Local Municipal Court

Citizens must ask the question, why did Scottsboro and other municipalities in Alabama, cancel their contract with Judicial Corrections Services, JCS? Why would our local courts facilitate Racketeering?  JCS, and municipalities utilizing their services, are being sued by the Southern Poverty Law Center, SPLC, for allegations of Racketeering (RICO). SPLC alleges in their suit that JCS and municipalities utilizing JCS services have enabled a criminal enterprise specifically pointed at defendants that are poor and cannot afford an attorney. I have interviewed several defendants locally who faced prosecution in municipal courts. All the defendants interviewed are living under the poverty level and stated they could not afford an attorney. I asked each person interviewed: “What plea did you enter before the court?” All told me they were not allowed to enter a plea as they were not asked for a plea. The scenario goes like this: Defendant is taken to a back room by unknown parties, told to sign documents paying for court costs, charges will be dropped, pay court costs and go to JCS to pay the costs. They are given 2 documents, one from the court and another from JCS. The documents samples are pictured below, names and dates have been redacted to protect people’s privacy.

I’m not saying defendants are innocent or guilty, I am questioning what appears to be a violation of trust relating to judicial actions at the municipal level.  It’s the old story, 2 wrongs never make a right; someone must ask the question, who will correct what appears to be illegal activity of municipal courts? An independent investigation should be conducted to determine if local judicial procedures violate rights of the defendants and to answer the question, are local courts violating law?

Jackson County Discretionary Fund Committee Meeting, February 3, 2014 or "Mak'em Beg" for Adequate Funding

The distribution methodology is being challenged as an unconstitutional act. Meanwhile, after several years of a secretive deliberative process, the Legislators opened the deliberative process to public scrutiny and placed 2 Jackson County Commission members on the committee.

Meanwhile the Delegation & Discretionary Committee authorized $225,000 for their office space while saying no or delaying funding for computers for schools, nursing funding and Sheriff's computers for vehicles which very well may be life saving regarding criminal and-or warrants information.

Election to Watch, Senate District 8

The Barron(D)--McGill(R) election for District 8 Alabama Senate will be the election to watch come November. Will the Tea Party organization and Jackson County Patriots, both Republican organized, make a difference in the upcoming November election?

Jackson County has been a traditional ultraconservative Democrat bastion. The political attacks pointed at President Obama via Fox News and other Republican Party mouthpieces are effective. The Democrats have done a terrible job countering the attacks of the Tea Party/ Republican Party propaganda mouthpieces. The Democrat counter arguments have been fractionalized and noneffective. The Democrats lack luster counter arguments concerning protecting the conservative wing, Blue Dogs, (Senator Barron) will be costly this November. I think the District 8 election will be separated by less than 500 votes.

What is interesting to note is the necessary numbers to win an election. The magic figure is 17,400, less than 2500 votes separated Barron and Stout in the last election. With less than 60 days out from the election I've seen Shad McGill ads on TV, his wife and children made a showing at the Labor Day First Monday event, not much visibility from Senator Barron at this point.

Alabama's Republican Candidate for Governor, Robert Bentley's Weak Point

Does the Republican candidate for governor, Robert Bentley, support antiquated Separate but Equal, does he support abolishing the Civil Rights Act? I have asked him and his campaign, he refuses an answer.

SOVEREIGNTY RESOLUTION/SECESSION or RACIST ALABAMA LEGISLATURE ATTEMPTS REPEAL OF CIVIL RIGHTS ACT

President Johnson signs Civil Rights Act, hands pen to Dr. Martin Luther King, Jr. Senate Joint Resolution (SJR) 27 attempts to invalidate the Civil Rights Act and other Federal Law.

SJR 27 attempts to overturn years of work and sacrifice by the Civil Rights Movement. SJR 27 is sponsored by whites who support repeal of Federal Legislation designed to prevent Racial discrimination. These racist politicians and extremists are attempting to deceive the citizens of the state.

The Alabama Senate passed Senate Joint Resolution 27 which was introduced by Alabama State Senator Beason along with nine co-sponsors. This Resolution is nothing more than an attempt at legalized racism by right wing extremists.

This resolution suggests repeal of the Civil Rights Act and other Federal Laws in Alabama. Quote: "BE IT FURTHER RESOLVED, That all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or requires states to pass legislation or lose federal funding be prohibited or repealed."

The U.S. Government is not an agent of the seperate states, as stated in the resolution: "WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states." If this were true, the Supreme Court would have no power over the laws of the several states in declaring a state, or local law unconstitutional and void. It appears the legislators who support this resolution should brush up on the relationships of the State and Federal Government.

We are not living in the mid 19th century or the Jim Crow era of Alabama which some seem to think. We have made many advancements in race relations and technology. Unfortunately there are those who have not advanced and seem to relish the ideologies of Jim Crow opression and eliminate advancements and sacrifices of many brave Americans.

This worthless resolution, SJR 27, is the result of right wing extremist expressing their bigoted ideology due to a Black President being elected to office. Where was this outrage when white Presidents and Legislative Authority were accomplishing the same so called repulsive acts?

WHEREAS, the Tenth Amendment to the Constitution of the United States reads as follows: "The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people"; and

WHEREAS, the Tenth Amendment defines the total scope of federal power as being that specifically granted by the Constitution of the United States and no more; and

WHEREAS, Federalism is the constitutional division of powers between the national and state governments and is widely regarded as one of America's most valuable contributions to political science; and

WHEREAS, James Madison, "the Father of the Constitution," said, "The powers delegated to the federal government are few and defined. Those which are to remain in the state governments are numerous and indefinite. The former will be exercised principally on external objects, [such] as war, peace, negotiation, and foreign commerce. The powers reserved to the several states will extend to all the objects which, in the ordinary course of affairs, concern the lives, liberties, and properties of the people."; and

WHEREAS, Thomas Jefferson emphasized that the states are not "subordinate" to the national government, but rather the two are "coordinate departments of one simple and integral whole. The one is the domestic, the other the foreign branch of the same government."; and

WHEREAS, Alexander Hamilton expressed his hope that "the people will always take care to preserve the constitutional equilibrium between the general and the state governments." He believed that "this balance between the national and state governments forms a double security to the people. If one [government] encroaches on their rights, they will find a powerful protection in the other. Indeed, they will both be prevented from over passing their constitutional limits by [the] certain rival ship which will ever subsist between them."; and

WHEREAS, the scope of power defined by the Tenth Amendment means that the federal government was created by the states specifically to be an agent of the states; and

WHEREAS, today, in 2009 (2010?), the states are demonstrably treated as agents of the federal government; and

WHEREAS, many federal laws are directly in violation of the Tenth Amendment to the Constitution of the United States; and

WHEREAS, the Tenth Amendment assures that we, the people of the United States of America and each sovereign state in the Union of States, now have, and have always had, rights the federal government may not usurp; and

WHEREAS, Article IV, Section 4, United States Constitution, says in part, "The United States shall guarantee to every State in this Union a Republican Form of Government", and the Ninth Amendment states that "The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people"; and

WHEREAS, the United States Supreme Court has ruled in New York v. United States, 112 S. Ct. 2408 (1992), that Congress may not simply commandeer the legislative and regulatory processes of the states; and

WHEREAS, a number of proposals from previous administrations and some now pending from the present administration and from Congress may further violate the Constitution of the United States; now therefore,

BE IT RESOLVED BY THE LEGISLATURE OF ALABAMA, BOTH HOUSES THEREOF CONCURRING, That the State of Alabama hereby claims sovereignty under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.

BE IT FURTHER RESOLVED, That this resolution serves as notice and demand to the federal government, as our agent, to cease and desist, effective immediately, mandates that are beyond the scope of these constitutionally delegated powers.

BE IT FURTHER RESOLVED, That all compulsory federal legislation that directs states to comply under threat of civil or criminal penalties or sanctions or requires states to pass legislation or lose federal funding be prohibited or repealed.

BE IT FURTHER RESOLVED, That a copy of this resolution be forwarded to the President of the United States, the President of the United States Senate, the Speaker of the United States House of Representatives, the Speaker of the House and the President of the Senate of each state's legislature, and the entire delegation of the Alabama members of the U.S. Congress.

Fortunately this legislation carries no weight of law but expresses a right wing extremist ideology, expressing a covert form of racism. Previous laws of this nature were passed prior to secession which brought on the Civil War and attempted during the Civil Rights movement. Now our nation has a Black President, up jumps a Sovereignty/Secession movement. As a retired military service member I take great offense concerning this law and its implications toward secession and racism. It is remarkable, of all the problems in our state and nation our allegedly esteemed legislators pass this resolution instead of reforming the State's Constitution and ending the last vestiges of Jim Crow contained in Alabama's Constitution.

Mr. Roden, CEO Chamber of Commerce. What role does the Chamber of Commerce play in these schemes of Bourbon Democrat Censorship. The Chamber of Commerce does support the non-accountable, irresponsibility of the TVA continuing with Bellefonte. So does our newly elected Mayor. Mayor Potter has pledged his support to TVA increasing their debt to build a nuclear plant they can't afford. TVA Debt is at $25 billion +, and growing. Rapidly approaching TVA's $30 billion Congressional Debt Cap. And now, the NRC has been caught violating their own rules in the channeling vast sums of tax payer money into flawed reactor plans and approval process. The AP1000 Reactor Design is not approved. They should not have proceeded with any action until the Reactor Design was approved. This has resulted in vast sums of lost tax payer revenue. Vast sums, millions upon millions of tax payer revenue going to nuclear reactor contractors and TVA's attorneys without formal approval of the reactor design by the NRC, the U.S. Governments nuclear regulatory authority. The Chamber of Commerce and Mayor Potter should be supporting Business growth, not irresponsible, non accountable government and Bourbon Democrat Deceit.

These tactics , I believe are orchestrated by and within Jackson County's Legislative Delegation and carried forth by the news organizations controlling editors at the Huntsville Times thru political influence of Mr. Barron himself as the leader of these Bourbon tyrants. They still attempt to practice their tyrany of a Plantation Master attitude of the White Rooster wing of the Democrat Party, the Bourbons. They just ain't happy unless they can discriminate against folks by showing their egotistical penchant for power and control. If they would concentrate half the effort to offer responsible, accountable examples of leadership we would all be much better off.

This story fails to mention the direct medical care involving physicians. The story also fails to mention if Col. Mark Smith is a Medical Corp Officer or MSC, Medical Service Corp Officer. The MSC Officer would not necessarily be a patient care provider. Although it used to be AMEDD's, Army Medical Department, policy to assign only Medical Corp Officers, Licensed Certified Physicians to Command positions. The article is a feel good political article and does not express the quality of direct Medical Care provided by this facility.

Another fact not stated, the U.S Army's comprehensive Medical Care System of Major Medical Centers has been practically eliminated. Whose fault is that, not the Army, but Congress. Funds for the AMEDD were reduced due to cuts in force reduction during the Clinton Administration. AMEDD has not recovered due to those funding cuts.

As I was reading this morning's Daily Sentinel and enjoying my cup of coffee, I nearly choked when I came to an article about Jackson County's state Representative, John Robinson, recommending that our U.S. Congressman, Bud Cramer, receive a state pension. Isn't his U.S Pension good enough? http://www.montgomeryadvertiser.com/apps/pbcs.dll/article?AID=/20080514/NEWS/80514002/1004/CUSTOMERSERVICE06 It seems our elected representatives have themselves and their political cronies first and foremost in their minds. It is this type of shenanigans Mr. Robinson that will result in your not being elected the next time around. If there is suffering that is to be experianced as a result of inflation and bad government, politicians should be the ones that experiance it first and feel the impact of their decisions. Instead it is through this type of public policy decision that places politicians above the status of their electorate.

For this political action Mr. Robinson, the two headed snake is appropriately awarded. I guess legislation concerning government accountability and the people must take a back seat to support of fellow politicians.
