JAMES MADISON QUOTE - 1822

"A popular government without popular information, or the means of acquiring it, is but a Prologue to a Farce or a Tragedy; or, perhaps both. Knowledge will forever govern ignorance; and a people who mean to be their own governors must arm themselves with the power knowledge gives."

CENSORED - Censored Images and statement by Affiliated Scottsboro, Tax Payer Supported Programs - Downtown Scottsboro, Main Street Scottsboro, Scottsboro Trade Days, in Violation of the Alabama Constitution and the U.S. Constitution - Violation of Civil Rights. Because of my posting of these images I have been blocked from posting on the mentioned City of Scottsboro affiliated sites on Facebook, but not the City of Scottsboro Facebook site. Some might say, that is not the City of Scottsboro, the address of these programs are 316 S. The Main Street Program Director is an employee of the City of Scottsboro as Marketing Director and is directly supervised by the Mayor of the City of Scottsboro per job description.

Censored Statement Regarding Murdered Capitol Police Officer
We shall never forget. "After serving in the Air National Guard and dreaming of becoming a police officer, Brian D. Sicknick joined the Capitol Police force in 2008. He died the day after he was overpowered and beaten by rioters from the mob at the Capitol." From New York Times - https://www.nytimes.com/2021/01/11/us/who-died-in-capitol-building-attack.html

Photo of Senator Bernie Sanders who represents a specific political platform placed on the  Scottsboro affiliated, tax payer supported program sites - Downtown Scottsboro, Main Street Scottsboro, Scottsboro Trade Days. The photograph of Senator Bernie Sanders was taken by a New York Times Correspondent while Senator Sanders was waiting on the Capitol Steps for the Biden Inauguration program to begin. Link: https://www.nytimes.com/2021/01/21/us/politics/bernie-sanders-meme.html  After the Senator Sanders photos a photo was placed on each comment from the above censored photographs, and the short bio from the New York times about the murder of Officer Sicknick. Senator Sanders photo was posed on various Scottsboro locations.

I have no problem with the Senator Bernie Sanders Photos and photo shop images. My problem and complaint is that of censorship of other political images and statements in violation of our State and U.S. Constitution. Should Tax Payers be supporting such programs which censor political speech of citizens while allowing political speech of the site administrators?

Scottsboro, Alabama - February 8, 2021 - (City and County Government Meetings Review and Issues) - Scottsboro City Council Regular Session and Jackson County Commission - City Council Agenda, Video, Censorship Issue - UPDATES February 9, 2021 - Main Street Program - Downtown Scottsboro - Scottsboro Trade Days - Responsibilities and Organizational Structure per Records Request Disclosures - Forensic Audit Needed - February 10, 2021 - Error in Main Street Board Membership List Corrected - Jackson County Commission Agenda and Facebook Video - UPDATE - February 12, 2021 - Commission Not Involving Legislative Delegation in Discussions Regarding Tax Revenue Distribution and Bond Issue - More on the Guffey Affair - WILL GUFFEY RETURN, WILL THE GOVERNOR ACT??

Part 1 of the Guffey Affair, plus all the issues involving courthouse security, this involves the Guffey Affair with associated documents and allegations: https://arklite.blogspot.com/search/label/Jackson%20County%20Courthouse%20Security.

WILL GUFFEY RETURN, WILL THE GOVERNOR ACT IMMEDIATELY??
WHAT IS THE STATUS OF THE ONGOING CRIMINAL INVESTIGATION?
IS ALABAMA THE MOST CORRUPT STATE IN THE UNITED STATES OF AMERICA?
SOME FOLKS SEEM TO HAVE FORGOTTEN, WE DO NOT ELECT KINGS, LAW IS KING, EXCEPT IN ALABAMA?

SMALL PRINT: The Jackson County Commission accepted Guffey's resignation effective immediately, NOW, back in 2020.  There is case law concerning these issues. Surely the Jackson County Commission and those political officials which planned the numerous false statements regarding Mr. Guffey's actions via Press Releases, hid his resignation initially, and planned this business with conspiring to steal money from the citizens of Jackson County by paying Guffey for doing nothing while at home. In the words of Mr. Jason Venable, Acting Commission Chair to the local press, paraphrased - "There is no law which says a commission chair must show up to work." WRONG - a paid full time political official has the responsibility to show up at work, perform his sworn duties, if not, that is theft of pay and benefits. Is there is a scheme involving multiple officials to pay Guffey for not working, for what purpose? Certainly not to avoid impeachment, which has been suggested.

Tim Guffey, Chair/Not the Chair, resignation accepted immediately by the Jackson County Commission, sitting at home doing nothing, getting paid until April 11, 2021. In Alabama County Elected Officials may lie to the public, scheme and sexually harass women in the work place, stay at home receive pay and benefits, do nothing, and receive no corrective or disciplinary action?? (photo by G.Morgan)

WHAT IS "EFFECTIVE IMMEDIATELY" MEAN?
Records disclosure reveals the resignation requested by Guffey does not take effect until April 11, 2021.
Is Alabama corrupt and inept to the extent that county elected public officials may submit a resignation for a future date to the governor, not come to work for months or longer, receive all pay and allowances, and that is ok in Alabama??

Per statement of the Main Street Program Director, Ms. Kirkland's Cover Letter, Organization and Responsibilities, Statement; Facebook Page(s) Administrator is Ms. Kirkland, Ms. Reynolds and Mr. Cisco. Ms. Kirkland stated to me this evening she was not aware of the censorship and blocking actions of Mr. Cisco until last Monday, February 1, 2021 when I provided her, the Mayor and City Council with Mr. Cisco's actions, which raise multi-levels of concern relative to violation of Civil Rights, ref: political censorship and blocking;  questionable administrative and leadership controls of the Main Street Program. I informed Ms. Kirkland that I had attempted to contact Mr. Cisco via Facebook Messenger. Mr. Cisco was sent a message asking him if he was sure he wanted to take this action, I received no reply as he blocked me from his personal page to prevent communications.

Main Street Program on Facebook is now the Downtown Scottsboro Program.

Downtown Scottsboro controls the Scottsboro Trade Days; once again address Scottsboro City Hall, phone number Scottsboro City Hall.

Because of the censorship issue, violation of Alabama's Constitution and the United States of America Constitution as to responsible speech, questions must be asked regarding financial and supervisory accountability.

With all the changes in organization, where does the money go? Faces in the following web based pages are altered, names are not altered.

Mr. Cisco is an Auditor working for Gant, Croft and Associates per Mr. Cisco's claim
Link to City of Scottsboro audits:
Gant, Croft and Associates is the Auditor for the City of Scottsboro, Alabama.

Before I get to the Scottsboro City Council Video, there are several issues involved within this article: 1) Censorship by government and entities representing government regarding political speech, including those entities which by non-profit status creation attempt to circumvent accountability. Some local and state governments within Alabama have a sordid history of this activity, which is in itself another issue. 2) Accountability as to financial, administrative and supervisory. Unfortunately, government officials sometimes forget whom they work for, WE THE PEOPLE. Political officials are our stewards whom we elect to manage OUR government systems lawfully and efficiently. To insure OUR government systems are managed lawfully and efficiently, government entities audit the entity by outside auditors. Those auditors must be free of conflicts. Which brings us to the current problem within the City of Scottsboro.
Image by 24newshd.tv - Fair Use for non-profit news reporting and commentary

Problem Resolution to decrease risk to financial, legal and supervisory accountability. It has been suggested last month by one of our esteemed City Council Members, Ms. Tolliver, that an independent forensic audit should occur by the State of Alabama. That was investigated and there was a reply that it would take forever and it would be expensive, EXCUSES rolled forth.

After examination of our sordid past history within the City of Scottsboro, there are many reasons why a Forensic Audit should take place immediately. Incidents after incidents related to accountability raise cause for concerns, the incidents have been occurring for over a decade. These multiple specific issues will be discussed at the next City Council Meeting.

Ms. Tolliver, Council Members, the Forensic Audit must occur, sooner rather than later. A civilian auditing firm, certified CPA's who are astute and experienced at Forensic Audits are available in Alabama.

MY THOUGHTS - CONDUCT THE FORENSIC AUDIT OF THE CITY OF SCOTTSBORO AND THOSE CORPORATE ENTITIES OF THE CITY OF SCOTTSBORO WHICH THE CITY OF SCOTTSBORO HAS HAD DIRECT, CONTINUOUS FINANCIAL DEALINGS WITHIN THE PAST DECADE.

A story about propaganda and, YOU MADE YOUR BED, NOW LAY IN IT! --- It is important to point out, once again, this is a dead issue regarding the taxation/revenue, which has not been properly dealt with within the County Commission. Before any diversion of the revenue may occur the Alabama Legislature must approve, the Legislative Delegation must be involved. The school bond issue involved an increase in "COUNTY SALES TAXES", those taxes are for school use only per legislative act. You have not adequately explained the details to the citizenry. Mr. Buckner and others, you are not placing forth a true picture until you work with the legislative delegation, not once did you mention the involvement of the State Legislature. The bottom line, you are not telling the full truth. The State Auditors already found a deficiency in your diversion of funds, which you had to pay back, remember that fiasco. If you are not aware of the auditors decision, best check on it. Mr. Porters comments about the Legislative Delegation and the school boards is an interesting problem. The bottom line is this, double talk, still no Legislative Delegation involvement. School gets money thru lawful acts delegating where tax money will be routed, now the commission wants the schools to give it back in part. M r. Venable and the commissions scheme sounds like a propaganda, diversion scheme. Venable continues with his propaganda in stating that he didn't know, not an excuse. Then you complain about the Google Tax Abatement, which you approved. Trade of Revenue vs Violation of State Law. AGAIN AND AGAIN, you must involve the Legislative Delegation, to include within your public discussion, at least a mention that you are working with them, if not, your discussions are a mute point and deceitful, unrealistic discussions. 10 years of the Jackson County Budget, including legislative issues:

WILL GUFFEY RETURN - WILL THE GOVERNOR ACT IMMEDIATELY, OR AS GUFFEY WANTS, STAY HOME AND GET PAID FOR DOING NOTHING??
More on the Guffey Affair
From the December 20, 2020 Article
When is a resignation effective?
Attorney Generals Opinion: 95-00182 Commission Chair Vacating Office - It appears, that once the governor accepts the resignation the vacancy may be filled. What is the bearing on Guffey's requested resignation date? To remain in office for 4 months once a resignation has been submitted and accepted by the County Commission, to receive pay, is that a conflict of interest, Guffey's self declaration, since there was no approval of administrative leave or medical leave by the Jackson county Commission.

The question is, has Governor Ivey accepted Guffey's resignation or not? If not, Guffey could come back, never mind his ripping the tax payers off of 4 months of pay for doing nothing. Do ethics not matter in the State of Alabama, does law not matter??

Cancellation of Scottsboro Downtown Market Event Associated with Protest of Sheriffs Department Officer Involved Shooting in Pisgah, Alabama; Release of Officer Shooting Video, Allegations of Davis's Family Suggests Failure to Secure Evidence, Coverup?? - UPDATES (1215 4-5-17) (4-11-17): Chief Deputy Rocky Harnen Provides Information, (4-11-17) New Video - UPDATE - March 1, 2021 - National Drug Threat Assessment- DEA

Facebook cropped photo of Alex Davis, Fair Use for non-profit news reporting.

According to various news reports 18 year old Alex Davis, a Pisgah High School Student, was shot and killed by a Jackson County Sheriff's Deputy in Pisgah, Alabama on February 7, 2017 after responding to a "fight call" on County Road 60.

Al.com news reported the deputy responding found a man bleeding from "a hammer blow to the head." The responding officer attempted to subdue Davis by using non-lethal force via a "stun gun" to subdue Mr. Davis. It was reported the non-lethal force was not successful, "the deputy then "fired his gun." http://www.al.com/news/huntsville/index.ssf/2017/02/high_school_student_killed_by.html

WHNT-TV Huntsville, Al. News report stated - "According to the Sheriff’s Office, Davis came at the deputy with a board. The deputy asked him to stop repeatedly. He also tried to subdue the teenager with his stun gun twice. Investigators say Davis was able to regain strength and pull the electrodes off him to pursue the deputy again. That’s when the deputy shot Davis, who died at the scene." http://whnt.com/2017/02/07/1-person-killed-following-deputy-involved-shooting-in-pisgah/
(UPDATE) Chief Deputy Harnen stated to me in the phone conversation that the deputy involved in the shooting had expended all of his taser cartridges in the attempt to subdue Davis with non-lethal force.

WRCB-TV Chattanooga, Tn. "The NBC affiliate in Huntsville, WAFF 48 News, spoke with the young man's bus driver. Melissa Morgan said he was very friendly and a good friend...Neighbors learning about the shooting are questioning why someone had to die." http://www.wrcbtv.com/story/34454946/pisgah-hs-student-shot-killed-by-jackson-county-deputy

UPDATE: 12:15 PM Wednesday April 5, 2017 - Phone Conversation From Chief Deputy Rocky Harnen of the Jackson County Sheriffs Department
Chief Deputy Rocky Harnen, Jackson County Sheriffs Department. (Photo by Jackson County Sheriffs Department - Fair Use for non-profit news reporting and commentary.)

Not All is Apparent in the Video Released

Chief Deputy Harnen stated: The board displayed by the concerned relative in the below video is not the board which the suspect utilized to strike the auto or threaten the officer - "That board is in the possession of the ABI (Alabama Bureau of Investigation) as evidence. There were several boards in the yard area."

Chief Deputy Harnen also stated in regards to the video shown in the links: "The video displayed is not the entire video, there is more, hours." I asked, "how much of the video did you watch?" Chief Harnen's reply, "I watched about 30 minutes." Chief Harnen mentioned there were different angles. I asked: "Were there more than one camera?" His reply, "yes."

March 27, 2017 Video Surfaces

WZDX - Huntsville, Alabama and RocketCity.Com reports on March 27, 2017 that a video surfaces in the officer involved shooting. "The Jackson County DA took the case to a grand jury where evidence was presented. That jury decided against indicting the deputy. Davis' biological mother, Mandy Carrasco is now speaking out and showed video of the encounter between Davis and the deputy."  http://www.rocketcitynow.com/news/exclusive-video-from-officer-involved-shooting-in-jackson-co/681520288?utm_medium=social&utm_source=WZDX_Huntsville

Home Security Video of the shooting displays disturbing revelations. (Update} But as the Chief Deputy points out above, the entire video is not shown.  http://www.clipsyndicate.com/video/play/6847151

(Update} It is important to point out that the deputy was cleared of any wrong doing by the Alabama Law Enforcement Agency's investigations division. There has been no release of forensic information regarding toxicology testing of Mr. Davis.

April 4, 2017 Downtown Scottsboro Reports on Weekend Market - Cancelling the Market Due to Protest About the Officer Involved Shooting

(Fair use of public Facebook photo of ad for non-profit news reporting and commentary)

"Downtown Scottsboro regrets to announce the postponement of Market on the Square on April 8th. We have been made aware of a planned protest to be held on The Courthouse Square on this same date. In an abundance of caution, we feel it is in the best interest of our vendors and our community to postpone Market until further notice. As soon as that date is determined, we will let everyone know.
All vendor fees will be returned ASAP by U.S. mail."
"Thank you for your understanding and your continued support."

Quite a few people had a comment about the cancellation of the Scottsboro Downtown Market event, including myself. Several postings were censored/removed.

My initial comment to questions regarding permits for a protest - Answer to the question asked: "There is no requirement to have a permit to protest. I have discussed the right of protest with county and city public officials and protested on the square and in front of city hall regarding political issues. Here are some basic rules. 1) Protesters may not be armed; 2) Protestors may protest on public property but may not interfere with the rights of others as to egress or regress into or out of buildings or obstruct the flow of traffic. 3) Protesting does not mean inciting riots or facilitating violence. 4) Communications of threats is against the law. 5) Laws apply anywhere including a protest, it is not against the law to express speech. The cancellation of the market is typical of those who have a right wing agenda facilitating fear regarding the rights of citizens. To say protestors will be violent is a ridiculous, assuming statement. The protesters have achieved one of their goals, bring attention to what they believe is a problem. The smart thing to do would have been to hold the market and have the Sheriff and a representative of the DA's office present to discuss the situation with the protestors and hold a press conference. Act smart, not ridiculous by demonstrating fear to our nations most time honored traditions."

It was also revealed that the Sheriff's Department had not been contacted by the Downtown Scottsboro group to determine if there was a security problem or to ascertain the Sheriffs thoughts about security.

Scottsboro City Council Meeting - Part 1 Work Session; Part 2 Regular Session March 27, 2017 - First Monday, Downtown Scottsboro, Scottsboro Downtown Redevelopment Authority, Scottsboro Cruise-In

Scottsboro's First Monday Trade Days is the longest continuous historical event in Jackson County Alabama and the City of Scottsboro. The last Mayor to strongly support this event was Mayor Dan Deason.

The event has taken big hits in the last few years, primarily due to the intentional denigration by an earlier Tourism Advisory Committee, which recommended the event be held one time a year; a city councilman who commented that it was not worth the time and effort; and a Scottsboro event coordinator under Mayor Potter who went to the square and literally ran people off. The current City Council has offered very little support for the event, but offers considerable support for conflicting events. There should be an effort to advertise Scottsboro and all it's events. This photo -  Earliest known photo of First Monday (photo owned by G. Morgan, former proof photo from the Asheville Post Card Co.)

MY POSTING ON FACEBOOK REGARDING "DOWNTOWN SCOTTSBORO" MARKET ON THE SQUARE

Downtown Scottsboro, Market on the Square - conflicts - non-profit status and relationships. Co-mingling of funds, governmental and non-profit funds? This letter was provided via Facebook messenger and the Downtown Scottsboro Facebook site early this morning.
At last night's City Council meeting, March 27, 2017, it was stated that “Downtown Scottsboro” is a non-profit 501c3 organization.
The City Council voted to cover the activities regarding ‘Market on the Square,’ on the City of Scottsboro's insurance as a co-sponsor of this event. I asked for your 501c3 status on March 9, 2015, you did not answer my request. I'm once again asking for proof of your non-profit (NP) status, if you have a NP status.
What is your relationship to the ‘Revive Scottsboro’ group? Is the ‘Revive Scottsboro’ group a 501c3 organization connected to “Downtown Scottsboro?” I ask this question due to my removal from the ‘Revive’ group when I asked about its’ purpose. I noticed discriminatory comments, and questions about inclusivity of all citizens. It is and was my opinion that the ‘Revive’ group is a discriminatory organization which does not stand up to tests regarding supporting equitable treatment of all citizens. Leadership of the group failed to answer simple questions regarding purpose of the group.
Upon review of your Facebook page it was noticed that previous funds allegedly provided to this group were paid, per your request, to the DRA, Scottsboro Downtown Redevelopment Authority for Christmas decorations, the DRA is a corporate entity of the City of Scottsboro.
Does the “Downtown Scottsboro” organization have a board and leadership, do you have an official organization, do you have bylaws, and what is your connection to the DRA? It has been previously stated that you are not connected with the DRA, obviously that is not true since you advertised a place to send checks on your Facebook page,to the DRA as pictured below  https://www.facebook.com/downtownscottsboro/

"Downtown Scottsboro" in your Downtown Market flyer you state you are a non-profit entity and that you collect funds. As such, and with the connection to the City of Scottsboro, and the DRA it is important that you disclose your non-profit status.
The issue of revitalization/redevelopment are important issues, and Scottsboro is in need of a strong revitalization/redevelopment program. However, its purpose and activities were questioned during its’ formation. The American Planning Association has specific guidelines regarding Redevelopment Programs. Previous article and questions raised about the DRA and their purpose along with video regarding its’ formation. http://arklite.blogspot.com/…/scottsboro-city-council-work-…
All of this is confusing, I'm asking for clarifications regarding relationships to the Scottsboro DRA, “Downtown Scottsboro” and Revive Scottsboro. Please respond on Facebook Messenger or my email address, as supplied on Facebook messenger. I would like to see a copy of your 501c3 status, if you have one.

The three above photos were taken form the "Downtown Scottsboro" Facebook page, a public page on Facebook. ( the photos copy purpose are Fair-Use for non-profit news reporting and commentary). The Market on the Square is one week after First Monday.

SCOTTSBORO CRUISE-IN
The Cruise-In on the Square was a great benefit to the First Monday Event and drew large crowds. It was announced at last nights City Council Meeting the Cruise-In would be moved to behind 50-Taters in the old K-Mart parking area.
This event was conceived to support First Monday as this poster depicts. The event is to be moved off of the Square beginning in April 2017. The Scottsboro City Council approved a $4950.00 Tourism Grant for the event to be located behind 50-Taters on County Park Road. There was no prior discussion as to the intention to move the Cruise-In event. It seems the movement of the event was reached in secret.

The Cruise-In supports children in county schools who cannot afford food after school is out, an admirable program. I wish them the best of luck. It is unfortunate the City of Scottsboro does not support this event remaining on the Square. The early events were held surrounding the current city hall.
Links regarding the Cruise-In supporting it with videos and lots of pictures, going back to 2008.

BUDGET HEARINGS
During the Scottsboro Budget hearings I had requested funds to advertise First Monday and/or the City of Scottsboro. Not one City Council Member, nor our current Mayor said anything about any level of advertising support. The silence was broken by Dr. Andrew Hodges of the Downtown Revitalization Authority stating, First Monday should be supported.

CONTRACT AND GRANT FOR NEW SCOTTSBORO ENTRY WAY SIGNS
When this came before the City Council I asked if this sign could be attached to the new entry way signs
There was no commitment to this request, silence regarding the City Council supporting First Monday is not golden. The City of Scottsboro does have the First Monday Event on the City website.
My work supporting First Monday is voluntary, I also maintain the First Monday Facebook page which may be found at https://www.facebook.com/tradedayscottsboro/

BOTTOM LINE
The City Council and the Mayor need to take a leadership role in this city regarding the various events. The last Mayor to offer constructive event planning and coordination was Mayor Dan Deason. Hopefully, the current council and Mayor will wake up and realize they have a leadership responsibility.

DOWNTOWN SQUARE RENOVATION
Square renovation will begin on April 17, 2017. The renovation will begin on the east side, starting on the southeast corner.
