TVA-In Lieu-of-Tax for Jackson County Alabama and the Discretionary Fund Committee

Discretionary Fund Committee meets, maybe for the last time. TVA-in-lieu-of-tax issue not resolved, indecision harms local groups and agencies who depend on the funds to operate.

The Jackson County Legislative Delegation Discretionary Fund Committee met last week for what could be the last time. Committee members Senator Steve Livingston, Representative Ritchie Whorton, Representative Tommy Hanes, Commission Chairman Matthew Hodges, Commissioner Jason Venable and Revenue Commissioner Jeff Arnold were all present for the meeting. Livingston began the meeting by announcing that the discretionary fund account balance was over $1 million and the Legislative Delegation office account was around $69,000. Former Jackson County Commissioner Horace Clemmons filed law suit against the delegation and members regarding the distribution of the funds.

"Clemmons responded to the new proposed bill and stated “While each bill the Delegation has proposed is better than the last, I still have problems with the latest one. My major concern is not with the bill itself, but the process that got us to the current bill. I have talked to several county and city elected officials and have yet to find one that was consulted. I believe the Delegation has a responsibility to determine what the other elected officials and the public want before passing a law that allocates our tax dollars. I also have an issue with the allocation of office expense and the County Commission Economic Development Fund. On the 2% office expense, I do not believe that it is legal for the Delegation to own a building that was paid for using tax money. I believe that we would all be better served if the County Commission provided office space and personnel for the Delegation. On the County Commission Economic Development Fund, I would only support that if it is clearly limited to support of local businesses. Large chains get plenty of (unneeded) support from State and Federal level. Local businesses are left out in the cold. Jackson County Park Board


A Special Call Meeting was held Thursday, March 3, 2011 at 5:00PM to discuss pending litigation in the matter of Jackson County Park Board vs Jackson County Commission. On the Park Board, as evidenced by the above photo, sets Jackson County Commissioner Horrace Clemmons who by virtue of 2 votes  ( http://arklite.blogspot.com/2010/07/county-commission-county-park-saga.html ) , his and one other, elected himself to the Park Board. Commissioner/Park Board Member Clemmons has been instrumental in attempting to abolish the Jackson County Park Board for the purpose of gaining control of the funds to be used for other purposes, including other parks.

Today the Park Board voted to obtain an Attorney Generals Opinion concerning the issues related to the Jackson County Park. I wonder if there will be any mention to the Attorney General of the conflict concerning Mr. Clemmons in this situation.

Horrace Clemmons Announces Bid for Senate District 8 Seat

Little Napoleon, Clemmons has acted in Napoleonic style toward bullying commissioners and citizens who do not agree with his secrecy and efforts at division. I purchased the rights of this image to demonstrate Horrace Clemmons Napoleonic style of management on the County Commission. He seems to think that the county commission is his entity to carry forth his secretive agenda. He has plans which he will not disclose. It is my opinion he is a dangerous government official which has supported secret meetings, closed door sessions and decision making out of the the open meeting while conducting legal mediation. Mr. Clemmons' conducts government business as if he was the owner of a business, in secret and beyond the scope of the public eye.
I had heard rumors about this alleged move on Wednesday. Many were stating there was a Facebook posting which had announced Clemmons' run for the Senate seat. From his Facebook page: Oct. 19, 2010 11:09 "Horace Clemmons If you, like me, are having a difficult time with the options that we have on the ballot for State Senate District 8 then please write-in “Horace Clemmons” on your ballot."


Today, Oct. 20, 2010, Horrace Clemmons says: "Horace Clemmons All of you that know me, know I am a Democrat, a belief fromed from my life experiences. That is why I find Senator Barron's statement in The Daily Sentinel off the mark, "It was my understanding [Clemmons] was strongly supporting Shadrack McGill." Were I to have voted for either candidate, it would have been the Democrat."


Well Mr. Clemmons you may say you are a Democrat and that is certainly your choice but I must say you are about the most Republican acting Democrat I've seen. A "wolf in sheeps clothing" has been seen in these parts, as a Republican your chances are slim to nil in being elected to Senate District 8.

The bottom line, there has been more turmoil during this county commission's tenure than any other in recent memory. Mr. Clemmons has contributed greatly to the turmoil, secrecy, division and surepiticious rule making. He has attempted to bully citizens and colleagues alike while on this commission. It is my opinion the election Horrace Clemmons representing Senate District 8 would be an error in judgement for the citizens of Jackson County.
