The Wheeler Affair, the Cover-up of Sexual Discrimination, Patterns of Organizational Misconduct, Reports and Disciplinary Actions 

Think about this fellow citizens - Early in 2019 an attorney who specializes in Sexual Discrimination, Sexual Harassment, Creation of a Hostile Work Environment, Ms. Hope Hicks, Esq., was paid $11,800 to investigate and make Recommendations to the City of Scottsboro. She made her report, it exists within the files of the City of Scottsboro, inquiries reveal it was a scathing report, there were disciplinary actions taken; attempts then and now are made to keep this report and the resulting actions hidden. How many of you fellow citizens have heard about her report and recommendations of disciplinary actions?? 

Unfortunately, some public officials, elected and appointed, forget who they work for, it is "We the People." Will someone, other than me, please inform Scottsboro Mayor Jim McCamy, that disciplinary records of employees are releasable per official records request, made twice now. Further, Mayor McCamy is the decision maker, the city attorney is his advisor, not the voice in his head telling him what to do.

Support of Council Member Tolliver's Request for a Forensic Audit

Items presented which support forensic audit. Elected Officials, Council Members and the Mayor, were informed I would gladly discuss the general matters mentioned in specific terms with any elected officials interested. I will not make a specific presentation of the items listed due to the good name a character of individuals involved. 
General subject Matter Regarding the Need for a Forensic Audit: 1) Financial Accountability; 2) Property Accountability; 3) Conflicts of Interest, internal and external; 4) Sexual Discrimination; 5) Violation of Civil Rights; 6) Retirement of Financial Director within the next year. This appears to be disputed, however it is my understanding due to a disciplinary action an agreement was made between the former Mayor and the Financial Director that a retirement would be forthcoming in the 2022 year time frame.

Dates of Records Requested – September 1, 2018 thru March 15, 2019

   **1)   Records Requested:  Consultation Report, Memorandums of Record, Human Resource Management Report from Ms. Hope Hicks, Esq., an Attorney hired to conduct - Inquiry, Findings or Suggestions relating to the Scottsboro Municipal Court and personnel employed by the City of Scottsboro Municipal Court, and/or within the City of Scottsboro as an Employer of employees, as a result of complaints relating to Sexual Harassment, Sexual Discrimination, the Creation of a Hostile Work Environment, or a violation of Civil Rights as it relates to employees of the City of Scottsboro.

   *2)   Records Requested: Complaints of Sexual Harassment, Sexual Discrimination, and Creation of a Hostile Work Environment relating to the Employees of the City of Scottsboro working in the Municipal Court of Scottsboro, Alabama. Complaints made to Mayor, Human Resources Director, and/or the consulting Attorney, Ms. Hope Hicks, Esq., regarding the previously mentioned subject matter.

*NOTE ABOVE: Item 2 was provided, complaint of Ms. Caroline Starr, Scottsboro city Magistrate. Later documentation from the new Scottsboro Municipal Judge, Honorable Daryl Eustace with comments from the State Attorney General was provided clearing Ms. Starr and other female personnel in the Magistrates Office.) Items 1 and 3 were not provided.

 **After the City of Scottsboro spending $11,000 to pay Ms. Hope Hicks, a private attorney from Montgomery Alabama specializing in Sexual Harassment/Discrimination case law, for an investigation into Sexual Discrimination/Sexual Harassment/Creation of Hostile Work Environment/Violation of Civil Rights, I find it hard to believe that documentation regarding the investigation she conducted, and resulting recommendations, were not available per law of the State of Alabama.

May 10, 2019 - Public Records Request to the Mayor and City Clerk of the City of Scottsboro, Alabama.

Dates of Records Requested – (on or about) February 1, 2019 thru May 3, 2019

   1)  Records Requested:  Reply to Mrs. Caroline Starr’s complaint to the City of Scottsboro on Municipal Court Letterhead regarding “Harassment,” alleged false reports by City of Scottsboro Finance Director Rick Wheeler and Former Municipal Judge Scott Berry. Only date on Mrs. Starr’s complaint is January 8, 2019. (Ms. Starr cleared per email of Honorable Daryl Eustace regarding finding of the Alabama  A.G.. Ms. Starr's complaint was provided.)

    2)  Records Requested: Disciplinary Action document, dates between February 1, 2019 and April 30, 2019 -   Written Reprimand from the Mayor of Scottsboro Robin Shelton regarding Scottsboro Director of Finance Rick Wheeler involving complaints registered to the City of Scottsboro involving “harassment,” alleged misconduct toward Mrs. Caroline Starr and/or other personnel in the Municipal Court.

    3)  Records Requested: Scottsboro Director of Finance Rick Wheeler’s reply to Disciplinary Action document/Written Reprimand addressed to the Mayor of Scottsboro Robin Shelton, dates between March 1, 2019 and May 1, 2019

 --It was confirmed the documents listed in request items 2 and 3 above existed but were not provided in my records request as required per state law. 

Previous Disciplinary Action documents of other department directors were provided. Was there an official reason for not disclosing the records requested in writing as required by the law, i.e. specific legal exemption per law. Inquiries revealed: 1) A cover-up of the events related to sexual discrimination; 2) non-disclosure of secret agreements related to Mr. Wheeler and the City of Scottsboro and 3) Documents related to an investigation, corrective actions recommended, by a hired attorney not disclosed regarding previous records request.

ALABAMA BASS TRAIL CHAMPIONSHIP TOURNAMENT COMING TO SCOTTSBORO'S GOOSEPOND COLONY IN OCTOBER. https://www.alabamabasstrail.org/

Chamber of Commerce CEO Rick Roden made presentation regarding Scottsboro hosting the Alabama Bass Trail next month, requested Tourism Funding of $10,000 from the city, return of the investment said to be $450,000, spent in the city during the event, $6500 to be paid by the Chamber. However, it was reported the City of Scottsboro's Tourism fund has been depleted. Mr. Roden commented that if the city could not help, the Chamber would pay the full amount. Mr. Roden further commented that apparently in the transition of the former Tourism Director's retirement, the events request for funding was not brought forward to the city council.

City Council Part of the Problem, Not the Solution
Wednesday June 19, 2019 - Messaging to Scottsboro City Council leadership: I submitted a request to the Scottsboro City Council President, Patrick Stewart, to be placed on the agenda for Monday's meeting. Stewart stated, "I will not be present, you will need to ask Council Pro Tem President Greg Mashburn, he will lead the council meeting." I contacted Mr. Mashburn, he refused to place me onto the agenda to discuss Sunshine in Government and a problem with transparency. Mashburn stated, "Unfortunately, I must deny your request to be on the agenda.  I will defer any inquiry or request for information to our legal council." Mashburn did say I could speak at the end of the meeting. I provided him my contact info regarding the issue of transparency and the ongoing cover-up of wrongful conduct by City Officials. He further stated, "I am unaware of any type of cover-up within our city government." I explained further to Mr. Mashburn, “You do not work for the city attorney, you work for the citizens, I am one of those citizens.” Scottsboro City Council Member Greg Mashburn is named in the City Magistrates complaint. I thought it surprising that Mashburn did not call me regarding my concern, I gave him my phone number. and offered to discuss the matter personally with him. 

Public Records Request failure, the law. Code of Alabama (COA) "13A-10-12 (a)(3) Knowing he lacks the authority to retain a governmental record he refuses to deliver up the record in his possession upon proper request of a person lawfully entitled to receive such record for examination or other purposes.
(b) Tampering with governmental records is a Class A misdemeanor."

Proper request submitted to the custodians of records of the City of Scottsboro, Alabama on May 10, 2019 - Records Requested: 1) Reply to the Municipal Court Clerk/Magistrate's complaint of: a) False Statements made against the Court Clerk/Magistrate; b) creation of a hostile work environment by appointed public officials; c) sexual discrimination/harassment by appointed public officials, conspiring to remove the public employee by improper means as a result of making of false statements. 2) Written Disciplinary Action by the Mayor of the City of Scottsboro to the city's Finance Director. 3) The city's Finance Director's reply to the Mayors disciplinary action.

Section 36-12-40
Rights of citizens to inspect and copy public writings . . .
"Every citizen has a right to inspect and take a copy of any public writing of this state, except as otherwise expressly provided by statute." If records requested are denied there must be a specific exemption stated in accordance with the law. There has been no specific exemption stated in accordance with the laws of the state. 

Attorney General's opinions and several court cases affirm the citizen’s right to inspect disciplinary action records and memorandums of reprimand as they are part of the business of government. Dennis Bailey, General Counsel to the Alabama Press Association had this to say recently as a reminder to public officials of the necessity of disclosure: "“In general, applications, disciplinary actions and memorandums of reprimand are documents reasonably necessary to conduct business, and thus subject to disclosure…" Synopsis of AG Opinion 96-0003 – Jeff Sessions, Alabama Attorney General

Keep in mind, the City of Scottsboro paid an attorney, Ms. Hope Hicks, who specializes in employment and equal opportunity law, $11,800. Scottsboro officials have not given the citizens any report regarding her findings. Records requests thus far reveal an intentional effort to cover-up wrongful actions on the part of Scottsboro officials. City Council met in Executive Session on February 11, 2019 with Ms. Hicks and all parties involved in the Municipal Court sexual harassment/creation of a hostile work environment, false statements complaint by Scottsboro Municipal Court Clerk/Magistrate to discuss this matter. February 25, 2019 the Scottsboro City Council, agenda item 3, approved $11,800 to be paid to Ms. Hope Hicks. City Council President Patrick Stewart announced the resignation of Scott Berry the Municipal Court Judge during this Feb. 25, 2019 City Council meeting. When the City Attorney was asked if the Resignation Letter would be available, he stated no, not at this time. 

A reminder to those on the Scottsboro City Council, Mayor and City Clerk and any other elected or appointed official that has a problem with Sunshine in Government. You should take to heart the adage -   "Sunshine is the greatest disinfectant of government corruption." Such is the case of Scottsboro City Officials failing to disclose written reprimands by the Mayor regarding an appointed public official’s misconduct, including that public official's reply to the Mayor. This unlawful failure to disclose the public records is effectively a covering-up of misconduct by public officials.

On March 19, 2019 I submitted a public records request in accordance with the laws of the State of Alabama regarding allegations of Sexual Harassment and creating a Hostile Work Environment in the Municipal Court of Scottsboro against female personnel. On May 6, 2019 I received one document,  a complaint made by Mrs. Caroline Starr, documentation confirms the complaint was made. As a result of this document receipt and interviews I have requested further specific documents to inform the public of alleged misconduct and/or illegal activity which have not been disclosed to the citizens of Scottsboro.

UPDATE - April 24, 2019 - Were crimes committed?
Interviews of Public Officials in the City of Scottsboro reveal allegations of alleged Criminal Conspiracy and False Statements relating to allegations of theft and possible criminal sexual harassment and violation of city personnel policy - Creation of a Hostile Work Environment, within the Municipal Court System of the City of Scottsboro. A result of alleged false statements and personnel misconduct, involving local allegations and allegations made to the Alabama Attorney General by appointed Public Officials.

According to those interviewed, this was an alleged planned personal attack against one or more female employees of the City of Scottsboro, thus the alleged conspiracy and the alleged submission of false statements.

There appears to be an effort to cover-up alleged false allegations of theft/misappropriation of government funds from the Municipal Court System. Interviews of Public Officials and employees of the City of Scottsboro reveal there is an EEOC complaint which the City of Scottsboro must answer soon. Interviews reveal there is an ongoing Alabama Attorney Generals Investigation.

The alleged criminal activity involves current and former Scottsboro Public Officials, both appointed and elected. Information regarding specific complaints and disciplinary actions, including reports is what these Public Records Requests concern.

UPDATE - PUBLIC RECORDS REQUEST
As of April 22, 2019 the following request for Public Records dated March 19, 2019, as indicated below, has not been honored. 

The City of Scottsboro Alabama hired an outside Attorney to conduct an inquiry/investigation into allegations of specific individual Public Officials were allegedly creating a hostile work environment and possible violations of Federal Law relating to Sexual Discrimination of Female Employees; the outside Attorney was Ms. Hope Hicks, Esquire, was paid $11,800 for her professional opinion/attorney fees, (disclosed in February 25the City Council meeting, agenda item 3 approved (update this blog story Apr. 25, 2019)) findings or report. To date the Public Records Request, as described below, has not been fulfilled, however the request is under review by the City Attorney.

I have inquired weekly to the Mayor and City Clerk of Scottsboro, Alabama regarding this request. It has been discovered via inquiry there are specifically 3 documents pertaining to this request, possibly more documents, which includes related disciplinary action documents. 

This request serves a public purpose to disclose the events and conduct of Public Officials within the City of Scottsboro involving either alleged illegal conduct or violation of public policy or personnel policy of the City of Scottsboro. 

The citizens of the City of Scottsboro have a right to know about inappropriate behavior of Public Officials which unfortunately has all the appearances, and evidence disclosing a pattern of wrongful conduct on the part of appointed Public Officials, relating to sexual discrimination and the creation of a hostile work environment. Specifically in this incident, involving the Scottsboro Municipal Court System and the City of Scottsboro's Finance Director. Information has also been received that a former elected official of the City of Scottsboro may have contributed as an antagonizer or instigator regarding the alleged unlawful act or violation of public policy regarding creation of a hostile work environment and/or sexual discrimination as a factor in the allegations.

I find it hard to believe that an Attorney paid in excess of $11,000 to conduct an inquiry/investigation into the creation of a hostile work environment, specifically when there has been established patterns regarding policy or law violations,  would not produce a work product which would make either recommendations or identify wrongful conduct of parties involved and or corrective actions which should be taken.

Verbal conversation with the City Attorney revealed, he is examining documents, however he stated,  there exists a 2001 Attorney General's Opinion allowing for no disclosure of some of the documents. I asked of the City Attorney to please cite the specific reasons for the non-disclosure; his answer would be, no records available to be released, as to a reason of non-disclosure. When asked how long will it be, he stated: "When I have time." The City Attorney did state there was one record at this time which could be released. I informed the City Attorney to please provide all documents at one time or cite reasons for non-disclosure at the time of the records release.

1)   Records Requested:  Consultation Report, Memorandums of Record, Human Resource Management Report from Ms. Hope Hicks, Esq., an Attorney hired to conduct - Inquiry, Findings or Suggestions relating to the Scottsboro Municipal Court and personnel employed by the City of Scottsboro Municipal Court, and/or within the City of Scottsboro as an Employer of employees, as a result of complaints relating to Sexual Harassment, Sexual Discrimination, the Creation of a Hostile Work Environment, or a violation of Civil Rights as it relates to employees of the City of Scottsboro.
2)   Records Requested: Complaints of Sexual Harassment, Sexual Discrimination, and Creation of a Hostile Work Environment relating to the Employees of the City of Scottsboro working in the Municipal Court of Scottsboro, Alabama. Complaints made to Mayor, Human Resources Director, and/or the consulting Attorney, Ms. Hope Hicks, Esq., regarding the previously mentioned subject matter.
3)   Records Requested: Any Findings, Memorandums, Documents or Reports related to the subject matter requested above, within the date range listed above, including documents from City of Scottsboros Mayor, any City Council Member, Human Resource Director, Municipal Court Judge, or Finance Director.
