A study of history reveals the coverup of public corruption and/or criminal activity is often worse than the original corrupt or criminal act. When the Jackson County Commission received this official report they had a responsibility to report this to the public, the citizens of Jackson County Alabama, they failed to do so. The report was released officially via the Alabama Department of Public Examiners Friday, April 30, 2021, 5 days ago. Poor judgement on the part of the commissioners in this case is not a criminal act, it certainly is a consideration for the voters of Jackson County come time for reelection

SUMMARY

Special Report on the Jackson County Commission August 24, 2018 through December 4, 2020 

The Jackson County Commission (the “Commission”) is governed by a five-member body elected by the citizens of Jackson County. The members and administrative personnel in charge of governance of the Commission are listed on Exhibit 1. The Commission is the governmental agency that provides general administration, public safety, construction and maintenance of county roads and bridges, sanitation services, and health and welfare services to the citizens of Jackson County.

This report presents the results of a special examination of the Jackson County Commission and a review of compliance with applicable laws and regulations in accordance with the requirements of the Department of Examiners of Public Accounts under the authority of the Code of Alabama 1975, Section 41-5A-12. We performed an examination of credit card transactions and other expenditures made by the Commission to determine whether inappropriate use of public funds occurred. 

FINDINGS

Instances of noncompliance with state and local laws and regulations and other matters were found during the examination, as shown on the Schedule of Findings and they are summarized below.

2021-001 relates to the former Commission Chairman’s noncompliance with requirements prescribed by the Chief Examiner of Public Accounts and the county’s travel policy regarding credit card usage and documentation of credit card charges.

2021-002 relates to the former Commission Chairman’s failure to provide an adequate reason for mileage claimed for travel.

21-236 B  - CHARGES AGAINST OFFICIAL

As reflected on Exhibit 2, the charges against the former Commission Chairman resulted from noncompliance with requirements prescribed by the Chief Examiner of Public Accounts and the county’s travel policy related to credit card usage and documentation of credit card charges, as well as the failure to provide an adequate reason for mileage claimed for travel. Official demand was made on the former Chairman requesting payments totaling $3,918.11.

The former Chairman failed to appear at a meeting before the Chief Examiner and show just cause why the amounts should not be repaid; therefore, relief is accordingly denied as evidenced by the Order of the Chief Examiner contained in this report.  After the Order of the Chief Examiner was issued, the charges were repaid in full.

EXIT CONFERENCE

The Commission members and administrative personnel, as reflected on Exhibit 1, were invited to discuss the results of this report at an exit conference held via teleconference. Individuals in attendance were: Commissioners: Danny Rich and Jason Venable; and Bob Manning, County Administrator. Also, in attendance was a representative from the Department of Examiners of Public Accounts: Dixie Broadwater, Special Projects Manager. The results of this report were also discussed individually via telephone with the former Commission Chairman, Tim Guffey.

  Mr. Venable does not accurately portray the seriousness of this event in his statement, Clarion's Facebook link above, and all that surrounds Guffey's resignation. Quote from the Chief Examiner in the audit report: "Instances of noncompliance with state and local laws. . ." The near $4000 of credit card abuse may have been repaid; who repaid the tax payers of the county for the auditors cost ($5,000-$10,000 maybe more), who has repaid the county for Guffey setting at home doing nothing for 4 months, December 2020 thru April 2021, at tax payers expense, approximately $19,000, per commission approval, for his alleged illegal and unethical behavior regarding sexual harassment and creation of a hostile work environment, including alleged criminal behavior investigated by state law enforcement investigators? What is the outcome of that investigation?  What type of actions is the county taking to insure sexual discrimination and creation of a hostile work environment will not reoccur?

Jackson County Commission attempts to limit and censor citizen speech relating to Commissioner Venable's questionable comments, discussed below, via a video he posted on the Jackson County Commission's Facebook site regarding the recent State of Alabama Department of Public Examiners Audit disclosure of former Commission Chair Guffey's misuse of county funds.
Unfortunately, the Jackson County Commission has placed this notice to the video posting of Mr. Venable on the Commission's Facebook Page, quote: ->"JACKSON COUNTY COMMISSION LIMITED WHO CAN COMMENT ON THIS POST." <-
Commissioners, you are the stewards of the citizens of Jackson County Alabama. You have no right to limit the comments or censor speech from one or more citizens, unless it is a threat or violates law. Your page on Facebook is the Public Square and a Public Forum of the government entity.

The citizenry, whom you work for have every right to express their discontent or dissent with your actions. Including those actions when placed on a public forum, such as the Jackson County Commission's Facebook site. Is this the conclusion of the "Guffey Affair?" 
Some would like to think so, it is not, there is more to come. Unfortunately some local politicians have not learned the lessons of history; "the coverup is often worse than the original offense." 

WHAT ARE THE "MORE TO COME" PROBLEMS AND ALLEGATIONS FOR FORMER COMMISSION CHAIR GUFFEY AND THE JACKSON COUNTY COMMISSION?
Alleged criminal and ethics issues remaining, not resolved, per interview with persons knowledgeable regarding the alleged criminal and unethical events: 1) Alleged sexual assault; 2) alleged threatening communications; 3) creation of hostile work environment,\ (established), (a) alleged violation of Civil Rights Act, (b) allegedly utilizing the "color of law and official position" to sexually harass, threaten, stalk employees, thus creation of a hostile work environment; 4) alleged stalking, hidden videoing of female personnel in their workplace. 5) alleged tampering with physical evidence related to a criminal act; 6) alleged conspiracy by political officials, 5 or more persons, to destroy video documentation, video record, of events related to criminal acts or violation of Civil Rights; 7) alleged secret meeting with a quorum of  commissioners and with other county officials/employees for the purpose of destruction of video evidence.

UPDATE: May, 3, 2021 - Interviews with Commissioner Buckner and Commissioner Rich seperately. - Both Commissioners emphatically deny that any meeting occurred in secret or otherwise, with them participating, regarding decision making to remove any information, evidence, etc. regarding video or photographs of female persons which may have been allegedly photographed or downloaded by former Commission Chair Guffey contained on Jackson County data systems or computer systems.

WILL GUFFEY RETURN, WILL THE GOVERNOR ACT IMMEDIATELY??
WHAT IS THE STATUS OF THE ONGOING CRIMINAL INVESTIGATION?

SMALL PRINT: The Jackson County Commission accepted Guffey's resignation effective immediately, NOW, back in 2020.  There is case law concerning these issues. Surely the Jackson County Commission and those political officials which planned the numerous false statements regarding Mr. Guffey's actions via Press Releases, hid his resignation initially, and planned this business with conspiring to steal money from the citizens of Jackson County by paying Guffey for doing nothing while at home. In the words of Mr. Jason Venable, Acting Commission Chair to the local press, paraphrased - "There is no law which says a commission chair must show up to work." WRONG - a paid full time political official has the responsibility to show up at work, perform his sworn duties, if not, that is theft of pay and benefits. Is there is a scheme involving multiple officials to pay Guffey for not working, for what purpose? Certainly not to avoid impeachment, which has been suggested.

Is Alabama corrupt and inept to the extent that county elected public officials may submit a resignation for a future date to the governor, not come to work for months or longer, receive all pay and allowances, and that is ok in Alabama??

Director of the Mainstreet Program and the Events Coordinator for the City of Scottsboro was Margaret Nippers, currently it is Katie Kirkland. The Mayor of the City of Scottsboro is the Supervisor of the Events Coordinator, Main Street Scottsboro Director per Job Description. Ms. Nippers mention in this is important, it was Ms. Nippers, Scottsboro's Events Coordinator, who initiated the submission to the Alabama Secretary of State for the 501c6 approval, which was approved.

Per statement of the Main Street Program Director, Ms. Kirkland's Cover Letter, Organization and Responsibilities, Statement; Facebook Page(s) Administrator is Ms. Kirkland, Ms. Reynolds and Mr. Cisco. Ms. Kirkland stated to me this evening she was not aware of the censorship and blocking actions of Mr. Cisco until last Monday, February 1, 2021 when I provided her, the Mayor and City Council with Mr. Cisco's actions, which raise multi-levels of concern relative to violation of Civil Rights, ref: political censorship and blocking;  questionable administrative and leadership controls of the Main Street Program. I informed Ms. Kirkland that I had attempted to contact Mr. Cisco via Facebook Messenger. Mr. Cisco was sent a message asking him if he was sure he wanted to take this action, I received no reply as he blocked me from his personal page to prevent communications. 

Main Street Program on Facebook is now the Downtown Scottsboro Program.

Downtown Scottsboro controls the Scottsboro Trade Days; once again address Scottsboro City Hall, phone number Scottsboro City Hall.

Because of the censorship issue, violation of Alabama's Constitution and the United States of America Constitution as to responsible speech, questions must be asked regarding financial and supervisory accountability.

Before I get to the Scottsboro City Council Video, there are several issues involved within this article: 1) Censorship by government and entities representing government regarding political speech, including those entities which by non-profit status creation attempt to circumvent accountability. Some local and state governments within Alabama have a sordid history of this activity, which is in itself another issue. 2) Accountability as to financial, administrative and supervisory. Unfortunately, government officials sometimes forget whom they work for, WE THE PEOPLE. Political officials are our stewards whom we elect to manage OUR government systems lawfully and efficiently. To insure OUR government systems are managed lawfully and efficiently, government entities audit the entity by outside auditors. Those auditors must be free of conflicts. Which brings us to the current problem within the City of Scottsboro.

Problem Resolution to decrease risk to financial, legal and supervisory accountability. It has been suggested last month by one of our esteemed City Council Members, Ms. Tolliver, that an independent forensic audit should occur by the State of Alabama. That was investigated and there was a reply that it would take forever and it would be expensive, EXCUSES rolled forth. 

After examination of our sordid past history within the City of Scottsboro, there are many reasons why a Forensic Audit should take place immediately. Incidents after incidents related to accountability raise cause for concerns, the incidents have been occurring for over a decade. These multiple specific issues will be discussed at the next City Council Meeting. 

Ms. Tolliver, Council Members, the Forensic Audit must occur, sooner rather than later. A civilian auditing firm, certified CPA's who are astute and experienced at Forensic Audits are available in Alabama.
 
MY THOUGHTS - CONDUCT THE FORENSIC AUDIT OF THE CITY OF SCOTTSBORO AND THOSE CORPORATE ENTITIES OF THE CITY OF SCOTTSBORO WHICH THE CITY OF SCOTTSBORO HAS HAD DIRECT, CONTINUOUS FINANCIAL DEALINGS WITHIN THE PAST DECADE.

A story about propaganda and, YOU MADE YOUR BED, NOW LAY IN IT! --- It is important to point out, once again, this is a dead issue regarding the taxation/revenue, which has not been properly dealt with within the County Commission. Before any diversion of the revenue may occur the Alabama Legislature must approve, the Legislative Delegation must be involved. The school bond issue involved an increase in "COUNTY SALES TAXES", those taxes are for school use only per legislative act. You have not adequately explained the details to the citizenry. Mr. Buckner and others, you are not placing forth a true picture until you work with the legislative delegation, not once did you mention the involvement of the State Legislature. The bottom line, you are not telling the full truth. The State Auditors already found a deficiency in your diversion of funds, which you had to pay back, remember that fiasco. If you are not aware of the auditors decision, best check on it. Mr. Porters comments about the Legislative Delegation and the school boards is an interesting problem. The bottom line is this, double talk, still no Legislative Delegation involvement. School gets money thru lawful acts delegating where tax money will be routed, now the commission wants the schools to give it back in part. M r. Venable and the commissions scheme sounds like a propaganda, diversion scheme. Venable continues with his propaganda in stating that he didn't know, not an excuse. Then you complain about the Google Tax Abatement, which you approved. Trade of Revenue vs Violation of State Law. AGAIN AND AGAIN, you must involve the Legislative Delegation, to include within your public discussion, at least a mention that you are working with them, if not, your discussions are a mute point and deceitful, unrealistic discussions. 10 years of the Jackson County Budget, including legislative issues:

When is a resignation effective?
Attorney Generals Opinion: 95-00182 Commission Chair Vacating Office - It appears, that once the governor accepts the resignation the vacancy may be filled. What is the bearing on Guffey's requested resignation date? To remain in office for 4 months once a resignation has been submitted and accepted by the County Commission, to receive pay, is that a conflict of interest, Guffey's self declaration, since there was no approval of administrative leave or medical leave by the Jackson county Commission.

The question is, has Governor Ivey accepted Guffey's resignation or not? If not, Guffey could come back, never mind his ripping the tax payers off of 4 months of pay for doing nothing. Do ethics not matter in the State of Alabama, does law not matter??

THE BIG QUESTION
Why doesn't Governor Ivey go ahead and appoint a new Chair of the Jackson County Commission?

 There have been Attorney Generals Opinions regarding this issue. Guffey has resigned, it is out of his hands. Because he is requesting a free ride on the tax payers dime for 4 months should not matter.
Appoint a new Chair of the Jackson County Commission Governor.

The citizen voters of Jackson County Alabama have a right to know the truth about this entire mess, which is getting worse due to the appearances of an active cover-up of the truth. To say an elected Chair of County Commission or an Elected County Commissioner doesn't have to show up to perform his or her sworn duties, because there is no law requiring such public officials to perform their sworn duties is preposterous and affront to our State and U.S. Constitution. Besides it is not true, we have criminal and ethics laws.

Todays Quote about Alabama County Commissioners from Mr. Venable: "There is no state law that requires a Chairman or Commissioner to attend a meeting. He is just not attending meetings" Referring to the alleged immediate resignation of Tim Guffey, Chair or Former Chair of the Jackson County Commission. What was the deal made? Was it to cover-up Sexual Harassment? Was it to cover-up the illegal placement of video surveillance equipment? Is there an investigation going forward?
