One lady related that a person had been placed on color code drug testing because a poor citizen did not have the money to pay for garbage collection in the county.
Allegations were made that Court Referral personnel had solicited for a "special treatment program" where clients would be placed into the program on Lookout Mountain when Court Referral personnel would be paid $1500.00. Allegations were also made regarding failed procedural/legal requirements in the security of urine specimen collection, transport and testing.

One of my Facebook friends, Kim Rice, ask me what do I think is the perfect solution to problems at CR/CC, Court Referral Community Corrections, below is my answer and my reply to her question on Facebook.
Thanks for asking Kim. A comprehensive Medical Treatment program with long term follow ups is a solution to substance abuse treatment. Perfect solution to a government structured program such as we have locally is not possible; however, there are solutions and programs in conjunction with courts and medical treatment that is better than the current local program.
1) Abolish the non-profit program, the current non-profit status is being abused to hide disclosures which would normally be available under a government sponsored program. Another solution would be to keep the non-profit program but actively recruit funders to provide 90-120 day inpatient treatment with a yearlong follow-up outpatient program. Cost share program - The substance abusers are currently paying for their testing, once released from inpatient care, which should continue.Government agencies, pharmaceutical, alcohol manufacturers and distributors should contribute to funding programs. So should a portion of law enforcement seizures.
3) Currently, our current drug testing programs available to CR/CC do not meet Federal Standards. Other words, the current local standards within the Jackson County Courts System do not meet the standards of employment law or DOT testing standards. The folks who fail drug testing may be incarcerated by a legal standard less than employment law or the standard lower than a Commercial Truck Driver drug test. That is wrong. Guidelines may be found at the Substance Abuse and Mental Health Services Administration (SAMHSA); there are no SAMHSA certified labs in the state of Alabama. https://www.samhsa.gov/workplace/drug-testing
The problem with what I am saying is money, money and more money. The current CR program diverts money from clients into the hands of attorneys, court system, managers of the CR/CC non-profit System. More money must be placed into treating the problem
medically long term, not enriching program managers, attorneys (which are not patient care providers), drug dealers and government War on Drug Agencies which have proven ineffective. Note this, what kind of medical treatment and follow-up could have been provided with the Trillion Dollars spent on the War on Drugs? Note 1) above.
Regardless of the comments of political, judicial or officials of Community Corrections/Court Referral there is no Federal Certified Laboratory for drug testing in Jackson County Alabama or the entire State of Alabama. There needs to be local improvements, drug abuse is a mental health care problem, more so than a legal problem. Mental health care funding in Alabama has decreased and Medicaid funding is not provided under the Affordable Care Act in Alabama.
In Jackson County Alabama, the acceptance of drug testing laboratories whose standards do not meet Federal Standards, and where the local legal standards do not meet the standards of employment law nor Department of Transportation requirements of drug testing is ridiculous and not supportive of a just legal system. This problem is simple to correct, there is no will to do so as it would mean following a set of just legal standards which insure a system of checks and balances not present currently regarding drug testing of those clients in the Court Referral system in Jackson County. The failure to require Court Referral clients testing positive to not be called in and informed of test results immediately when a positive test is demonstrated is a failure of due process. The failure to not have two sealed sample containers with urine as is the standard of practice is not only a failure of due process of law and a violation of standards of practice but an excuse to incarcerate without due process of law. To wait weeks, over a month, before notification after a known positive test result is ridiculous and demonstrates a failure of our legal system involving Court Referral. The bottom line - there needs to be improvement regarding drug abuse treatment and the organizations involved in drug testing in Jackson County Alabama.

Regarding Agenda Item 14, Community Corrections Court Referral
Scottsboro, Alabama November 13, 2017 Jackson County Commission Agenda Item 14 Motion to Discuss Community Corrections. Motion was made to go into an Executive Session to discuss Good Name and Character. "Incompetent . . . Incomplete" says, in part, requested report by Jackson County Commission referring to Community Corrections accountability. I was informed by a confidential source that Judge Holt was present prior to the Commission meeting to express alleged displeasure with agenda item 14, Community Corrections. Mr. Porter, County Attorney, was asked if Judge Holt was present during the Executive Session on agenda item 14, he stated "no comment."

UPDATE: Justice for Stacy - April 21, 2017 - The autopsy results for Stacy Sullivan have been released. The investigation is closed, because of concerns for the family, the cause of death and contributing factors will not be released by this writer.

On or about April 21, 2016 Ms. Stacy Sullivan's death is still unresolved due to dysfunctional state leadership which has failed to place sensible priorities on important law enforcement critical areas, specifically Forensic Sciences.

According to various news reports 18 year old Alex Davis, a Pisgah High School Student, was shot and killed by a Jackson County Sheriff's Deputy in Pisgah, Alabama on February 7, 2017 after responding to a "fight call" on County Road 60.
Al.com news reported the deputy responding found a man bleeding from "a hammer blow to the head." The responding officer attempted to subdue Davis by using non-lethal force via a "stun gun" to subdue Mr. Davis. WHNT-TV Huntsville, Al. News report stated - "According to the Sheriff’s Office, Davis came at the deputy with a board. The deputy asked him to stop repeatedly. He also tried to subdue the teenager with his stun gun twice. Investigators say Davis was able to regain strength and pull the electrodes off him to pursue the deputy again. (UPDATE) Chief Deputy Harnen stated to me in the phone conversation that the deputy involved in the shooting had expended all of his taser cartridges in the attempt to subdue Davis with non-lethal force.

Chief Deputy Harnen stated: The board displayed by the concerned relative in the below video is not the board which the suspect utilized to strike the auto or threaten the officer - "That board is in the possession of the ABI (Alabama Bureau of Investigation) as evidence. There were several boards in the yard area."
Chief Deputy Harnen also stated in regards to the video shown in the links: "The video displayed is not the entire video, there is more, hours." I asked, "how much of the video did you watch?" Chief Harnen's reply, "I watched about 30 minutes." Chief Harnen mentioned there were different angles. I asked: "Were there more than one camera?" His reply, "yes."

(Update} It is important to point out that the deputy was cleared of any wrong doing by the Alabama Law Enforcement Agency's investigations division. There has been no release of forensic information regarding toxicology testing of Mr. Davis.

"Downtown Scottsboro regrets to announce the postponement of Market on the Square on April 8th. We have been made aware of a planned protest to be held on The Courthouse Square on this same date. In an abundance of caution, we feel it is in the best interest of our vendors and our community to postpone Market until further notice. As soon as that date is determined, we will let everyone know.

Quite a few people had a comment about the cancellation of the Scottsboro Downtown Market event, including myself. Several postings were censored/removed.
My initial comment to questions regarding permits for a protest - Answer to the question asked: "There is no requirement to have a permit to protest. I have discussed the right of protest with county and city public officials and protested on the square and in front of city hall regarding political issues. Here are some basic rules. 1) Protesters may not be armed; 2) Protestors may protest on public property but may not interfere with the rights of others as to egress or regress into or out of buildings or obstruct the flow of traffic. 3) Protesting does not mean inciting riots or facilitating violence. 4) Communications of threats is against the law. 5) Laws apply anywhere including a protest, it is not against the law to express speech. The cancellation of the market is typical of those who have a right wing agenda facilitating fear regarding the rights of citizens. To say protestors will be violent is a ridiculous, assuming statement. The protesters have achieved one of their goals, bring attention to what they believe is a problem. The smart thing to do would have been to hold the market and have the Sheriff and a representative of the DA's office present to discuss the situation with the protestors and hold a press conference. Act smart, not ridiculous by demonstrating fear to our nations most time honored traditions."
It was also revealed that the Sheriff's Department had not been contacted by the Downtown Scottsboro group to determine if there was a security problem or to ascertain the Sheriffs thoughts about security.

Drug Testing Program Management, DTPM, is connected with Jackson Community Corrections and Court Referral (associated with Jackson County Courts, the State of Alabama's Office of Courts and Alabama Department Corrections).
Their owner and at least one of their executive staff are board members of the Jackson County Court Referral and Community Corrections organization. A NON-accountable corporate courts' organization in Jackson County. But lets not confuse issues of making money with issues of helping people with substance abuse problems, maximum sarcasm intended.

DTPM does not meet the requirements of the Substance Abuse and Mental Health Administration, SAMHSA, for a certified drug testing facility. Nor do they meet the Code of Alabama (COA) requirements for employee drug testing, COA - 25-5-335. But, that does not stop their Elvis impersonations, or sending off confirmations with no seal/no double sample testing methodology, or greater than 5 day old samples. Can you say, improper chain of custody? UPDATE - August 25, 2020 - More info on testing protocol and certification requirements in Alabama. More evidence of a racket of extortion on the poor, but benefiting corporate entities and their owners, NOT PEOPLE.
Clinical Laboratories in Alabama which test human bodily fluid specimens have certification requirements. These requirements are outlined in the Alabama Department of Public Health Rules (ADPH), Chapter 420-5-8, and is administrative law in Alabama. The requirements became health law in November 1975 and have been updated many times, with the last update July 2014. Link: https://www.alabamapublichealth.gov/providerstandards/assets/ICLIPL714.pdf My inquiries reveal DTPM does not meet the requirements of a clinical laboratory testing human bodily fluid specimens FYI -. These issues have recently came to light as DTPM is testing for Covid-19 per contract from Highlands Medical Center, Jackson County Health Care Authority. This was discovered after interviews with Highlands Medical Center laboratory staff.

Drug testing falls under the Department of Mental Health who are not qualified, not properly funded, nor able to properly certify actual clinical laboratories, however they do so anyways. This exemption points to a high level of corruption initiated politically for financial gain of those profiting from the medical conditions of substance abusers. In my opinion, to exempt these clinical laboratories from certification requirements of the ADPH, due to their performing drug tests, is unprofessional, facilitates malpractice and is indicative of a corporate fascist culture supporting money before the health of human beings. The care of patients suffering from substance abuse must involve medical treatment instead of fostering a culture of money before human health. That is not saying courts should not be involved due to criminal behavior, I am saying that the medical condition of substance abusers must be placed before a corporate justice and prison system to insure a person who has a drug problem receives the necessary treatment and returns to society to be a productive member of the community.

The "war on drugs" is about money, not people's health. Money to support a non-accountable drug court system, attorneys, court referral entities with a continuous stream of offenders - regardless of accuracy or truthfulness of test results; money to support the corporate court system and the skulduggery it brings as demonstrated by the below photos.

The War on Drugs Cost - It is about the money, not ending the problem of substance abuse. Facts demonstrate the war on drugs has killed more people than drugs and resulted in an increase in organized crime. UPDATE: Jan 5, 2015 - I had received a call from a local concerned citizen about a County Commissioner, Mr. Stacey Ledwell, who is also a business owner, Mr. Rooter, a local plumbing service. Mr. Ledwell had sold a backhoe to the Cumberland Mountain Water Authority via a sealed bid process.
I had discussed the concern with Mr. Ledwell last week and he assured me everything was accomplished in accordance with the law. Yesterday, prior to the County Commission meeting, Mr. Ledwell provided me with his bid submission document, attached below, and an Attorney General's Opinion regarding The Cumberland Mountain Water Authority's opening a bidding process for a backhoe. The invitation for bid was published in the November 25th 2015 edition of the Daily Sentinel on page 9 as an Invitation by The Cumberland Mountain Water Authority - "Taking Sealed Bids." Mr. Ledwell's bid entered via the sealed bid process, as indicated, was $42,000.00 which was the low bid which met bidding specifications.
Commissioner Ledwell's transparency about this issue is commendable and is appreciated that he provided the documents which demonstrates his concern for doing what is right regarding open, transparent government. I do not think there is any conflict of interest as the Cumberland Mountain Water Authority is a separate corporate entity of Jackson County who has a separate Board of Directors managing the affairs of the water authority.

More on the continuing issue of the Jackson County Community Corrections and Court Referral, video and significant violations of policies, conflicts of interest and evidence of Failed Quality Assurances Programs regarding Community Corrections and Court Referral drug testing protocols and documents submitted to the District Attorney for a Motion before the Jackson County Courts.
Policy Regarding Drug Testing
Documents acquired via County Commission Documents Request previously refused by Community Corrections and Court Referral.
This policy indicates that the testing may be challenged by requesting a confirmation test be performed if the client/defendant requests the test. This would mean that the agency would have to notify the client/defendant if there was a positive test. There are instances where one or more client(s)/defendant(s) were never notified of a positive test or given the opportunity to challenge erroneous information which resulted in cancellation of probation after a months worth of Amended Motions and errors. Errors which were based on erroneous entries or false information as stated on motion documents before the court. This also demonstrates a failed Quality Assurance Program to insure there are no erroneous tests, scheduling errors, or violations of policies-standards and protocols resulting in problematic/erroneous court document entries.

This policy states, "...agents representing the Board will have no financial interest direct or indirect which would conflict with services to the Board..." The Executive Director receives lease payments on the Community Corrections property which he owns, he benefits from his position as property owner as the Executive Director of the non-profit corporation. At least two Board member's profit from their vote or participation in decision making on the Board as they are executives and/or owner in the drug testing company and counseling service non profit organization.
Court Referral - Community Corrections, quote: December 15, 2015, 23 comments - "Jackson County Court Referral and Community Corrections Also. This is my page. I made this page for the convenience of my clients so that they would not have to call the number and getting a busy signal. If it becomes a page of a lot of negative comments, I will shut it down. Thank you." This may be described as misconduct, per their personnel handbook guidelines as it brings discredit on the organization.

Handbook will cover this employees misconduct, "refraining from offensive and undesirable conduct which is not in the best interests of the organization."

Local insanity - the war on drugs takes on new meaning.
Court Referral and Community Corrections is needed, but it must be controlled as a government organization and never allowed to be formed into a non-profit, non-accountable organization with no oversight.
Organized crime in our local judicial system? False statements, false accusations, false motions - how many judgments have been based on false claims? The entire judicial system where Community Corrections and Court Referral has been involved, should face an intensive forensic audit.
Oversight is needed and this bastard court non-profit corporation must end. This non-profit judicial organization claims to be just like the First Baptist Church, their records are not subject to public inspection.

Motion containing false information from the district Attorney's Office - The Defendants color, which was "watermelon" was not called on the day stated, the methadone accusation is false.. The false accusation is based on a false statement from the Court Referral Community Corrections office, but this isn't the only false statement on a court document which has been demonstrated as false.
SUMMARY
There must be changes to the Jackson County Court Referral and Community Corrections program, oversight is a must. Never should there be false information provided to the District Attorney’s Office from Court Referral and Community Corrections, which has occurred.
Per the Code of Alabama, the Community Corrections and Court Referral System should be a county government managed organization with oversight under the laws of the State of Alabama; currently there is no oversight for this cash only operation. With no audits on file with the Alabama Department of Public Examiners since 2003 (Clarion article - http://www.theclarion.org/index.php?option=com_content&view=article&id=9605:commission-requests-application-from-court-referral-&catid=42:clarion-rotation-stories&Itemid=142 ) the opportunity for corruption and misappropriation exists. Has misappropriation and corruption occurred - in my opinion YES. To demonstrate how it has occurred all one must do is look and read the IRS 990 form regarding Community Corrections 2013 filing and conflicts which exist with its director(s) and board membership. Board membership are in part the directors of the drug testing program, a business entity, and drug counseling programs, another non-profit entity receiving cash from those ordered to attend counseling from Community Corrections and Court Referral; other words, the non-profit Directors sitting on the Community Corrections Board profit from the contracts with drug testing and counseling services, they are the same people.
