JAMES MADISON QUOTE - 1822

"A popular government without popular information, or the means of acquiring it, is but a Prologue to a Farce or a Tragedy; or, perhaps both. Knowledge will forever govern ignorance; and a people who mean to be their own governors must arm themselves with the power knowledge gives."

U.S DISTRICT COURT UPDATES

Side Bar - Don't fall for the "Trick Zombie."
My Thoughts - Don't count on Bellefonte Nuclear Facility being dead. The reason Nuclear Development, LLC lost their case regarding the purchase of the nuclear facility was due to the requirements to have a comprehensive Quality Assurance Plan required by law and monitored by the NRC. Cancellation of the NRC construction license opens the sale up without the restrictions of NRC oversight as required by law, as stated in the court documents. This may free up the sale of Bellefonte to Haney or another buyer without the oversight of the Nuclear Regulatory Commission (NRC). However, if nuclear construction is to be renewed the NRC licensing and oversight process would begin, and the licensing process has changed from the old process.

The opportunity exists for sustainable energy projects such as large scale solar, run of the river power generation and other hydro projects such as pumped storage generation.

UPDATE - September 2, 2021 - TVA's Notice to the Court - (1) The construction permits issued by the Nuclear Regulatory Commission (“NRC”) for Units 1 and 2 at the Bellefonte site expire on October 1, 2021. . . (2) TVA sent a letter on August 31, 2021, requesting that the expiration date of the Bellefonte construction permits be extended. (3) TVA intends to inform the NRC on or after September 10, 2021, that as a result of the Court’s Final Judgment, TVA is withdrawing its request for extension of the expiration date of those permits.

UPDATE FINAL JUDGEMENT
August 26, 2021 - "(1) Judgment is entered in favor of the Tennessee Valley Authority on Counts One, Two, and Three of the Amended Complaint. (2) Purchase and Sales Agreement, judgment is entered in favor of Nuclear Development in the amount of $22,950,000, plus prejudgment interest at a rate of 7.5% per annum, running from December 30, 2018 to the date of this final judgment."   https://storage.courtlistener.com/recap/gov.uscourts.alnd.168540/go  v.uscourts.alnd.168540.247.0_1.pdf

UPDATE - June 9, 2021 - TVA claims Nuclear Development LLC, ND, attempting to 'stick' TVA ratepayers with "Luxury Jet" and "Luxury Limousine," described as "luxury travel services" for Haney and guests travel around his home town, including locations and people not associated with legitimate business expenses. UPDATE - JUNE 1, 2021 - March 31, 2021 Order of the UNITED STATES DISTRICT COURT NORTHERN DISTRICT OF ALABAMA NORTHEASTERN DIVISION Case No.: 5:18-cv-1983-LCB - THE BELLEFONTE NUCLEAR POWER PLANT, UNITS 1 AND 2 Link to court document, of note are the numerous redactions depriving the public of the judiciary process relevant to the safety of the Bellefonte Nuclear Facility:   https://storage.courtlistener.com/recap/gov.uscourts.alnd.168540/gov.uscourts.alnd.168540.161.0.pdf

Note Pages 51 thru 55 in this document, Referring to the loss of Quality Assurance due to cannibalization of the facility after surrender of the Construction License - quote: "[Quality Assurance] Requirements are not optional . . . 10 CFR 50.54(a), “Conditions of Licenses,” and 10 CFR 50.55(f), “Conditions of Construction Permits,” which require that a quality assurance program be implemented; 10 CFR Part 50, Appendix B, which requires that all activities performed to establish, maintain, and verify the quality of plant construction be addressed in the licensee's quality assurance program; 10 CFR Part 50, Appendices A and B, which require that certain quality records be retained for the life of the plant; 10 CFR 50.55(e), which requires reporting of deficiencies in design, construction, quality assurance, etc.; 10 CFR 50.71, which applies to the maintenance of records; and 10 CFR Part 21, which applies to reporting of defects and noncompliance. Those NRC regulatory guides that endorse the ANSI N45.2 series of standards, “Quality Assurance Requirements for Nuclear Power Plants,” also are applicable and include Regulatory Guides 1.28, 1.37, 1.38, 1.58, 1.88, and 1.116."
"Because the transfer of the Bellefonte site without NRC approval would have been unlawful under Section 101 of the Atomic Energy Act, the closing condition set forth in Section 6(a)(v) was not satisfied, and Nuclear Development’s motion for summary judgment is denied."

It is of interest to note in the latest filing on April 7, 2021 by Nuclear Development LLC (ND) maintains the Court Erred, of course they do. It appears ND is grasping for elusive straws.

UPDATE: NOTE ITEM 51 at this link regarding Quality Assurance. TVA can't satisfy Quality Assurance as the nuclear reactor under construction had it's construction license terminated per request of the owner, TVA. All Quality Assurance ceased when Units 1 & 2 were stripped and cannibalized of critical parts and systems with large holes cut into the facilities to remove components as described in ITEMs 3 thru 8, describing parts removed and the non-operable condition of the plant. Thus, ITEM 51 is misleading and not accurate as Quality Assurance was terminated and cannot be satisfied in accordance with law and regulatory purpose during the period of the termination of the NRC license to construct, 2005 thru 2007.

NRC Senior Project Manager Joseph Williams also identified these very same broad quality assurance weaknesses in reinstating the construction permits for Bellefonte Units 1 and 2. In his analysis Williams said, ". . . it is apparent that the facility has not been preserved in the same state it was when the construction permits were terminated. As noted, these activities were not conducted in a manner consistent with NRC regulations."

Published accounts show that members of TVA’s own staff questioned the foolishness of stripping the Bellefonte Units of their valuable nuclear components and leaving the plant open to natural environmental degradation.  Quote Regarding the Bellefonte Nuclear Plant Cannibalization: "Dr. Bob Doggart, a former senior engineering specialist at TVA who now serves as the managing lead assessor for the British Institute of Nondestructive Testing LLC said. “To allow outsiders to come in and remove key equipment for virtually nothing was unbelievably foolish.” Chattanooga Times Free Press on March 29, 2009"

In summary - Mr. Gunderson, a nuclear engineer and former nuclear power executive, describes 21 important points in his sworn testimony of why the Bellefonte Nuclear Facility construction permit is faulty and problematic as to violations of law and policy regarding construction and operations of the Bellefonte Nuclear facility, pages 2-14 in the report linked above, which includes testimony of the NRC own experts revealing critical faults regarding Bellefonte Nuclear Operations.

TVA later reversed that decision but then ultimately gave up on any of its plans for Bellefonte as demand for additional electricity has stagnated in the Tennessee Valley. Critics of the Bellefonte plant contend that the integrity of the plant safety systems was jeopardized when steam generators and other equipment was removed. . .We don't believe that Bellefonte could ever meet the safety standards that the NRC would require because it was put outside of the nuclear quality and assurance standards and we've seen no credible program to bring it back into those requirements," said Stephen Smith, executive director of the Southern Alliance for Clean Energy, which has long opposed the completion of Bellefonte.""

NRC Open House Public Meeting for the 2016 Performance Evaluation at Calhoun College's Aerospace Center near Tanner, Alabama May 3, 2017 from 6PM to 7PM.

NRC ANNOUNCEMENT ON TVA's BROWNS FERRY NUCLEAR FACILITY (in part)

Under the NRC’s Reactor Oversight Process, the agency assesses plant performance through the use of color-coded inspection findings and performance indicators, which are statistical measurements of plant performance that can trigger additional oversight if exceeded. Any inspection findings or performance indicators that are greater than green (very low safety significance) trigger increased NRC oversight. Routine inspections are performed by resident inspectors assigned to the plant. Reviews are also carried out at the sites by specialist inspectors assigned to the agency’s Region II office in Atlanta. The annual assessment letter for Browns Ferry, as well as the notice for the meeting, are available on the NRC website. Current performance information for Unit 1, Unit 2 and Unit 3 is also available.

TVA Watts Bar Nuclear Plant - A Chilled Work Environment - Failed Safety Culture or NRC Lip Service? UPDATE - November 10, 2016 Falsification and Destruction of Fire Watch Records at Watts Bar Nuclear Plant - NRC Says Low Severity? Retaliation??

TVA, Tennessee Valley Authority, has boasted about the first new nuke plant in many a year. Actually it isn't new and it cost about 7 billion dollars to complete over 43 years. There are other costs, a "chilled work environment," contributing factor, STRESS to get the plant on line. The question - has safety been compromised? Photo by TVA - Fair Use for non-profit news reporting and commentary.

UPDATE - NOVEMBER 10, 2016
FALSIFICATION OF RECORDS, NRC SAYS LOW SIGNIFICANCE?? WATTS BAR NUCLEAR PLANT - NRC INTEGRATED INSPECTION REPORT 05000390/2016003, 05000391/2016003 AND NOTICE OF VIOLATION AND OI REPORT NUMBER OI-2-2015-039
ADAMS Accession No. ML16315A344 (It will take a few days for this document to be posted on the NRC's info library.) ADAMS Reference link: http://adams.nrc.gov/wba/  or http://www.nrc.gov/reading-rm/doc-collections/
Document Date: November 10, 2016
This report released today after the "Chilled Effects" meeting last Thursday, Nov. 3, 2016 regarding the Watts Bar Nuclear Plant. Low significance?? Notice of Violation for willfully falsifying Fire Watch Records and destroying said records.  There may have been retaliation by a contractor involved in this incident regarding an employee refusing to sign a falsified report.

Quote: "Severity Level IV. The NRC identified a Severity Level IV violation of 10 CFR 50.9 "Completeness and Accuracy of Information," for the failure to maintain continuous compensatory fire watch information that was complete and accurate in all material respects. The licensee’s actions of creating falsified fire watch completion records...(from page 6 under Findings) "According to the testimony received by the NRC OI, on the morning of April 28, 2015, the licensee contract fire watch foreman attempted to persuade four fire watch laborers to sign fire watch records indicating that they performed the missed fire watch from the day before. Three of the individuals each signed the fire watch turnover records. However, one fire watch laborer refused to sign the fire watch turnover records. A meeting was held with the contract fire watch foreman, the contract fire protection specialist, and the TVA fire protection foreman. When it became clear that one individual would not sign the fire watch turnover record, the contract fire watch foreman disposed of the paperwork. The missed fire watch was reported to management, prompting investigations about the root causes of the missed fire watch. The licensee initiated condition report 1019953. The falsified fire watch record was never recovered."

The NRC fined TVA $70K for falsifying Fire Watch Records at the Sequoyah Nuclear Plant, op-ed from Pam Sohn back in April of this year.

The Nuclear Regulatory Commission, NRC, March 23, 2016
NRC to TVA
As discussed during the public meeting held on March 22, 2016 in the RII office(ML16083A403), we initiated a review in late 2015 at the Watts Bar Nuclear Plant into the environment for raising and addressing safety issues. We began this review in light of information received through our inspection and allegations process associated with the Safety Conscious Work Environment (SCWE) within the Operations Department and its influence onthe safe operation of the plant. Our review includes information received through allegations, inspections, and interviews of your staff over the past few months. The Nuclear Regulatory Commission, NRC, has concluded that a Chilled Work Environment exists in the Operations Department because of a perception that operators are not free to raise safety concerns using all available avenues without fear of retaliation. We have not identified any serious safety violations or instances involving significant plant safety issues, but the information gathered has led to concerns about the impact the work environment is having on plant operations raises
questions about your commitment to emphasize safety over competing goals to ensure protection of people and the environment. We want to ensure that TVA has a clear understanding of the scope of our concerns and to communicate specific requests and expectations for your response.

The Safety Culture Policy Statement (76 FR 34773; June 14, 2011) sets forth the Commission's expectation that licensees establish and maintain a positive safety culture commensurate with the safety and security significance of their activities and the nature and complexity of their organizations and functions. The NRC defines nuclear safety culture as the core values and behaviors resulting from a collective commitment by leaders and individuals to emphasize safety over competing goals to ensure protection of people and the environment. A safety conscious work environment is defined by the NRC as an environment in which “employees feel free to raise safety concerns, both to their management and to the NRC, without fear of retaliation” and is one trait of a strong safety culture. NRC Regulatory Issue Summary 05-018, “Guidance for Establishing and Maintaining a Safety Conscious Work Environment,” dated August 25, 2005, further describes the NRC’s expectations in this area. More on this letter: http://www.nrc.gov/docs/ML1608/ML16083A479.pdf

The Problem With The Regulator, NRC, and the Nuclear Industry
Failures of nuclear safety culture are not enforceable actions. Comprehensive report on Safety Culture:
"Nuclear professionals, members of the public, Congress, Non-Government Organizations (NGOs), and concerned non-industry stakeholders agree on one issue: nuclear plant safety is paramount and must be the number one priority. However, the actions, and inactions, of the Nuclear Regulatory Commission (NRC), Nuclear Energy Institute (NEI), and nuclear plant owners, have led to financial considerations taking priority over nuclear safety. The current focus on nuclear safety via what the industry and its regulator call “safety culture,” unless redefined and clarified, is a dead end. To truly achieve nuclear safety, “regulatory compliance and enforcement ” must be the frame used to gauge Nuclear Safety Culture." Paul Blanch (PE) Energy Consultant, author of the linked report.

Part 1 Selected Citizen Comments - The NRC would not disclose any retaliation events or occurrences. An employee states she has witnessed retaliation in the work place and discriminatory activity. Union of Concerned Scientists - SMR's will not resolve cost, safety and security problems
WASHINGTON (September 26, 2013)—Nuclear power proponents pinning their hopes on small modular nuclear reactors to resurrect the industry’s fortunes will likely be disappointed, according to a report released today by the Union of Concerned Scientists (UCS). The report, Small Isn’t Always Beautiful, concludes it will be extremely difficult for small reactors—which are less than a third the size of a standard 1,000-megawatt nuclear reactor—to generate less expensive electricity and, at the same time, be safer than their larger cousins.

“Nuclear safety and security don’t come cheap,” said UCS Senior Scientist Edwin Lyman, the author of the report. “A utility that thinks it can have its own little nuclear reactor at a bargain-basement price may get exactly what it pays for: a plant more vulnerable to serious accidents and terrorist attacks.” http://www.ucsusa.org/news/press_release/small-modular-nuclear-reactor-0404.html#.VxFoPZX2bIV

BREDL/BEST/MATRR
On April 12 from 1 p.m. to 4 p.m. members of the Bellefonte Efficiency and Sustainability Team/Mothers Against Tennessee River Radiation (BEST/MATRR), a local chapter of the Blue Ridge Environmental Defense League (BREDL) attended the open house and information session. We conducted interviews with TVA Clinch River Project Manager, Dan Stout, and the Attorney with the Tennessee Sierra Club, Brian Paddock. The information session was held at the Pollard Center on the campus of Oak Ridge Associated Universities, Oak Ridge Tennessee.

NRC - Tennessee Valley Authority Clinch River Site Early Site Permit Application
Tennessee Valley Authority (TVA) intends to submit an Early Site Permit Application (ESPA) for two or more small modular reactor (SMR) modules (up to 800 MWe, 2420 MWt) at the Clinch River Nuclear (CRN) site to the NRC for review in the second quarter of NRC fiscal year (FY) 2016 (first quarter of calendar year (CY) 2016). The application will use the Plant Parameter Envelope (PPE) approach, by which an applicant provides sufficient bounding parameters and characteristics of the reactor or reactors, and the associated facilities, so that assessments of site safety and environmental suitability can be made by NRC.

Complaint to the Nuclear Regulatory Commission OIG for violation of the Federal Sunshine in Government Act.
The NRC held a separate meeting for public officials at 9AM on April 12, 2016. This separate meeting makes no sense, since the only information to be presented is allegedly public information. The separate meeting effectively isolates public officials from the public. The NRC General counsel has confirmed receipt of this complaint.

COMPLAINT TEXT
NRC OIG Complaint – 4-8-16
Subject: Separate Meeting for public officials Regarding SMR Project.
From: Garry Morgan, Scottsboro, Alabama

Violation of Government in the Sunshine Act Pub.L. 94–409, 90 Stat. 1241, 5 U.S.C. § 552b - Regarding holding a separate meeting, secret meeting, with local public officials, outside of a public meetings scheduled on April 12, 2016 - Reference NRC Public Affairs Notice 16-016, regarding Small Modular Reactors at the Clinch River Site near Oak Ridge, Tn. There is no mention of the separate secret meeting in the official notice with public officials which is scheduled on 4-12-16 at 9AM, location Hilton Hotel or Pollard Auditorium, per "un-named" (names redacted, confirmed from 2 separate officials) NRC Officials.

Although this is not a deliberation of the Nuclear Regulatory Commission it is a Public Meeting as scheduled and there will be many different public officials from various public entities attending this secret meeting for public officials which is allegedly to discuss the same information to be presented at the afternoon and evening public meetings in the described NRC meeting announcement.

Why a secret meeting prior to the regularly scheduled meeting? Could it be there are site problems or other problems which the DOE, NRC, TVA does not want the public to know about? Are there secret site plans which federal and local officials will consider which the various federal agencies involved do not want the public atlarge to be aware? Surely all involved want to hear public comments - why would a federal agency move to isolate public officials from the public? Is there a need for secrecy involving what should be public information?

The legislative intent of the Sunshine Act is as follows: "The basic premise of the sunshine legislation is that, in the words of federalist No. 49, 'the people are the only legitimate foundation of power, and it is from them that the constitutional charter ... is derived.' Government is and should be the servant of the people, and it should be fully accountable to them for the actions which it supposedly takes on their behalf." (U.S.C.C.A.N. 2183, 2186).

The NRC's intentional isolation of various government officials from the public in a separate meeting violates the very spirit and intent of the United States of America's Federal Sunshine in Government Act. Many items discussed in these public meetings will be deliberated on at a later date in various governmental entities.

It is vitally important that all government officials hear all public input, not just the input from federal officials and contractors connected with the Small Modular Reactor Projects. Holding a separate public officials meeting isolates public officials from the electorate, taxpayers and ratepayers, the stakeholders which the NRC are supposed to protect.

Isolation of public officials from the public in a separate secret meeting for public officials does not facilitate open government as described in the Federal Sunshine Act and does not display
your role as the regulator in a positive light, the isolation of public officials by holding a separate meeting for public officials violates the intent of the Federal Sunshine Act.

I am asking the NRC OIG to initiate action to stop any separate meeting which isolates public officials from the public in NRC Public Meetings.

The Nuclear Zombie - NRC- ASLB Hearing on TVA 's Bellefonte Units 3 & 4 Docket 52-014COL & 52-015COL, near Scottsboro, Alabama

The Nuclear Zombie by Edwin Vazquez - Fair Use Rights for Non-Profit News Reporting
The Bellefonte Facility is the Nuclear Zombie - It feeds on your money.

TVA Annual Financial Statement 10K Sep 30, 2015

(TVA Sep 2015 10K page 83 & beyond)TVA's Assets are listed as $48.825 billion; Cash flow of $300 million; TVA's Liabilities, includes long term debt, are listed at $48.825; TVA's Long term debt interest is $22.792; TVA's short term debt is $1.099 billion; TVA's VIE debt $1.328 billion; TVA Pension shortage is $6.027 billion.

The bottom line of TVA is this: Assets are near >>$49 billion, liabilities are near >>$80 billion, ten year trend indicates increasing liabilities. Only a complete fool would think TVA can afford Bellefonte 3&4. It is questionable if they can afford Bellefonte 1&2.

Currently, out to 20 years, TVA admits there is no power need for Bellefonte 1&2. Considering the financial situation of TVA and the estimated costs of a Bellefonte 3&4 which is currently running $10-$15 billion in todays dollars per unit. 30 years out, construction time if Bellefonte 3-4 began 10 years out, the cost would be at least 50% to 75% higher bringing the costs conservatively to $15 to $22 billion per unit.

Nuclear decommissioning fund listed on page 137 is $700 million short by TVA's estimate.  TVA's balance on their decommissioning fund is $1.5 billion; the actual cost of decommissioning 1 nuclear plant would exceed $700 million by todays cost estimates and may run as high as $1 billion, decommissioning is not counted in the above figures.

TVA cannot afford BFN 3&4, nor is there a power need at this time out to 2033,  TVA IRP https://www.tva.gov/file_source/TVA/Site%20Content/Environment/Environmental%20Stewardship/IRP/Documents/2015_irp.pdf  . To continue this charade wastes everyone's time, efforts and valuable financial assets. The COL for BFN 3&4 should be immediately terminated.
