) City council meeting dates for Jan 2, 2012 and Jan 16, 2012 will be moved to the following Monday as the dates listed are holidays.

Important issues were: 1) a $500 one time pay increase. this increase did not apply to elected officials.

Commissioner Clemons did not approve the $500.00 one time pay raise.

2) Sheriff's department to purchase 2 radar speed units from Commissioner Clemons pay fund.

3) Then we have the issue of the license inspector. The commission voted on a 3 to 1 vote to hire a full time license inspector. the vacancy announcement will be made within the county personnel system only.

Commission Chairperson Sadie Bias hired the current License Inspector, Bradley Tyler Smith.

At last Thursday's work session the commissioners agreed to advertise the position within the county system and outside of the county system. At Mondays commission meeting Commissioner Allen was not happy with the decision and voted against the issue. Mr. Allen stated, "that is not what we agreed on at Thursday's meeting." After the commission meeting Monday Mr. Allen commented to me that the Commission Chaiperson Sadie Bias and the License Inspector's Grandfather, Commissioner Jack Smith had apparently already made up their mind about the hire. Bradley Tyler Smith was hired at the Public Works Department and then hired for a temporary license inspectors position. The License Inspector is an admitted felon, theft 2nd degree and robbery 3rd degree, Criminal Case #2010- 544 & 545, the Grandson of Commissioner Jack Smith.

Commissioner Jack Smith, District 1, involved with the hire of his Grandson as the County License Inspector. Mr. Smith has been involved in other controversial issues including the appointment of another Commissioner to the County Park Board with a total of 2 votes, his and Commissioner Clemmons. It has been reported there was a trade of supporting votes concerning the appointment of Commissioner Clemons to the Park Board for the hire of Commissioner Smith's Grandson.

The License Inspector is enrolled in Drug Court but has not completed the legal proceedings.

A license inspector in Alabama has the authority of law enforcement in enforcing the licensing laws of the State and County. In the case of Jackson County the license inspector is a felon. Apparently if you are a relative of a County Commissioner law does not matter.

Bradley Tyler Smith was not bonded upon hire or immediately after the hire. The commission purchased a bond of $25,000 from Auto-Owners Insurance Co. signed by the local agent Thomas Harding on Nov 14, 2011 after the issue was brought forward to the commission recently. The Commission Chair and County Attorney stated they were not aware of any requirement for a bond and previous inspectors had no bond. The License Inspectors bond has not been approved by the Governor. Alabama law requires a license inspector's bond to be approved by the governor.

On Monday Dec 12, 2011 the Scottsboro City Council held a work session prior to the regular meeting.

Jackson County's 911 call center such as the one pictured above will be affected by Scottsboro's purchase of new radio equipment.

The big issue involved the purchase of new radio equipment for all city agencies. If all new digital equipment is purchased it will cost the city of Scottsboro in excess of $200K. Happy Thompson made a presentation along with Lamar Miller and Mike Boylan. The purchase of the new equipment would allow trunking of radio communications. If the trunking system is taken down for whatever reason the question is what will be utilized for a backup? Backup Communications is a must! Failed communications has been experienced during natural and man made disasters due to a centralized location of all communications resources. Other questions involve: Who will work on a new digital system, will all work have to be accomplished out of town? Will the North Alabama emergency net frequency be utilized and accessible on the system? Apparently other area departments who will not have the digital equipment will not be able to communicate with each other. There was a motion made to table the issue at the regular council meeting until more definitive information could be gathered on the subject.

This is a problem which must involve the entire county, not just Scottsboro.

Other issues discussed at the work session were the resurfacing of South Broad Street project and FEMA fund reimbursement for the so called "Gravity Wave" storm in April 2009. $30K will be put aside for the purchase of emergency power generation equipment at City Hall. Mayor Potter reported that $61,657 has been approved for payment and a $15,450. balance remains unpaid.

In other business: 1) Jim Flowers was appointed by Mayor Potter to the Planning Commission.

2) A public hearing was held for a liquor license for the Raceway located at 2409 S. Broad St. 1 citizen spoke against the license being granted. Mr. Hall stated there should be a prohibition on alcoholic beverages in Scottsboro. He stated, "alcohol usage causes the crimes of spousal and child abuse to rise." He also stated crime in general increases as a result of alcohol abuse. The alcohol beverage license was approved by the City Council.

At Bellefonte, a cancelled nuclear construction permit was reinstated in a stripped nuclear plant without one singular vote of approval from the NRC Board. Local politicians all showered praises on the TVA while ignoring serious safety problems relating to site geology, hydrology, river flow reversal at the inflow-outflow cooling area and ground collapse related to sinkhole, Karst Terrain, problems discovered on the new Environmental and Safety reports for the AP1000 reactors.

Local environmental groups attempted to require the TVA via the NRC to place forward a new nuclear construction licensing process due to the old permit failed to identify problems identified in the new AP 1000 reports. The NRC denied the request.

The TVA and NRC is involved in a Federal legal action due to their ignoring site safety and the law thus endangering the public. Arguments have been made in the case before the Federal Court of Appeals. A decision will be made soon. Ignore the danger, ignore the law, ignore the problems: problem solving the nuclear way, a path to disaster?

The problem is politics and money. The nuclear industry has supplied Federal Politicians with large amounts of campaign money; state, county and local governmental entities are supplied with TVA in-lieu-of-tax payments and decades of promises, some promises true, many false.

Jackson County, Alabama is a depressed area with a decreasing population, approximate current population 53,000. 14% of Citizens income in Jackson County are below the poverty level, 78% have a high school education or higher, 22% have less than a high school education of which 6% are functionally illiterate.

Current amount of river water withdrawal for Jackson County Alabama is 6.5 million gallons per day. A Bellefonte nuclear plant would increase the daily Tennessee River water withdrawal 4.5 times the current rate for Jackson County.

The current Bellefonte nuclear facility was built over Karst Terrain. The TVA claims there are no sinkholes on the property, but that is a dangerously false statement. There are 2 known large sinkholes on the Bellefonte nuclear plant property as demonstrated on the TVA/USGS 1970 topographical map. One of the sinkholes is located next to the proposed AP1000 Unit 3 site, another large sinkhole exists near the cooling towers in a fenced in area. Geological Survey maps available at the University of Alabama Cartography division indicate there are 58 caves within 5 miles of the Bellefonte area. The entire Bellefonte area is classified as a likely sinkhole area. The NRC dismissed the geological evidence and historic data presented to them in an official report in 2008 during the Environmental Scoping Session.

Bellefonte is located in an active seismic zone, less than 2 miles from the Sequatchie Fault and adjacent to a minor fault along River Ridge which is less than 1/4 mile east of the Bellefonte nuclear reactors.

The Bellefonte Nuclear Reactors have a series of 45 foot vertical supporting anchor rods drilled into the Limestone rock to stabilize the reactor structure. Rock which is noted for its ability to fracture and allow moisture seepage, characteristics of Karst Terrain geology. There have already been 8 instances of vertical supporting tendon cable couplings breaking over the years, the last being 2 years ago. It is possible that the occasional small ground tremors, along with the alkalinity of the limestone rock, are contributing factors affecting the supporting tendon structure breakage. This is part of the critical primary containment structure for the nuclear reactor and represents a containment structure failure a decade prior to the nuclear reactor becoming operable.

The river current in the area of Bellefonte's outflow and intake pipes reverses current at times of fast flowing river current. The area is a large elongated bay area along the west river bank where the river forms a very large deep water eddy within the bay. This problem was not identified in the original safety and environmental reports. It was reported in the recent AP1000 safety and environmental reports. The problem will result in the warmed outflow going back into the water inflow, which is supposed to be cool water.

There are meteorological changes in our area due to climate change. The frequency of tornadic storms have increased, thus increasing the risk of catastrophic damage to the nuclear facility. Also, during the period of draught 3 years ago, it was noted that ground collapse was evident within the Bellefonte reactor security zone.

In August of this year, the TVA approved the construction continuation of the Bellefonte Unit 1 nuclear reactor. The continuation of a stripped, cannibalized nuclear plant which the NRC reinstated the cancelled construction permit prior to the TVA approving to finish its construction. The approval of an antiquated Bellefonte nuclear construction permit appears to be for the sole purpose of circumventing modern safety standards and newly discovered environmental issues not previously addressed in the original 1970's environmental reports.

Another issue for the current debate: the Bellefonte Nuclear Reactor Unit 1 will cost the TVA ratepayers $9 billion dollars if it is completed by 2019. TVA can not afford Bellefonte, it has a $25 billion dollar debt, over $25 billion dollars owed in interest on its debt. Long term TVA commitments concerning fuel options, leases and the debt bring the TVA's long term financial commitments to approximately $68 billion. The TVA has proposed a financing scheme to sell the Watts Bar Nuclear Plant and the John Sevier Combined Cycle Gas Plant to fund the completion of Bellefonte. This scheme has not been approved by the full TVA Board and does not meet the requirements of the TVA Act; it is another example of TVA's failure to disclose important aspects of its decision making process to the public as required by the Federal Sunshine Act.

The question: will the NRC and the TVA follow good sense and responsible governmental practice to protect the citizenry from error, defect and deceit as required by nuclear safety law, or will they support the nuclear energy industry by placing money before the value of human life? The current trend of the TVA and NRC demonstrates the citizenry must take a back seat to the nuclear corporations hunger for money over life.

"This definition was modified by the Anabolic Steroid Control Act of 2004, which was signed into federal law in October 2004. Chief Dawe stated Monday in our sit-down discussion with him and the Mayor, "there was insufficient evidence to initiate an arrest." The Mayor indicated the officers were taking steroids for body building purposes. There was a discussion of dietary supplements vs prescription drugs. However, after further inquiry and research there are no legal dietary supplements containing Testosterone.

The lack of further investigation to facilitate an arrest establishes a precedent for two standards of law, one for public officials and one for the citizen. Previously in Scottsboro there have been unfortunate political decisions where crime by influential citizens is overlooked while the average Jane and Joe is prosecuted. Those who speak up about injustice, misconduct by politicians and unjust influence by influential citizens have had to tolerate harrassment and illegal actions by authorities including law enforcement.

Garrity Rights Issue discussed in the Daily Sentinel article by District Attorney.
The Garrity Right is not a right to circumvent the prosecution of violations of the law by police or for that matter any public official. Nor does Garrity extend a free pass to not investigate criminal activity. In this case is there confusion concerning the components of protection and prohibition? There is a clear line between criminal investigations, criminal prosecution and administrative acts such as suspension and termination of employment.

The fact responsible public officials attempt to "muddy up the issues" utilizing Garrity Rights to cover-up criminal activity of police officers is problematic for the public officials involved. It is also a slap in the face of citizens and lady justice relative to equal protection under the law. Tonight was a regular meeting of the Scottsboro City Council.

Prior to the council meeting I sat down with Scottsboro Mayor Melton Potter and Chief of Police Ralph Dawe to discuss lingering concerns related to steroid abuse involving Scottsboro Police Officers. The following is a synopsis of that conversation.

I expressed my concern that the officer steroid scandal still looms as the question has not been answered concerning illegal steroid usage versus over the counter usage.

Paraphrased comments from Mayor Potter and Chief Dawe: The Officers involved work out with weights and apparently were taking diet supplements which contained steroids. Bad judgement is not the same as illegal use of prescription steroids. Any steroid usage is against department policy. As a result the violators of department policy were dealt with administratively. Chief Dawe assured me if he could prove the officers involved had violated any State or Federal Law, as difficult as it may have been, they would have been arrested.

Chief Dawe went on to say, "this incident has damaged citizen trust and that trust must be earned." He assured me, and assures all, that the Scottsboro Police Department will do their best to insure citizen trust is earned and the Scottsboro Police Department will maintain high professional standards.

Mayor Potter stated, "those involved will undergo enhanced drug screening for steroid usage. The officers involved are also receiving professional counseling."

I expressed concern to the Mayor that I thought he should inform the public of these additional facts as they are important and relevant to this situation and the public has a right to know all the facts concerning this case. The Mayor did not did not address the additional revelations at tonight's city council meeting.

I informed the Mayor and Chief Dawe that I would provide a synopsis of our meeting to the public.

Chief Dawe stated to me if anyone had any questions concerning this incident they could contact him at the Police Department and he would discuss any concerns with them.

Tonight was a City Council work session.
The Agenda: 1. Presentation by Matt Adams of Regions Bank concerning 2002 bond issue refinance. Mr. Adams stated there would be a savings of approximately $65K to $75K. There would be no extension of time on the bond issue, this is a reduction of interest. Different scenarios were discussed concerning savings distributions. The council members agreed that a lump sum payment would be the best option and suggested the amount of savings be applied to purchase a new roof for the library. The issue cannot be refinanced until the First Call date on the bonds which is Feb. 2012. Closing on the refinancing may begin 90 days prior to the First Call date according to the Regions Bank Representative. 2.City Wide Radio System purchase. 217 new radios will be purchased off of the State Bid List costing $213,540.13. This purchase is scheduled to comply with new public service frequency changes mandated by the Federal Government. 3. City Financial Director assistant discussed.

Reports: Mayor Melton Potter (pictured below) released a public statement concerning the incident involving the suspended Scottsboro Police Officers first reported in the Scottsboro Daily Sentinel on Wed., Nov 16, 2011. The story has also been extensively reported on WAFF, Ch 48 News.

Mayor Potter's Statement: "On November 9, 2011, after an internal investigation, four Scottsboro Police Department Officers were suspended without pay for the use of Testosterone. Lt. Shane Clarke, Officer Gerald Mount were suspended for 4 shifts. Officers Chris McIllwain and Jeremy Ake were suspended for 3 shifts."

"It is mine and Chief Dawe's belief that these are isolated incidents and are not indicative of an inherent problem within the department."

"I have complete confidence in the abilities of Chief Dawe and his staff concerning this investigation. We do not expect to uncover any more information concerning this matter at this time."

"The names and reasons for the suspension became public this morning in a court proceeding and that is why I am releasing this information at this time. It is still my belief and policy that information concerning our employees is confidential as long as no crimes are committed."

The TVA held its Quarterly Board Meeting yesterday at the Mississippi State University Campus in Starkville, Ms. (Last update Nov 21, 2011)

Prior to each board Meeting the TVA Board conducts a listening session for citizen stakeholders to express their concerns. There were 9 speakers who spoke including myself. Many spoke on Energy Efficiency. One member of the Mississippi Public Service Commission spoke to the Board about his and others concern about TVA debt. At one point the Mississippi PSC commissioner compared TVA debt accountability to the activities of Enron.

At yesterdays TVA Board meeting it was reported that TVA's Statutory debt was $24.431 (long and short term debt). TVA's estimated values of financial instruments on page 116 of TVA's Financial Report reflect the following data as of Sep 30, 2011. Long term debt net: Carrying amount of the long term debt- $23.949 billion; Fair Value of the long term debt- $29.190 billion.

Page 63 of the 10K reflects the following Long Term Commitments and Contingencies: Debt-$24.659 billion; interest on the debt-$25.190 billion. Total long term commitments which includes fuel contracts, leases, environmental agreements, litigation, debt, interest and other-$67.415 billion.

Note: TVA's Chief Financial Officers comment and question: The Chief Financial Officer of the TVA, John Thomas, III, stated regarding debt and reporting of financial disclosures, (paraphrased) "we need to perform 'technical accounting' to reflect our financial status." MORE PENSION PLAN WOES?
On page 121 of the current 10K TVA's Pension Plan demonstrates a $4.709 billion unfunded shortage. Current Pension fund obligations for 2011- $11.255 Billion; fair value of pension fund assets- $6.546 Billion; this leaves a Pension fund shortage of $4.709 Billion. TVA pension plan obligations have increased by $1.1 billion over the FY2010 year.

TVA has stated they intend on selling 2 assets to fund the finishing of the Bellefonte Nuclear Power Plant. On this mornings Financial Call the TVA stated they have gained approval for the sale of the Sevier combined Cycle Gas Plant and Watts Bar Nuclear generation assets from Congress. That is not what the TVA Act allows. Note the link and excerpt from the TVA Act below.

TENNESSEE VALLEY AUTHORITY ACT Section 4(K)(c), quote: "That no land shall be conveyed, leased, or transferred, upon which there is located any...power plants...That no transfer authorized herein...shall be made without the approval of the President of the United States..." The intent of the law is clear to a reasonable person. Prevent the sale of any current or future electrical generation assets and associated properties without the approval of the President of the United States. Congressional approval is not mentioned in the paragraph.

BELLEFONTE CASE before the U.S. Federal Appeals Court, Washington D.C.
Legal case relating to Bellefonte Nuclear Power Plant: Pg 138 in TVA's 10K Report; "Case Regarding Bellefonte Nuclear Plant Units 1 and 2...Final briefs have been submitted, and oral arguments took place on October 20, 2011."

The TVA under its current leadership is unable to manage the organization without massive debt. TVA's debt must be brought under control. TVA's continued unwise moves into expensive nuclear power will continue to increase TVA's debt. More images to follow.

The citizens of Scottsboro have 2 choices for recycling, both are volunteer efforts. Both remove a substantial amount of waste from the Scottsboro landfill waste stream which saves landfill space and saves citizens money. The City of Scottsboro offers volunteer curbside recycling.

A private business venture is also available, "Recycling for Scottsboro," a private broad range recycle program, more information below.

Scottsboro City Council - Remembering Buddy

In January 2008 I asked this question of Buddy, "What is your #1 priority for 2008?" This was Buddy's reply,"There are several issues which are priorities. We must get our spending under control, oversight of the departments are important. All city employees must work and pull together, particularly in the Mayors absence. The city's employees and officials must be united to accomplish the peoples business."

Buddy Simmons served the citizens of Scottsboro as a Fireman, retiring as a Captain after 28 years of service. Buddy continued his service to the citizens of Scottsboro as a City Councilman, 2004-2008. Buddy has responded to that final call which we all must make. But not all can say they served the citizens of Scottsboro in such a distinguished manner as Buddy Simmons

"A memorial service will be held for Simmons Thursday, at 3 p.m., at Scottsboro Funeral Home Chapel. Burial will follow in Cedar Hill Cemetery. Jackson County Commission Work Session - Public Hearing for North Jackson Park - Little Napoleon - Commissioners Attempt Intimidation of Citizen Over Ch 48 Issue

At 3PM today the Jackson County Commission held a Public Hearing to allow public input concerning Facilities at North Sand Mountain Park. The county commission intends on removing the tennis courts and adding a concession facility, restrooms and a pavilion. funding will be accomplished from locally raised money and county park money. The public hearing was adjourned at 3:13PM. Between the public hearing and the regularly scheduled commission meeting I asked the commissioners if anyone had a comment about the Ch48 News article about Mr. Smith's Grandson's hiring and reports that the hire involved vote trading concerning the county park issues involving Commissioner Smith, Commissioner Clemmons and Commissioner Bias. Several very spirited exchanges ensued between the 3 commissioners and myself.

Jackson County Chairperson Sadie Bias gives me the evil eye at a meeting between the County Commission, Legislative Delegation and citizens at Scottsboro City Hall concerning the TVA in lieu of tax issue. I asked Ms. Bias about the Commission General Fund balance. She did not know the balance, it took 2 months to acquire the General Fund balance form the County Commission.

This afternoon, Chairperson Bias informed me after my questions about vote trading and the hire of Commissioner Smith's Grandson "If I was a man I would take you outside and whip you." Which I replied, "such a dignified comment from the Chairperson of the Commission."

I inquired of Ms. Bias if there was a bond required of the license inspector. I also inquired of the county attorney after the meeting. According to Bias there is no requirement for a bond for the license inspector. The County Attorney stated he was not aware of the requirement of a bond. That is not what the Code of Alabama has to say about this situation.

" Section 40-12-11- Bonds of license inspectors. Before entering upon the duties of their office, all license inspectors shall execute to the State of Alabama a bond, to be approved by the Governor, in amounts to be fixed by the Department of Revenue, for the faithful performance of their duties.
(Acts 1943, No. 122, p. 123; Acts 1961, Ex. Sess., No. 208, p. 2190.) Code of Alabama 40-12-10 (i) The county commission may appoint deputy license inspectors, and the acts of such deputies shall be recognized as the acts of the license inspector...(k) License inspectors shall have the same power to arrest persons violating the revenue laws of the state as is now vested in the sheriffs of the state and shall receive the same fees for such service."

Commissioner Clemmons informed me this afternoon, "You are a trouble maker, I have an expressed disdain for you, you do not tell the truth." My reply,"Horrace, you are not telling the truth.Yes sir, I am a trouble maker for politicians such as yourself who think they must control everything. You fail to realize it is the citizens who are your boss." Clemmons replied, "All the citizens except for you."

Commissioner Clemmons was observed and overheard earlier in the day attempting intimidation of other county elected officials. Another County elected official was overheard telling Clemmons, "I don't work for you." All of this transpired in the hallway outside of the commission office. This is not the first time "Little Napoleon" Clemmons has attempted intimidation and manipulation of county officials. "Little Napoleon" Clemmons attempts to project that he is in charge of the county commission.

Commissioner Smith commented, "I'm going to sue you for lying about me." I informed Commissioner Smith, "Sue me, you are an elected official. I did not lie, it was reported on Ch 48 news. I had nothing to do with the Ch48 report. You're an elected official, I'll talk about you all I want." Smith then commented, "You said on your blog my Grandson was hired for vote trading." My reply, "No, that is not what was stated, I linked the Ch48 web site story and stated it has been reported there was vote trading." Smith said, "I don't appreciate lies, I'll meet you outside afterwords." I informed Smith, "there is no lie, you have a problem. If you have something to say, say it now." Smiths reply, "I'll meet you outside after the meeting." After the commission meeting I met Mr. Smith outside the courthouse entrance and we had a long discussion. Mr. Smith was emphatic stating, "I made no vote trading deals concerning the hiring of my grandson and placing of Horrace Clemmons on the County Park Board. I did not know Tyler was going to be hired for the job until the commission meeting. I abstained from voting for his hire."

On July 26, 2010 the County Commission met and a most unusual vote transpired. Mr. Clemmons was voted onto the County Park Board. Mr. Clemmons and Mr. Smith voted Clemmons onto the County Park Board. Mr. Clemmons stated to me after his election, "if I accomplish nothing else I want to have a camping area built at the Walls of Jericho Park parking area." I think that was his purpose of being placed on the park board and manipulating the dissolution of the Jackson County Park Board. Then placing control of the park under the County Commission. Clemmons could project his control over the park funds to begin the process of the Walls of Jericho campground. The expense to the citizens of Jackson county do not seem to be a concern for him. I publically inquired of Mr. Widner, County Engineer, were employees being threatned with termination if they discuss matters with commissioners? He told me if they do not utilize their chain of command they will be fired. Does this mean county employees do not have the right to discuss concerns with their elected officials without the fear of termination? His answers were given in public. I also asked Mr. Widner, "were employees denied emergency medical care?" He told me, "no, I don't know who told you that but that is not true." Employees at County Public Works have told me during an injury an employee was denied an emergency ambulance call.

There is a serious problem concerning leadership with the Jackson County Commission. Intimidation and manipulation is apparent on the part of Clemmons and Bias. Apparently there is no open door policy or the policy is a faux policy which may result in retribution. Employees are not allowed to discuss concerns with their elected commissioners under the threat of termination. Unfortunately it appears the Chairperson of the Commission is part of the problem.

1) Ms. Pat Blakenship from Court Collections Services, CCS, made a proposal for the City of Scottsboro's courts and fines collection services. CCS is a local service as compared with the current courts collection corporation whose home office is in Georgia. 2) Recyclables bid recommendation, the bid committee recommended The Taylor Group with a bid of $22.00 per ton. Rock 10 submitted a bid of $20.50. There is a 130 tons of recyclables involved. 3) 1 time annual holiday pay raise for employees, the amount of pay will be based on years of service. 4) Holiday discussion, change in the Employee Handbook concerning holidays, addition of "Good Friday." 5) FY 2012 Airport improvement project pre-application. Total project cost $1,423,611, the city's share will be $42,918.00 (2.5% the state will also contribute 2.5%)

UPDATE: Nov 11, 2011 - Press Release from Commissioner Jack Allen concerning issue. Mr. Allen has indicated he will run for the Chairman of the Jackson County Commission in the next election, in the Spring of 2012. Currently it appears Ms. Bias and Scottsboro Council President Matthew Hodges will run for the commission chairperson position.

In response to the story on WAFF TV 48 about the Jackson County License Inspector and his alleged charges, WAFF TV 48 stated that all the Jackson County Commissioners knew of this information beforehand and that is an incorrect statement. Below are the details of his hiring.

In August, the commission voted to give the chairwoman permission to hire a temporary license inspector replacing the one that had been terminated. Since the position was temporary, she had the power to hire anyone without the commission’s consent because she is the department head over them.
After that vote, it was told by Commissioner Clemons that she was hiring Commissioner Smith’s grandson to fill the position as a temporary. Commissioner Smith confirmed the fact later that Commissioner Clemmons, Chairwoman Bias, and he were going to try him in the position.
Since the Chairwoman has the sole power as the department head over the position, the commission had no say so in who was hired until the position becomes full-time and at that time the whole commission has a vote on the position and it takes a majority vote of the commission to approve.
The background of Commissioner Smith’s grandson was never mentioned to the commission. This information was not known by me until a week ago when I received several calls wanting to know why we had a person checking licenses with charges and he was attending drug court.
This type of leadership decision is the reason that I have chosen to run for the chairman position of the Jackson County Commission instead of my district seat.

I will assure you, as the chairman of the commission, these problems will be addressed and the entire commission will vote on hiring both temporary and full-time employees. We need to institute background checks on all potential employees to assure the citizens of Jackson County that issues like these will not occur in the future.

The Jackson County Commission did vote to approve the temporary hire but Mr. Smith abstained from voting as he knew who was going to be hired. Mr. Allen was absent during the issue's vote due to sickness. Ms. Bias made the appointment.

Agenda items: 1) Museum Commission appoints 3 members for full 4 year term- a) Jim Roney, b) Debra Helms, c) Helen Kern; Robert Matthews was appointed to fulfill the term of Ms. Bennett, expires Oct. 2012. 2) 90% of City Budget approved, projected revenue-$20,163,063.00; projected expenditures-$20,159,048; this represents a $4015 surplus. 39% of city employees are topped out for pay purposes, a new step 13 pay rate was approved for those employees topped out.3) Resolution approved to vacate street next to Thompson property. 4) First reading of resolution to abolish Taxi Cab Franchise Ordinance. 5) Resolution approved to submit questions to Alabama Attorney General concerning the Scottsboro Parks and Recreation Board. Packet also forwarded to Jackson County District Attorney concerning allegations made by Mr. Arthur Davis. (questions to AG posted below) 6) Professional services agreement for airport runway approach approved, to be reimbursed from FAA funding. 7) Two persons spoke to the City council last night. a) Mr Arthur Davis: Mr Davis spoke concerning his complaint about the Scottsboro Parks and Recreation Board. He also requested of the City council, paraphrased, "can there be any action taken to keep the Plantation course open pending investigations and the Attorney Generals Opinion?" In short the answer was no. (My comment: The Recreation Board is a seperate corporate entity of the City of Scottsboro, Al. with all the corporate powers vested in a public corporate entity. Mr. Davis and others seem to have a problem in grasping the meaning of Alabama Code Section 11-60-8. GPC is not a non-profit entity, it is not some special bastardized entity of the state, it is what the law says, a seperate corporate entity of the municipality with all the privileges and responsibilities of a seperate corporate entity as described by the law. We shall see in short order if Davis' and the golfers of the "Point's" complaint holds water.

Mr. Davis is not the only player in the Point golf situation. City Council Member Keith Smith has publicly stated that he thinks the Parks and Recreation Board should be dissolved and a seperate city department created. Questions to the Alabama Attorney General per #5 above: 1) Can a member of an incorporated Public Park and Recreation Board be removed from the Board by action of the city council during that term of office? 2) If so for what reason? 3) Can a member of an incorporated Public Park and Recreation Board be removed from the board during that members term of office? 4) If so by whom? 5) If so for what reasons and on what grounds? 6) Do the provisions of Sec 11-43-160 (Removal of Municipal Officers) apply to members of an incorporated Public Parks and Recreation Board? 7)Do the provisions of Sec. 10-3A-42 (Part of Code pertaining to nonprofit entity which has been repealed.) apply to members of an incorporated Public Park and Recreation Board? 8) Do the provisions of Sec. 10A-3-2.22 (pertains to non profit entities) apply to members of an incorporated Public Parks and Recreation Board. 9) May a municipality compel a Public Park and Recreation Board to operate said boards facilities at or during certain hours, on certain dates, or at certain times. 10) Is an incorporated Public Park and Recreation Board a political subdivision of the City or is it an entity seperate from the city? 11) Can an incorporated Public Parks and Recreation Board sell or close a facility on which the City holds a mortgage without the city's permission?

The Scottsboro Parks and Recreation Board is formed as a seperate corporate entity under the laws of the State of Alabama. " Section 11-60-2 Legislative intent; construction of chapter generally." and "Section 11-60-8 Powers of corporations generally; location of projects of corporations." Concerned persons would do well to review the provisions of this portion of the law as it applies to the Park's Board. The Board is a seperate corporate entity of the State of Alabama with all the rights of any corporate entity of the state as authorized by law. Section 11-60-8 outlines their responsibilities and rights.

The question now should be asked are specific individuals on the city council and golfers attempting to interfere with the lawful operation of the Park Board for their personal motives of playing golf at a course which is and has been a nonviable operation from day one and has cost the taxpayers over two million dollars in expenses?

There has been much said about conflicts of interest. Here's one document which contradicts the allegations made relative to an 8% loan rate and allegations that Mr. Baggett initiated loans as a Vice-President of the 1st National Bank and Park Board President. Note the signatures and the loan rate, it is not 8% nor is Mr. Baggett's signature on the loan.

My final words concerning this case. Documents are evidence, words without substantiating evidence are nothing but words.

The intentional attack on the Scottsboro Parks and Recreation Board by golfers and one member on the City Council who plays golf at Plantation Point, reference the Daily Sentinel Dec 14, 2010 article titled "Smith says city should have control of Goose Pond Colony," is an attempt at governmental manipulation for personal gain. The gain in this case is the personal recreation afforded by the game of golf. It seems the few golfers preferring to play golf at Plantation Point rather than the Goosepond Colony course are saying, "we want our way or we will destroy the citizen's Park Board."

Our town of approximately 15,000 cannot support the public operation of two municipal golf courses in our current climate of economic downturns. There are several other courses in competition within 50 miles of Scottsboro. Including a Robert Trent Jones 36 hole course approximately 35 miles from Scottsboro.

It is my humble opinion this entire situation, including the Attorney Generals request and the request for an investigation is the result of a few golfers (which includes one City Council Member) vendetta for the Park Board's actions regarding the part time operation of Plantation Point.

At Monday's City Council meeting it was mentioned that an employee of the "Point" has a workable plan for the course's continued operation, so said Mr.Arthur Davis; Mr. Smith stated he had the plan in response to Mr. Davis. Why are these concerned citizens and the council member not bringing forth these plans to the public? Instead, they continue to make allegations pointed at the Park Board who is attempting to do the best job they can for the citizens of Scottsboro.

Plantation Point's operations have cost the citizens of Scottsboro over $2,500,000 (2.5 million dollars+, including sewer improvements as a result of a broken sewer system.) in expenses during the past 5 years while demonstrating no profit to sustain its operation. Plantation Point continues to realize massive losses as demonstrated by the Park Boards audited profit and loss statements reported publicly.

Plantation Point's continued losses have the potential to jeopordize the entire park complex which this board has worked tirelessly to pull out of a desperate financial hole. This fact is evidenced by the Park Board's previously mentioned audited financial statements, not allegations by disgruntled golfers and a councilman who wish to play golf at the expense of the citizens of Scottsboro at a course which is loosing hundreds of thousands of dollars.

The Scottsboro Parks and Recreation Board had no other choice but to curtail operations at Plantation Point or continue to loose money and jeopordize the entire park operation.

Thank you to the Scottsboro Parks and Recreation Board and their professional management team for the outstanding service to our community. This citizen appreciates your hard work.

BOARD MEETING AGENDA WITH NOTES Prior to the Board meeting board Chairperson Mike Baggett read statement. (see below)

14 citizens attended the meeting including press. 1) The financial report revealed a $5600 profit for FY 2011. The board gave credit to the complex division managers for an excellent job. 2) Cart purchase loan approved, 80 carts-70 for GPC, 10 at Plantation, (Plantation will have a total of 46 carts), 60 month loan term, total amount $293,000, low interest bid was awarded to First Southern Bank for 4% interest. 3) Boat ramp and marina dock repairs were authorized for up to $20,000.00 4) It was reported WiFi at the marina is up and running after repairs 5) Marina lighting repair project to be bid, end dock lights were repaired by staff. 6) Cabin and campground renovation to continue. 7) Bait & Tackle shop lease bid will be made within the next 60 days. 8) The Plantation Golf Course has 2 buildings, one will be closed and all supplies or equipment is to be consolidated. 9) Goose Pond walking trail to be requested for entry on National Trails list. 10) Facility annual audit has begun, expected to be completed by January 2012. The audit firm is being peer reviewed, the Park Boards audit will be the subject of the accounting firms peer review.

A retired citizen made a suggestion that the GPC board make an appeal to the community for volunteer support for projects such as local fishing tournaments and The Plantation Golf Course, he also suggested school partnership programs. It was suggested the board has a responsibility to foster enhancement of advertising to find new ways to support the facility.

STATEMENT OF THE SCOTTSBORO PARK BOARD CONCERNING Monday's, Oct 18,2011 City Council Meeting Work Session (Click on image then link left of image for an expanded view.)

Important points of the Park Board letter pictured above: 1) The Parks and Recreation Board was formed by law of the State of Alabama as a Corporation in 1981. 2) The board receives no compensation. 3) Goose Pond Colony/Plantation is a $3 million dollar annual business which receives no taxpayer subsidies. 4) Since 2005 the $6.5 million debt has been reduced to approximately $4.6 million debt. 5) The business decisions to cut back operations at Plantation Point has been made over the course of the year with many, many meetings and discussions with elected officials, home owners and citizens in the attempts to resolve the continuing losses at Plantation Point. 6) GPC golf has remained steady at a 66% utilization rate while Plantation course play rates have dropped 27% in the past 2 years and had a 38% utilization rate the last FY ending in September. 7) The Plantation course was purchased 12 years ago through financing that required payments of interest only as it was unable to generate revenue sufficient to pay regular principal and interest payments. since that day the Plantation course has never generated revenue sufficient to pay the interest. The GPC Golf Course, Marina, campground and Cabins make the required payments. 8) Starting in 2011 GPC was required to begin paying principle plus interest on the Plantation course purchased 12 years ago.. 9) To ensure the payments are made the GPC Board has made some very difficult decisions... 10) The decisions will allow the course to remain open and provide needed capital to perform maintenance on the entire complex that has been neglected because of the losses which had to be covered at the Plantation Course. 11) The course will be open part time, Friday Saturday and Sunday in the spring summer and fall; closed in the winter. 12) At the Monday night Scottsboro council Meeting Mr. Arthur Davis made some strong accusations toward the Goose Pond Colony Board, city council and its attorneys. 13) The GPC Board takes great exception to the accusations but welcomes any inquiries to the facilities. 14) We are audited annually and have an open door policy to anyone who wants to discuss or look at the operations of GPC/Plantation. 15) The efforts by Mr Davis to discredit the GPC Board coincide with the decision to limit operations at Plantation Point where he and his wife play golf. 16) The GPC Board cannot continue to neglect the entire complex to satisfy people such as Mr. Davis who does not like to play golf at GPC. (My comment: Mr. Davis is not the only person attempting to influence the board to make unwise decisions, Council member Smith is likewise involved. It appears this is a political move by Mr. Smith to manipulate a seperate corporate entity of the city for personal and political purposes for the benefit of the few while neglecting the overall needs of the facility and the community.) 17) The GPC Board respects the actions of the City Council and the city's managers and maintain a continuous dialog with the Mayor and the City financial Manager about the parks operations. 18) We consult with the Mayor and City Financial Manager... [we] would never be influenced by political motivations. (My comment: I have followed the GPC boards actions for many years, it is due to the due diligence of this current GPC Board and the current professional complex Management that our park complex is not bankrupt! Several years back I did not agree with the actions to place the city's Financial Director at the helm of the GPC complex and filed an Attorney Generals Complaint. If not for the actions of the past City Council, the Attorneys involved, the excellent management by the City's Financial Director and the current GPC board the citizens of Scottsboro would have suffered a tremendous loss. This citizen says thank you for the exceptional action at an exceptional time which saved the GPC facility from sure bankruptcy due to misappropriation and mismanagement which was occuring many years previous. Goose Pond colony is a wonderful asset for the city of Scottsboro. I suggest all City Council members do what is right for the citizens as a whole, not a select few.) 19) We look forward to and encourage any inquiry into the operations at Goose Pond Colony and Plantation Point. 20) GPC Park Board meetings are held on the 3rd Tuesday of each month, the park board encourages participation.

Comments of Mr. Arthur "Buzzy"Davis. (I had spoken with Mr. Davis about our disagreement concerning this issue. I informed him I would include his comments if he would send them to me.)

Oct 22, 2011-Mr. Morgan: I'm surprised that by inference or tacitly you approve of deceptive advertising resulting from joint funds of a Public Board,a City and a County Chamber of Commerce. Advertising TWO PUBLICLY OWNED GOLF COURSES OPEN YEAR ROUND was a clear inducement to move here. Some moved lock,stock and barrel,bought homes and spend the vast majority of their income in Scottsboro. There are 42 homes that surround Plantation Pointe G.C. Closure of that course for 4 days per week and entirely for the Winter has a real,significant effect on values. One realtor estimated that eliminating the G.C. would reduce values by as much as 40%. The closures warrant partial abatements in real estate taxes.

Some 20 members have resigned their memberships due to the uncompensated reduction in services. The City and G.P.C. have a symbiotic relationship. What one entity does that appears beneficial to the one does not necessarily benefit the other.

You may choose to applaud that Board for their historical efforts and volunteerism and to the extent that their efforts have benefited the citizens of Scottsboro,their statutory beneficiaries,I would join you. But on this issue you seem to be viewing the Colony as a totally separate entity which doesn't consider the larger picture. It may be human nature to award points for past performance,but is it necessarily logical in evaluating current decisions and their impact.

BTW in 2008 if a couple moves to Scottsboro and buys a home from a family that moves to Grant, whose principal wage earner is employed in Huntsville is that a benefit to the City of Scottsboro? Have you weighed the value of the amount of money that a family has spent in Scottsboro since 2008 before making a judgment?

You mentioned "selfish golfers" seeking "moral justification". What is your "moral justification" for supporting the recent actions of the Goose Pond Board without determining the "moral justification" of their actions in reducing services to customers in the middle of a contract year without offering compensation or a prorata adjustment?

You have their quoted formal rebuttal. It says :"We regret any inconvenience that this may cause but offer the Goose Pond Colony Course seven days a week and will keep it open during the winter to compensate for the days the Plantation Course is closed."

Think about that comment. Goose Pond Colony Course has been open weather permitting all winter seven days a week. Consequently it is not "compensation." It is spin. In effect you seem to be justifying the position you are taking by accepting as given all of the foregoing comments without truly evaluating meaning. This may seem trivial to you,but what you are missing is the impersonal,arrogant style of communication that this Board uses in dealing with services. It really has little to do with golf,but speaks volumes about the management style and dearth of customer relations.

If you had an annual contract payable monthly to rent two parking spaces on opposite sides of the City and 6 months into the year were told you couldn't park in one of the spaces 4 days a week and there would be no adjustment in price,but you'd be compensated by being able to park in the other space 7 days per week,would you believe that you were being compensated? Would you continue to do business with that entity?

What you and that Board seem to be unwilling to accept is that they have made a material change in an agreement that they have stuffed down their customers throats. It just so happens that they are a public non-profit corporation created for the purpose of serving those customers.

I wouldn't return to any retail store that treated me that way and I wouldn't have treated my customers that way when I was in business.

I would be equally opposed to any action this board took that reduced services in the same manner for their other customers:including,but not limited to: campers;boat slip users;lodge and cabin guests;swimmers and others.

When I moved here and joined the two golf courses as a gesture of public support I paid my full membership in advance two years running knowing there was no discount. I could have paid monthly. I am inactive and retired,but joined the Chamber of Commerce and pay dues each year. I use all services of the City,though other competitors may charge less. Why? It's my way of showing public support.

When we receive our bill from the City on a weekday we routinely pay it that day or the next. Shortly after I moved here I made it known verbally to the Mayor what my background was and that I would be available to serve as a volunteer. I have publicly offered to volunteer in this connection 3 times:June;August;and September.

All I expect is objectivity from those who take public positions on issues. Characterizing former members of the "two public golf courses" as selfish may require a mirror image self review of all entities taking sides on this. Reasonable minds may differ,but mutual communication and continuing dialogue and not unilateral edicts that are not open to constant review should not be and cannot be tolerated from public offcials who serve citizens.

Mr. Davis until you demonstrate evidence of your claims it is just more rhetoric without a foundation.

I have stated many times in public and within media forums, "show me the evidence" and I will stand with you. Until this occurs it is my opinion that the golfers who prefer to play golf at Plantation Point are attempting to have their way regardless of the facts and ignore the larger problems. There is more to the GPC park facility other than Plantation Point.

Scottsboro City Council Work Session

Tonight was a City Council Work Session. 1) Taxi Cab discussion. The current Scottsboro Ordinance dates back to 1945 according to Mr. Kennamer, City Attorney. The history of the old ordnance relates to the bootlegging of liquor by the local taxi service. It was suggested the council repeal the current city ordinance and rely on the state law regarding insurance, license and background investigations. The Business License Ordinance will need to be updated regarding taxi cabs.

2) Discussion concerning vacating city property next to Randy Thompson, a gravel road involving 9/1000 of an acre on the corner of Hancock Rd. and Bob Jones Rd. A public hearing on this issue will occur next Monday.

3) City Right of Way discussion by Vickie Everett involving the Willow Chase Homeowners the Everett's and the City of Scottsboro. Essentially the city owned the property and there was a problem with visual clearance. Property exists on Wynn Rd and Willow Chase.

4) More on the continuing saga of Golf, Plantation Point and Goose Pond Colony. To highlight, Mr. Arthur Davis accused the President of the Scottsboro Parks and Recreation Board, Mike Bagget, of alleged "Criminal Conflict of Interest" as the Vice President of the First National Bank and Board President of the Parks & Recreation Board regarding loans issued to the park from the bank.

Retired Judge and golfer Arthur Davis addresses Scottsboro City Council on what he says are mismanagement problems and alleged ethics and criminal conflicts with the Scottsboro Parks and Recreation Board.

Mr. Davis and City Council Member Keith Smith have expressed concerns because the Park Board is closing Plantation Point during the winter months and cutting hours. The Board says they can not afford to keep the Plantation Course Open. Davis and Smith claim mismanagement, lack of advertising and allege criminal conflicts.

Mr. Davis stated losses of money in areas such as the Snack Bar of $139,500 as evidence of mismanagement since 2008. The Park Board has stated they will lease the snack bar.

The Docks Restaurant
Mr. Davis mentioned another revenue loosing operation was the Docks Restaurant. He suggested the restaurant should be leased for $2000 per month, it is currently leased for $600 per month. Davis went on to say this has resulted in a loss of revenue of $154,000 over the years.

Mr. Davis also stated the current manager of the Goose Pond Colony facility is not qualified.

The bottom line, Mr. Davis called for the removal of park board members and requested the States Attorney General provide advice on removal of the Park Board. Council Member Smith also said he would request formally an Attorney General's opinion at the next meeting.

The former Judge continued on chastising the current City Attorney and the Park Board Attorney for allowing the City Finance Officer to be placed as Chairman of the Park Board 8 years ago.

8 years ago Goose Pond Colony was in serious trouble. There was missing equipment, giving away of services and goods. The complex was near Bankruptcy, according to reports, vendors refused to extend credit to the complex.

The City Council at that time developed a plan to place the City Finance Director as chairperson of the board in the attempts to "save" the complex from bankruptcy. The plan violated law, but accomplished the job. I filed an Attorney Generals complaint concerning the misapplication of power regarding the incident. The City Finance Director performed a fantastic job of preventing the GPC complex from a sure failure. The problem at that time was secrecy, there was no explanation of why it was necessary to place the Finance Director over the park board. All of that is "water under the bridge." The current Park Board has worked tirelessly to manage the facility back into a state of finacial health from a bankruptcy situation.

I spoke to the City Council last night asking the Council to work through this problem for the benefit of the citizens. I suggested to them the council and park board form a seperate corporation to manage Plantation Point as allowed by law.

When the Council President asked if their were any questions, Council Member Keith Smith made a pointed comment to me, "I read what you write all the time (refering to me), you want to send politicians to jail, you complain about all politicians, why are you changing now?" Mr. Smith is wrong and has a problem, in my humble opinion. Unfortunately, Mr. Smith seems to forget the facts in this situation, as he was embroiled in a golf controversy while he was the police chief.

I reminded Mr. Smith he was Police Chief during the time of missing equipment and misappropriation of goods and services over 9 years ago, complaints were filed. However, the Scottsboro Police Department or the Attorney Generals Office would not investigate the problems which were occuring at Goose Pond Colony.

It was obvious Smith did not like my suggestion the Park Board and Council resolve their problems.

Time on the Golf Course-flashback: Former Mayor Dan Deason attempted to discipline the then Police Chief Smith. According to the former Mayor, "the police chief (refering to Police Chief Smith) spent many, many hours at the golf course when he should have been working." Mayor Deason was not successful in any meaningful personnel action to correct Mr. Smith's "working golf game."

There is more to Goose Pond Colony than Golf. Councilman Smith and others attempt to manipulate the system when it fits their personal need, this time it is golf. For Councilman Smith manipulation has been seen previously; examples: as police chief - playing golf on public time and insubordination; as a politician - the Civic Center at Goose Pond Colony, City Audits, the North Goose Pond Island development versus industrial jobs and now golf at Plantation Point are areas where Mr. Smith has been embroiled in mud slinging for political and personal purposes.

The Scottsboro City Council and the Scottsboro Parks and Recreation Board would do well to resolve this problem in a positive fashion without a continuous creation of problems. I'm pretty sure there are cans of the "proverbial worms" relating to unethical conduct that have not been opened.

NRC Inspection - Red Findings - TVA Browns Ferry Nuclear Facility

Nuclear Regulatory Commission, NRC, inspectors on Monday, October 3, 2011 told TVA and the public that the Browns Ferry Nuclear Plant is safe to continue operating. However, there are testing and documentation program failure problems which must be corrected. TVA Browns Ferry Nuclear Plant near Athens, Al.

"The Nuclear Regulatory Commission in early May gave the Tennessee Valley Authority a "red" or "high safety significance" rating in connection with last fall's failure of a cooling-water injection valve at Browns Ferry on the Tennessee River near Athens, Ala." The NRC officials stated the issue of the faulty heat removal system check valve is still an open issue that will continue to be evaluated by the NRC.

Several other issues were stated to be a problem which were discovered during the inspection process: 1)The failed valve issue remains an open issue, it was reported there was one instance that an inaccurate report concerning the questionable valve was entered. 2) Apparently there is a question concerning the wording of the code regulating valve inspections and the issue of an open and closed valve status. 3) A continuous historical finding of no documentation in relationship of corrective actions programs. 4) Over torquing of valve, employee listed vendor document information on inspection reports that valve was operable when it was not. 5) Inaccurate information listed on inspection reports by Browns Ferry Operators concerning valves. 6) Corrective actions relied on singular procedural functions. There was no program to ascertain the cause of failures for the purpose of correction of a given problem. 7) There was no Design Basis Document concerning component proper or improper function. The NRC Inspectors stated there was no requirement for such a document. (My comment: This is a very peculiar finding, but it helps to explain the next finding. This finding is significant and disturbing as it is an indication of a general lack of concern and mismanagement concerning critical scientific and engineering controls.) 8) There is a general lack of "rigor" (rigor-Strictness or severity, as in temperament, action, or judgment; the quality of being valid.) in corrective actions; multiple instances of a lack of engineering standards as to problem resolution and solution discovery to problems. 9) Browns Ferry management was reactive to equipment issues but had no motivation to discover the cause of problems experienced.

""What if the tornado that struck [near the plant] on April 27 had torn off that [sheeting] roof and sucked the contaminated water out and scattered it over the community?" Johnston asked. "I want some reassurance.""

"One NRC inspector told the audience that those containments were upgraded for assaults such as that on the heels of the Sept. 11, 2001, terrorist attacks."

"But David Lochbaum, a former TVA nuclear engineer and a former NRC training instructor, took that answer to task. "That's not accurate," said Lochbaum, a Chattanoogan who now works for the Union of Concerned Scientists. "It may be reassuring, but it's not accurate. The 9/11 changes were only about airplanes, not multiple problems such as what the tornadoes caused or could have caused if one had made a direct hit on the plant," he said."

"The tornadoes did knock out much of [north and central] Alabama's and Mississippi's electric grid, stranding Browns Ferry plant for seven days on diesel power as the plant went into emergency shutdown. "

TVA's Chief Nuclear Officer Preston Swafford was present and stated, paraphrased, "An Integrated Improvement Plan will be accelerated and the TVA Executive Management concurs with all NRC findings."

Jackson County Commission Meeting - County Employees Get Pay Raise

Today's Agenda

The big news, all county employees will receive a 3% pay raise. The Probate Office Employees will receive a 5% pay raise. Last month the Commission's administrative staff received a 5% pay raise for the additional workload of the County Park.

Will the commission's administrative staff receive an additional 3% pay raise? Will County Employees, specifically male personnel in the county maintainace department file an unfair personnel practices grievance due to unfair payroll treatment and sexual discrimination for the unbalanced pay increases favoring female office personnel in the county commission and probate offices?

The County Commissions Budget was submitted and approved. After the meeting I inquired of the County Administrator, Sandra Erickson, as to the amount of the approved budget, she stated the Department Expense Budget is $16 million with expected revenue receipts of $15.5 million. She further stated the $500K shortfall would come from the General Fund Budget.

City Council Members Ms. McCrary, Mr. Speers and City Finance Director Rick Wheeler attended the Alabama Fire College for an orientation session and experienced Fire Fighter Training classes. City Officials attending are presented with Fireman's Helmets, goggles with their name plate. Mr. Speers was absent due to a school business commitment.

All bids will be effective Oct. 1, 2011, approved contractors. a) Rec-Com cleaning was awarded to BC&C Cleaning of Dutton Al. for $70.00 per day; b) Rec-Com pool chemicals contract was awarded to Anders Pool Co.; c) City's fuel bid was awarded to McPherson Oil of Trussville, Al. for .075cents over actual cost of fuel; d) City Oil and lube products bid awarded to Jackson Oil Co,: e) City streets paving bid awarded to Jackson Paving of Guntersville, Al.; f) Street Striping bid awarded to J.C. Cheek Co of Lacey Springs, Al..

Other Agenda items: 8) Amendment to wrecker rotation policy approved. The change involves 2 major issues, a) all wrecker services must have insurance listing the Scottsboro Police Department as one of the insured and b) investigation proceedures for unreasonable fees complaint. 9) Knights of Columbus Road Block, County Park Road & Hwy 72, approved for Sat. Oct. 1, 2011 7AM till 4PM for fund raising for the A.R.C. http://www.thearcofalabama.com/chapters/jackson.html 10) Road closing in front of Brownwood School approved for Nov. 4, 2011 from 8AM till 2PM for American Heritage Day. 11) Public Hearing for Liquor License for the Veranda Cafe. There was 1 person which spoke in opposition to all alcoholic beverage licenses favoring a prohibition to all alcoholic beverages. 1 person spoke in favor of the license stating it was a renewal of license. The license was approved. 12) 1 vacancy on the Planning Commission, it is a Mayors appointment. The Mayor will hold off on the appointment until after the new Planning Ordinances are complete. 13) 1 vacancy is open on the Museum Commission finishing the term of Mrs Liz Bennett, term expires in October 2012. Interested parties should turn in requests to the City Clerk no later than 4:30PM Oct 7, 2011 14) ALDOT agreement for paving project approved, cost share with city, $675K in paving costs. Broad St will be paved in the spring of 2012.

Goose Pond Colony Board Meeting

The 3rd Tuesday at 4:30PM is the Scottsboro Parks and Recreation Board meeting, this one was no different except for the speeches of right wing golfers who proclaimed we will be drilling for more oil, there will be big changes come November 2012 and suggestions that board members resign. And of course, Bellefonte and the TVA will make everything all right.Yes, right wing extremism has afflicted the Plantation Point Golf Course. For a moment I thought I heard Sara Palin stand up and shout, "drill baby drill, free clubs for all and beer in every cart!"

The right wing golfers did not stick around till the end, they missed the revelations about the budget and plans. The right wingers were more concerned about supper than Goose Pond Colony. They all marched out in a symbolic jester filing past the "Godfather" of Plantation Pointe, gathering their approval as they left.

However, I do agree that advertising is atrocious, a media advertising program is sorely needed. Not only for Goose Pond Colony and Plantation Pointe but Scottsboro events such as First Monday Trade Days and the availability of industrial property in the area.

The GPC 2012 budget was approved, $3,003,474 is the projected income with projected expenditures of $2,881,694.

The boat owners representative mentioned several serious and high risk safety related problems which he stated must be fixed. 1) Dock 3 has defective transition plate which is a walking hazard. It was stated this equipment must be fixed as it could cause an injury as a result of a trip-fall resulting in injury and a liability event. 2) Dock 3, lights are burned out at the docks end. 3) Docks were reported as lifted from their supports during the 2009 spring storm. It was reported that poles are bent and some supports may be off of the retaining collars. It was stated that a high wind could cause the docks to move or "wheel" around causing severe damage not only to the docks but also to private property. It was also reported the hazards have been in existence for some period if time according to the boat owners representative. Employees are aware of the problems but have not resolved the issues.

J.P Parsons made a presentation concerning the 150 year Civil War Commemoration in Northeast Alabama, Southeast Tennessee and Northwest Georgia. There is a fee of $1000 required for participation in the events and advertising. It was suggested that the county and 3 cities each contribute $250. There was considerable discussion concerning the Wrecker Rotation. Our new License Inspector was present, the Grandson of Commissioner Jack Smith. Some county officials have alleged that support for issues were gained by the hiring of this commissioners relative. One other commissioner has his grandson working for the county at the Road Department, that would be Commissioner Gaylen Stone.

TVA SECRECY, Federal Sunshine Law

We are the TVA, shh, we have secrets and treat our ratepayers like mushrooms. Meanwhile, the local political gentry care specifically about TVA in lieu of tax money, not about the health, welfare and law governing the actions of government.

The TVA has a continuing problem with open deliberations as required by the Federal Sunshine Act. Commission Chairperson Sadie Bias along with Chamber of Commerce Director Rick Roden attended a tour, luncheon and discussion of Bellefonte prior to a TVA Board decission with a quorum of TVA Board members and staff concerning the Bellefonte Plant. The "Tennessean" article quotes Spokeswoman Barbara Martocci, "[she] said informal board gatherings are briefings that meet the letter of the law..." "Board Chairman Dennis Bottorff of Nashville said great effort is made to be open.“That was a tour,” he said. “There weren't any kind of decisions being made."

If a briefing is conducted that is a discussion of information which may come before the board at a later date. The meeting was not just a luncheon as TVA officials would have you to believe, it was a "briefing" and discussion about the nuclear plant as TVA officials admit. The Federal Sunshine Law contains more than just provisions for decission making, the law covers deliberations of a quorum of Board Members.

Issues of Open Meetings and secret decission making has been an issue for the Jackson County Commission on previous occasions. The TVA has been chastised for its brand of secrecy as a government entity. It frequently attempts to use excuses such as commercial exceptions to avoid Freedom of Information Act disclosures. The TVA Committee process is a ruse to disguise secret meetings where approvals are made behind closed doors prior to the TVA Board meetings.

Tea Party Event at Jackson County Park

Ms. Ellen O'Connor, Jackson County Republican Party Women's Club Chairperson.

The Tea Party held a political rally at the Jackson County Park Sunday. The rally kicked off with Blue Grass music played by Wills Town Junction. There were 85 people who attended the rally.

Ms. O'Connor gave a report concerning last years Tea Party Rally which raised $550. She introduced Tony Goolesby, Sylvania, Al. City Council member.

Mr. Goolesby said we are here today for remembrance of the First Responders who sacrificed so much on that memorable day in New York ten years ago. He stated, "God is the only one who can take a bad situation and make it better."

Goolesby spoke on two different occasions. He quoted several Bible Scriptures, Psalms 119-93, " I will never forget your precepts, for by them you have preserved my life." He spoke for several minutes concerning his thoughts on this verse. Mr. Goolesby in his second presentation spoke about Isaiah 5, 20-21 " (20)Woe to those who call evil good and good evil, who put darkness for light and light for darkness, who put bitter for sweet and sweet for bitter. (21) Woe to those who are wise in their own eyes and clever in their own sight." Goolesby said, "The government will never tell you the truth...I think this is what is wrong with America." His next scripture quote came from Ecclesiastes 3. 1-8, "There is a time for everything, and a season for every activity under the heavens..."

The next Speaker was Alabama Senator Shadrack McGill. Senator McGill delivered a prayer and quoted scriptures, 2nd Peter: "³ His divine power has given us everything we need for a godly life through our knowledge of him who called us by his own glory and goodness. ⁴ Through these he has given us his very great and precious promises, so that through them you may participate in the divine nature, having escaped the corruption in the world caused by evil desires."

Senator McGill ask the question, "why are we befriending those who will destroy us?

Ms. Kayla Carter sung the Star Spangled Banner and Amazing Grace. Mr. Goolesby delivered the Pledge of Allegiance.

Next up was the video, "We the People," a video letter to President Obama stating we reject your vision for our country.

Mr. J.E. Edwards was the next speaker. Mr. Edwards is retired, a World War 2 Veteran and has been a Red Cross Volunteer for 35 years. Mr. Edwards stated he spent 19 months in Europe during his tour of service during WW2. Mr. Edwards gave a special thanks to his wife for the period of time he was not at home during his Red Cross volunteer work.

Mr Edwards is a retired teacher, he told of his days as a teacher and how he felt about the poor children in which many had not eaten when they arrived at school. I think Mr. Edwards held back a tear when his thoughts drifted to the children of Sand Mountain. God Bless our World War 2 Vets and the men and women who taught in Alabama Schools many years ago.

The next speaker was Mr. K.Carl Smith, a U.S. Army Veteran. He wore a t-shirt which proudly proclaimed, "I'm an FDR Republican, a Fredrick Douglas Republican.

"I do not want a slave master Republic." Mr. Smith spoke of the distinct differences between President Obama and Mr. Douglas, "Obama rejects our Constitution, Frederick Douglas supported our Constitution."

"We are fighting a battle of propaganda." Mr. Smith talked about the 4 values of Frederick Douglas, 1) Respect for the Constitution, 2) Respect for Life, 3) Limited Government, 4) Personal Responsibility.

"Who are the Frederick Douglas Republicans," he asked? "We are people who are not afraid to stand up for our beliefs and convictions. We are every day citizens who will fight for liberty and justice and are not satisfied with the status quo. This movement is not about the color of our skin, this is about values."

In his book Mr. Smith goes on to say, "Frederick Douglas Republicans are not bound by race, color, creed or religion. We come together as a united front..."

He spoke about Jesse Jackson and liberals being about insults, accusations and instigation's.

Mr. Smith had this to say about diversity, "Jehovah God initiated the first diversity program as he ordered his disciples to carry the word of God to the world."

Mr. K. Carl Smith was an excellent motivational speaker. I spoke with him afterwords asking if he had any political ambitions. He stated to me, "I do not at the moment, but if I do it will be at the Congressional level. His book is titled, "Frederick Douglas Republicans, A Movement to Reignite America's Passion for Liberty." Good luck to you Mr. Smith, we need people such as yourself in Washington to change the course of negative endeavors. Consider a run against Mr. Brooks.

The last speaker was Mr. Paul Reynolds, National Committeeman, Alabama Republican State Committee.

Mr. Reynolds stated, "I need feet on the ground, we need to raise $300 million dollars."

The most impressive portion of the rally was Mr. K. Carl Smith, a graduate of Alabama A&M University. He has the "right stuff," and he is a person which could motivate the people of U.S. Congressional District #5 to vote for him. I thought he was a down to earth motivational speaker and well grounded in his values. He has an innovative approach and is well versed in the "Art of Engagement." As Mr.Smith pointed out the Democrats of the 19th and 20th century practiced slavery, racial discrimination and exclusionary policy, so did the Republicans. No doubt times have changed, members of the "White Rooster" conservatives, Alabama Democrats of old, remaining have migrated to the Republican Party and make up a base of the right wing extreme. There are Democrats which do not subscribe to extremist exclusionary political action just as there are Republicans which do not subscribe to exclusionary political action. There are conservative Democrats which display values akin to conservative Republicans but are separated by political party lines.

The terms conservative and liberal are frequently confused and utilized as a divisional tactic of both political parties. We desperately need unity and solutions for our many problems, the most pressing being our national debt. Will the Tea Party subscribe to American Unity or support exclusively Republican Party political strategy? That is the question in which members of the Tea Party must answer. An American independent political party is needed, the Tea Party could be the beginnings of that independence if it decided to go down the road of Independence in the Spirit of America and remove itself from current political divisionary tactics.

Jackson County Commission Meeting

Monday, August 22, 2011 there were 2 seperate meetings held, a Work Session in the Commission's Board room and a Regular Meeting conducted in Court Room #1.

During the work session several budget issues were discussed. Sheriff Chuck Phillips appeared before the Commission to make requests for departmental needs which included the jail, vehicles, computers, maintenance and staff needs. The work session agenda is posted below.

On May 5, 2011 I submitted a request to the County Commission to view the financial records of the commission, this request was placed in writing and submitted to the commission. On June 13, 2011 the commission released a partial disclosure as a result of my request which was posted within this blog. http://arklite.blogspot.com/2011/06/jackson-county-commission-meeting.html This disclosure revealed the commissions balance and budget shortfalls due to the ongoing TVA in lieu of tax issue with the Jackson County Legislative Delegation which has since been resolved.

The county commissions financial records are now posted on the commissions bulletin board after 3 months of procrastination by the commission's administrative office. It became apparent that the administrative office within the commission was not going to take any action on this issue. I discussed this issue with Mr. Stone and Mr. Allen, I was asked to give them time to resolve the matter which has now been resolved.

The big news item was the sale of the county surplus property across the road from the old Marvin's Lumber store and adjacent to the county annex building. This property sale was approved via sealed bid for $64065.00.

Mr. John Porter, County Attorney, announced the case between the County Commission and the Legislative Delegation was settled with the judge signing the agreement concerning the TVA in lieu of tax issue.

County employee issue in the making?

Some county employees have expressed a concern over the recent 5% pay increase given to the commission's administrative staff to cover the additional work involved with the county park's administrative duties. The 5% pay increase was approved at the August 8, 2011 commission meeting. The 5% increase for the administrative staff is funded from county park income.

I contacted Ms. Sadie Bias, Chairperson of the Jackson County Commission, concerning this issue, she stated no county employee has discussed their concern related to this issue directly with her.

A quote by John Adams: "The true and only real definition of a republic is a government in which all men, rich and poor, magistrates and subjects, officers and people, masters and servants, the first citizen and the last are equally subject to the laws." The government itself, represented by the TVA in this case, is bound by law. Deceitful socialist bureaucracy and propaganda are being utilized to subvert nuclear safety laws, policies and procedures by the TVA .

Yesterday's TVA board meeting should have been an eye opener for those who were in favor of Bellefonte restarting. Unfortunately, it was not, due to a willingness to accept lies from the TVA for financial motivations. What was exposed was the extent the TVA is willing to perpetuate deceit to build a nuclear power plant. TVA Executives and those who support nuclear power deceit are now members of the newly formed "Mendacity Club." Below are a few highlights of the clubs positions.

Dr. Marilyn Brown, chairperson of the Nuclear Oversight Committee, was elated over her proclamation that nuclear power is "secure, clean and affordable." ( "Secure," but not safe nuclear power.) That statement of fallacy was repeated many times yesterday at the TVA Board meeting. Another proclamation of Dr. Brown concerned the so called unbiased and independent nuclear oversight committee experts, far from it, as both support the nuclear industry. It seems the college professor has become a developer of TVA propaganda.

Chief Operating Officer Bill McCollum supported and presented the "Mendacity Club's" position. One of his points was that a combined cycle natural gas plant cost nearly the same as finishing the Bellefonte Nuclear Reactor. This was a gross distortion of the facts. Cost to complete Bellefonte, $4.9 Billion, cost of a 800 mega watt combined cycle natural gas plant at Bellefonte with the pipe line, under $2 billion dollars. I'm no supporter of coal, but Bill McCollum's statement that nuclear was less expensive than coal demonstrates the extent of deceit the TVA will make to support their position concerning nuclear power.

McCollum also stated quality assurance systems were maintained during TVA's period of the nuclear plants' cancelled construction permit and subsequent stripping of the plant. McCollum's statements directly conflict with the NRC position on this issue.

The "Mendacity Club's" solution to their financial debacle, increase their debt and form schemes of irresponsibility, sell, lease and/or lease back the defective Bellefonte Nuclear Reactor.

There is a serious downside to TVA's history concerning nuclear power. The TVA and their supporters will utilize any means to support their position concerning nuclear power, including death threats, lies, massive debt, threats of arrest and the utilization of propaganda . Now, the ignoring of obvious safety problems and illegal actions contained within the current Bellefonte construction permit process.

There is a political expose in this process. Many government officials in their unwavering support of TVA's mismanagement and nuclear power have exposed themselves as supporters of deceit, propaganda and socialism as a political and economic government form. The various government officials in supporting TVA's irresponsibility demonstrate irresponsibility themselves in their grab for TVA in lieu of tax money and the false proposition that TVA is the benevolent parent providing jobs when in fact TVA is an abusive government corporate bureaucracy destroying American Regulated Capitalism via irresponsible leadership and mismanagement in a system of socialistic fascism.

The government officials involved do not support good ole American regulated capitalism, they support fascist socialism where the means of production and distribution are owned by the government and built by the multinational corporation at either taxpayer or TVA ratepayer expense. The "socialist corporatocracy" grows, say thank you to our ignorant, socialist supporting government leadership, the trade unions, nuclear lobbyists and the TVA. They have formed a Corporate Socialist Amerika in support of nuclear power and the beginings of the fascist state.

The Bottom Line of TVA and Bellefonte, the song and dance is not over.

Various government officials may have demonstrated they do not support the American ideals of regulated capitalism. However, this fight is not over, the U.S. Court of Appeals, Washington D.C District, will now decide the case of the defective construction permit since the TVA ignored the obvious defects in support of their deceitful financial position and gross mismanagement.

The supporters of nuclear power attempt to suckle at TVA's teats of government deceit and financial irresponsibility at ratepayer expense. The Tennessee River Valley Caucus conservative political representatives have shown their hand, they are only conservative in support to conserve the neu Corporate Socialist Amerika pouring millions of dollars into their political reelection campaigns, not to mention the millions of dollars spent for corporate lobbying.
