AGENDA


City Council Member Smith discusses the necessity of keeping Roseberry Creek free from invasive water plant species which may obstruct the waterways surrounding city park, county park and the entire embayment where businesses and residents are located. The county has not approved a budget amendment authorization to assist in control of invasive water plant species species. However, the county does not have general fund money for such a project. TVA is refusing to assist in any further  weed abatement projects although the environmental and economic impacts are very much part of TVA's concern.

Also, the Conveyor Belt Issue and Mr. Blizzard, discussed at 31:20 by Mr. Smith. Mr. Blizzard is currently on sick leave.

Scottsboro City Council Meeting - Aquatic Nuisance Species Issue - Roseberry Rescue Group

At last nights City of Scottsboro's City Council Meeting there were 46 citizens in attendance. Six citizens spoke concerning the elimination of nuisance weeds in Roseberry Creek. The agenda is listed:
The City of Scottsboro's City Council approved item 12 on the agenda by a majority vote.
SCOTTSBORO CITY COUNCIL APPROVES $50K DISBURSAL TO ROSEBERRY RESCUE GROUP SPRAYING. FAILS TO REQUIRE LONG TERM CONTROL PLAN OR TVA/ALABAMA DEPARTMENT OF CONSERVATION BIOLOGIST INPUT. Provided either the County Commission or the Legislative Delegation contributes another $50K. 3 out of 4 was the requirement approved by the majority of the council. The 4 possible contributing groups are the Roseberry Rescue Group, the State Legislative Delegation, the Jackson County Commission and the City of Scottsboro.

Council Member Carol McCrary voted no on the issue. Ms. McCrary stated, "we need TVA's input on this matter...I cannot in good conscience vote for the approval of this issue."

It was very disturbing to see the Scottsboro City Council not recognize the necessity of acquiring the professional input of a biologist or fisheries expert to examine the Roseberry/Dry Creek nuisance species problem. The City Council did not establish a requirement to develop a long term control plan involving the input of an Alabama Department of Conservation or TVA Biologist for this project.


By all appearances, the Scottsboro City Council is catering to the request of influential special interest groups while ignoring good sense, legal requirements and explicit responsibilities of other government agencies.

The council ignored what the fisherman present were telling them was occuring to the fishery. They also ignored the request to develop a long term plan and acquiring the advice of a professional biologist in addressing this problem.

There is a TVA meeting in Chattanooga Thursday, Feb. 16, 2012. A public listening session by the TVA Board will begin at 9AM Eastern time, 8AM our time.

Our regional environmental group supports responsible aquatic nuisance species control, not decimation of the fishery via improper application of herbicide treatment to sensitive riparian areas of Dry Creek and Roseberry Creek area.

Our group request was plainly stated to the City Council, the Roseberry Rescue Group, the City's Attorney and the Mayor. The press also received a copy of our environmental groups request and suggestions for the proper management of this problem.

It was plainly stated by the Roseberry Rescue Group their only concern was for themselves and not for the preservation of the fishery or the environment. The group spokesperson stated, paraphrased: "Go somewhere else to fish, you have 98% of Guntersville Reservoir to fish."

If the project is to be accomplished, it must be done in accordance with sound practices of environmental-watershed management and the law for the benefit of the fishery, the wildlife, while allowing proper usage and navigation to and from the area for the public. 


Since the application of the aquatic herbicide begining 3 years ago algae has become a problem. This problem was demonstrated to the City Council last night but had no effect on the city council. 
Profuse Algae growth may be seen in shallow and up to 6 foot depths in the area. 
A sample of the algae was collected and taken to the city council meeting. when a body of water has excessive phosphate, nitrates or other effluent or runoff problems algae will become excessive. There are 2 sewage treatment plants in this area.  Plus considerable farm land drainage. The large area removal and destruction of aquatic species by the methodology applied results in a high risk environmental scenario of which the Roseberry Rescue Group nor the City of Scottsboro seem to grasp.

Toxicity studies of Fluridone: U.S Bureau of Land Management, Fluridone Ecological Risk Assessment, November 2005, Bureau of Land Management Contract No. NAD010156ENSR Document Number 09090-020-650;  Section 3.1.3.1- "...fluridone is considered to be moderately toxic to fish species. Most studies reviewed, and all studies selected, for TRV derivation for fish were based on products containing at least 97% fluridone." 3.1.3.3- "The toxicity of fluridone was evaluated with several freshwater aquatic invertebrates, including water fleas (e.g., Daphnia magna), scuds (Hyallela spp.), crayfish (e.g. Astacidae), and chironomids. Acute toxicity was observed in aquatic invertebrates exposure to fluridone..." Fluridone Ecological Risk Assessment, Final Report The report goes on to state that larger animals and wildlife, including birds, are not effected if the application of the herbicide is performed properly. However, there is a risk to native aquatic species in the treatment area.

Conclusion: there is a moderate to high risk to the fishery and the the fishery food chain. This may account for the poor fishing within the area of Roseberry and Dry Creek area as reported by members of the Bass Anglers Clubs and fisherman speaking at last nights city council meeting.

We do not want what the picture to the left demonstrates. What probably will be acheived in the Dry and Roseberry Creek area will be what the Bass Club members described in last nights Scottsboro City Council meeting," no cover, no fish, the fish left the area." And so have the fisherman and their money.

Scottsboro City Council Meeting

Last night was a work session of the Scottsboro city Council. Several important issues were discussed.
1) City Attorney, Steve Kennamer, discussed the City Ordinance concerning business licenses and alcoholic beverage control license. The new ordinance will coordinate local laws with the state law. Mr. Kennamer stated the new license issuance fee will be based on the state license fee which is based on the consumer price index. According to the City Attorney this will lower the current fees. (In my last posting concerning this issue I had misunderstood the explanation of the license fee issues. I stated there would be an increase in license fees. A change in the law will not result in a fee increase and there probably will be a decrease in license fees as the local law is coordinated with state law, my apologies for the error.) 2) Vacancy announcement on the Water Sewer and Gas Board due to the death of Mrs. Dicus, term expires Sep. 2014. Applications for the position must be turned into the City Clerk no later than Feb. 24, 2012 by 4PM. 3) 1 vacancy on the Housing Authority Board, applications must be turned into the City Clerk no later than 24 Feb, 2012 by 4PM. 4) There were 3 items of discussion relating to the traffic signals at the intersection of Hwy 72 & 35, Wal-Mart and Scottsboro High School. The items concern a modification of the signals at the 3 locations.

Presentation by Mr. Lowell Bivins of the Roseberry Rescue Group concerning Aquatic Nuisance Species in the Dry Creek and Roseberry Creek area. The Jackson County Park and the Scottsboro City Park are located in these areas. There are many homeowners which have docks by the lake in the area of Roseberry and Dry Creek.

The Aquatic Nuisance Species issue has been an ongoing issue long before 2008 when the Roseberry Rescue Group (RRG) LLC was formed.  Information about the Roseberry Rescue Group may be found on the web at  http://sites.google.com/site/roseberryrescuegroupllc/home .

The Roseberry group of concerned citizens state on their web site: "In 2008 two specific non-native aquatic weeds (hydrillia and Eurasian milfoil) had encroached the waterways, channel and near shore areas of Roseberry Creek within Scottsboro and Jackson County. They literally took over whereby Roseberry Creek was unusable by the public or private land owners."

"The simple reason this occurred was that around 2005 TVA began scaling back service and eventually stopped treatment and left the job to local communities."

The Roseberry group is asking the City of Scottsboro to pay for $50,000 of a $200,000 bill for control of  hydrilla and millfoil. The group will also request $50K each from the County Commission and the Legislative Delegation. The lakeside homeowners will also contribute $50K to the project. The responsible parties for the stewardship of the Tennessee River waterways, TVA and the State of Alabama in accordance with Federal and State law, contribute nothing.

The irresponsibility of the TVA and the State of Alabama in this problem is appalling in regards to this issue. The TVA and the State of Alabama are neglecting their responsibilities.

The TVA Act states: "Sec. 22. To aid further the proper use, conservation, and development of the natural resources of the Tennessee River drainage basin and of such adjoining territory as may be
related to or materially affected by the development consequent to this Act, and to provide for the general welfare of the citizens of said areas..." Board of Directors of the TVA has a responsibility:



"Sec. 2. MEMBERSHIP, OPERATION, AND DUTIES OF THE BOARD OF DIRECTORS. (b) (5) 
shall affirm support for the objectives and missions, of the Corporation, including being a national leader in technological innovation, low-cost power, and environmental stewardship." In TVA's Environmental Policy they state: "Natural Resource Management - TVA protects natural resources while providing recreational opportunities across the valley." TVA also states their responsibility under "Water Resource Protection and Improvement - TVA manages an integrated river system for multiple uses while striving to provide clean and sufficient water for the valley's needs." The policy states: Policy for managing aquatic plants in the Tennessee River system-
TVA will assume the leadership responsibility for resolving problems with, and disputes over, aquatic plants within the Tennessee River system. TVA will take the lead in bringing stakeholders and technical experts together to discuss and define the problems, voice concerns, design management plans, and develop funding strategies. Administration, implementation, and financial responsibilities will be negotiated among local, state, and federal government agencies, TVA and other stakeholders.

State of Alabama: The Department of Conservation and The Alabama Department of Environmental Management (ADEM) have responsibilities under several laws. Previously, ADEM did not issue permits for aquatic nuisance species control. Currently they are issuing permits for herbicide treatment. There are other responsibilities outlined in Alabama Water Resources Act. This law is referenced in the Code of Alabama Section 9-10B various subparts.  Also relevant is the Alabama Aquatic Nuisance Species Management Plan which was developed by Governor Riley and signed into law but has never been funded.   www.outdooralabama.com/education/generalinfo/ans/plan/AlANSPlan200812.pdf. There are several problems relating not only to government responsibility but to the Roseberry Rescue Group Responsibility.
There is no doubt that Hydrilla and Millfoil are out of control in many areas of the lake. The last application of the herbicide reduced the current problem. Short term solutions are not the answer. Poisoning the waters over and over again will have an impact on the fishery. The application of Fluridone and also a shoreline herbicide promotes the growth of dangerous algae. Reports from Florida reveal Hydrilla will build a resistance to Fluridone.

There is no long term plan by any of the governmental entities or the Roseberry Rescue Group concerning their deployment of this herbicide. Nor has there been any scientific input concerning the impact on the fishery or native aquatic species relating to the long term use of the herbicide.

To continue to spend $150,000 in public funds every 3 years for the spraying of "water weeds" in an 1100 acre area without knowing the long term effects of the application is negligent. In 21 years (began in 2008) that will equal a total of $1.05 million dollars (2012 dollars) in tax dollars spent without any scientific input from biologists or a definitive plan to evaluate and resolve the problem for a long term solution.

It is significant that the Dry Creek area has been identified by government conservation agencies as an area affected by siltation and pesticide runoff. There are 2 sewage treatment plants releasing effluents in the area of Roseberry Creek. Killing off the aquatic species in the area will have an effect on the fishery and the lake. Aquatic species in shallow water serve a purpose to clean human waste and agricultural discharges. The possible repercussions of widespread aquatic species poisoning are not known at this time due to the lack of a study. However, in Florida and other areas there are horror stories related to excessive algae blooms killing off the fishery as a result of eliminating other aquatic plant species.

Current TVA Board Chairman Mike Duncan resigns effective May 18, 2010. Chairman Mike Duncan of Inez, KY, is chairman, chief executive officer, and director of Community Holding Co.; chairman, CEO, and director of Inez Deposit Bank. "Honorable members of the TVA Board, this opportunity to speak before you is greatly appreciated. My presentation today concerns TVA Debt and Environmental Stewardship."

"TVA Executive Management is requesting the debt ceiling be raised from the mandated Congressional Cap of $30 Billion dollars to an undisclosed increase in the debt ceiling."

"TVA's debt is approximately $23 billion, debt interest is $22 billion, long term commitments and contingencies are approximately $66 billion which includes debt and debt interest. These are the figures reflected in TVA's February 2010 10Q quarterly Financial Report filed with the Securities and Exchange Commission."

"Ladies and Gentleman of the TVA, to raise the debt limit to an undisclosed or for that matter any increase is unacceptable."

"The TVA Act requires you to produce affordable power for citizens of the TVA area. You do a wonderful job at keeping the lights on and the machines running. You know and I know that upgrades of current power production facilities are needed."

"With current trends of decreased electricity demand can you afford to proceed with the astronomical cost of nuclear power?Don't you think 800 mega watt combined cycle natural gas plants are far more economical?"

"The TVA Act requires environmental stewardship of the natural resources under your purview. Ladies and gentleman of the TVA you are lacking in this critical area."

TVA should be partnering and working with the Alabama Department of Conservation and Alabama's Aquatic Nuisance Species Task Force to resolve this complicated problem. Why are you not working in a partnership to facilitate a long term solution to the weed control problem on Lake Guntersville instead of encouraging environmental vigilantism?"

"Our local legislators have informed the community that poisons such as battery acid, anti-freeze and even military defoliants are being dumped into Lake Guntersville to control aquatic nuisance weed species."

"Please be responsible and fulfill your environmental stewardship responsibilities."

Poll on Aquatic Nuisance Weeds/Poll Results


It has been a while since I have ran a poll. It seems now is a good time since there is an important issue before the Scottsboro City Council.

Do you think the Scottsboro City Council should issue tax payer money to a private, non-profit group for the elimination of aquatic nuisance weeds in Guntersville Reservoir's Dry Creek and Roseberry Creek area? POLL RESULTS: 44 total votes over a 5 day period. There were 20 yes votes, 45%; there were 24 no votes, 55% which were no votes or votes that stated the lakeside homeowners should cleanup around their own boat docks.

City Council Meeting


Early morning wind damage on Monday completely destroyed this mobile home off of Edmonds Dr. in Scottsboro. The roof and side was blown off of this mobile home. Other mobile homes in the same area received serious damage from this storm. Many Campers in the County Park area were completely destroyed. Wind gusts were reported up to 80 mph in this event. The Mayor commented to me he had never seen high winds of this nature locally for such a sustained period of time.

The TVA has decided to continue with Lake Guntersville Aquatic Weed Spraying including private dock areas.

Two big issues at last nights City council Meeting. 1) Mayor discussed Storm Damage first to start the meeting. He stated there were no injuries reported. He commented all agencies were working diligently to repair storm damage and appreciated all efforts and the hard work to restore power to the area. There were 6500 customers without power Monday morning. At the time of the Council Meeting he stated there were 1500 without power. In a related issue the Jackson County Commission declared the area a Disaster Area. 2) In the Mayors portion of the Reports it was stated that the TVA had made a decision that they would continue to spray for weeds on Lake Guntersville. The Mayor stated TVA will treat for weeds on Lake Guntersville in all public access areas, recreation areas and the navigation channels and sub channels from June-August.

The TVA will continue their spraying programs around private boat docks during the month of June and July. If the private property owners wish to continue treatment thru August the TVA will require the private property owners to pay for the service during the month of August. The Mayor further stated that TVA officials have not made the official announcement concerning the weed issue.

1) Contract awarded for inmate medical services to Southern Health Partners. 2) Bid openings for Animal Shelter kennels and cages; Kennels were awarded to Direct Animal Products and cages were awarded to Ultra Light Products. Budget will be amended for a total of $95,762.00, the cost for the cages and kennels.

New Business
1) Assistant City Court Magistrate Position approved, a secretarial position will be abolished. Additional funding for the position will be temporarily provided by the Court and Jail Fund. 2) Budget Amendment approved for Cemetery for $4,650.00 for drainage. 3) Alcohol Beverage License approved for Papa Jacks, 1533 S. Broad St. 4) Alcohol Beverage License approved for SoJo's Quick Mart, 47 Ridgedale Rd. 5) Transfer of Alcohol Beverage License approved for Buena Vista Restaurant. 6) In the Reports section Mayor Potter introduced the new City Engineer, Charles King. Mr. King is a graduate of Auburn University and was the Assistant Engineer for Elmore Co., Alabama.

Fluridone Will Not Work Says TVA

Local Maskarovka in Scottsboro, Aquatic Nuisance Weeds and Bellefonte

Hydrilla. My disagreement with the City of Scottsboro approving $42,500 appropriation and subsequent discussion about this problem has resulted in me being banned once again from al.com, Scottsboro forum.
Can't have any disagreement with the TVA in Scottsboro concerning their lies about Bellefonte and their lack of responsibility concerning lake stewardship. As soon as today's Daily Sentinel was released I was banned from the al.com forum. There has been much discussion concerning the Roseberry Creek and Dry Creek Aquatic nuisance species problem in Dry Creek & Roseberry Creek concerning the disbursement of $42,500 of taxpayer money to the Roseberry Rescue Group, a group of private citizen lakeside homeowners, from the Scottsboro City Council. I have presented an opposing viewpoint of this situation to the City Council last night, along with forum discussions of this issue on al.com, Scottsboro forum. My postings on al.com were removed.

The media censors and local politicians do their dirty deed once again. I have been banned once again for telling the truth on al.com, Scottsboro forum. Many postings removed discussing the Aquatic weed issue and the Bellefonte Nuclear Power Plant issue. More of the same deceit, more of the repressive actions of local political leadership coupled with local media serving as their messengers of deceit. All the while personal attacks continue.

TVA Irresponsibility, Vigilantism and Poor Decision Making.

Hydrilla, milfoil, and native aquatic plants north of Hwy 35 in Scottsboro. This is Dry Creek which flows into the Roseberry Creek area.
Milfoil and hydrilla makes for a green carpet in the North Sauty Creek area at Goose Pond Colony. Monster bass hang out in the shoal areas in the spring, summer and fall months using the weed cover and the numerous channels through the cover to ambush their prey.

Hydrilla, the culprit and reason for concern of local citizens. Unfortunately the TVA fails to meet their stewardship responsibilities in controlling this invasive plant. Local Citizens in Scottsboro have formed a vigilante non-profit group to take matters into their own hands. They have also convinced the Scottsboro City Council to participate in their ill advised plans.

What do you get when you combine TVA Irresponsibility, Vigilantism and Poor Decision Making? A Scottsboro City Council Decision which gives $42,500.00 of citizen tax payer money to an ill advised project where professional, scientific input was not acquired. But wait, there may be more money from other public entities to placate the influential vigilante citizens irresponsible actions.

Last year the TVA announced that it was not going to continue its aquatic nuisance species weed control. A responsibility which the largest governmental socialistic electrical utility has by law. They announced they would control invasive aquatic nuisance species only in public access areas and navigation channels. The lakeside homeowners formed a non-profit organization and named it Roseberry Creek Rescue Group. (Unfortunately the question now is who will rescue the poor citizen of Scottsboro from the lakeside home owners who have swindled $42,500 from the coffers of Scottsboro.) The group enlisted the services of a private contractor to kill the aquatic nuisance species blocking their boat docks. The same contractor the TVA has put out of work due to their cut back of controlling aquatic weeds. The contractor comes forward and states, I will resolve all of your problems, give me $170,000.

The proposed contractor, the Roseberry Rescue Group nor the City of Scottsboro, in the several public meetings, has never requested nor allowed any input from any State Biologist or professional scientist of any biological, ecological, or environmental discipline that would serve as a disinterested party to effectively evaluate any plans professionally and scientifically brought forward by the group.

The jurisdiction of the Resource which we call the Tennessee River, Guntersville Lake and specifically Roseberry Creek falls under the domain of the Federal Government and the State of Alabama. The City of Scottsboro nor the Roseberry Rescue group have no authority to participate in the destruction, elimination or poisoning of any species of flora and fauna of the river or lake. If they go ahead with their venture they will effectively be a group of lawless ecological vigilantes. The responsible Federal and State Agencies are the TVA and the Alabama Department of Conservation. Summary
Roseberry Creek has an invasive species problem and responsible planned action must be taken to resolve the problem. The failure of TVA to meet their responsibilities concerning stewardship of the mighty Tennessee River does not justify poor decisions without professional, scientific input to plan and resolve the problem permanently.

There are many factors involved ie, sewage and runoff pollution, exasperating an existing ecological problem by enabling an avenue of a more serious proliferation by organisms such as Lyngbya alga to become dominate in Roseberry Creek; the avenue and frequency of dispersion of chemicals in this wide area must also be taken into consideration, it may require a period of years to have the best control of nuisance aquatic weeds. Endangered species might be in the area such as mussels and darters in Dry Creek and Roseberry Creek. The widespread use of Flouridone in the Roseberry Creek area in all likely hood will create other problems such as that with Lyngbya alga which sometimes takes over when hydrilla is controlled. Creates toxins and clogs water systems, a very difficult to control alga. Blue green filamentous algae is present and proliferates when aquatic weed control measures have been applied to the shoreline of Roseberry Creek in past years.

A professional, scientific, joint agency approach to controlling this problem is necessary with public input. A single group of citizens taking the law into their hands and convincing the local political municipal body that their scheme should be financed all the while discarding the principles of science to resolve a perplexing Biological and Ecological issue is unacceptable conduct by those participating in this scheme. That is my opinion on this issue as supported by all available scientific and legal material that I have gathered and listed in the linked documents, including just plain good and common sense of the responsible citizen.

Scottsboro City Council Meeting and Work Session

The City Council approved a $42,000 disbursement, with stipulations, to control aquatic nuisance species around private boat docks.
Tonight a joint session was held, first a work session then a regular council meeting.

1) Name change of Island Drive on Goosepond Island to Goose Pond Island Drive, approved. 2) Surplus Property declaration at Street Department, 2 John Deer Tractors, approved. 3) Resolution with State Department of Transportation concerning access road north of Deals on Wheels, approved. 4) Road block request from Shriner's for the period of April 5 for the area of County Park Rd. and Hwy 72. 5) Bid opening for Animal Shelter kennels and runs for $95K and some change, tabled awaiting county Commission input. 6) Approval for transfer of $300,000 into Street Department Paving Account. 7) Additional funds for Planning Department approved in the amount of $7500. This money will be utilized for the hiring of a City Engineer. (Mr. Curtis Davis, City Planner, last day at work was last Wednesday.) 8) Surplus property declaration for Planning Department. 9) Pharmacy Card Program approved for the citizens of Scottsboro allowing for 20% off prescriptions for all citizens who do not have insurance. This is a no cost program for the tax payers. This program was brought home from the League of Municipalities meeting in Washington last week. 10) A Cost of Living Increase was approved at 2% for City Employees effective April 1. 11) Roseberry Rescue Group requested $42,500 from the City of Scottsboro for the cleanup of aquatic weeds around their private boat docks. The Council approved this request with the stipulation that other sources must equally fund this project. The County Commission did not fund the requested $42,000. It was reported by the group the Jackson County Legislative Delegation will receive a request for this project. The Roseberry Group and the council stated that most citizens support the city utilizing taxpayer money to clean up aquatic weeds around private boat owners docks. That is not a true statement. I have discovered that the City Council did not consult with any State Department of Conservation Biologist or Fisheries Specialist prior to approving this project. Hydrilla and the Roseberry Rescue Group

Hydrilla, the culprit of choking the lake. TVA refuses to meet its legal responsibilities of River and Lake Stewardship in controlling this aquatic nuisance species.
Hydrilla in the back end of Dry Creek in December of 2008. The Roseberry Rescue Group proposes to control the hydrilla and milfoil from approximately 1/4 mile south of the Randall's Chapel Bridge on Hwy. 35 to Roseberry Creek entrance on the Tennessee River.

Alabama Representative Jeff McLaughlin, Democrat, Marshall County, Chairman of the Tennessee River Caucus has met with the TVA in a closed door session in Guntersville recently over TVA's control of Aquatic Nuisance Plant Species . During the press conference it was stated by State Rep. John Robinson, Democrat Jackson County, that he had heard Agent Orange was going to be brought in to control the weeds.")

Last night the Roseberry Rescue group made a public presentation at the Council for Aging facility concerning the aquatic nuisance plants in Roseberry and Dry Creek. There was a full house, standing room only. Mayor Potter and Councilman Smith were present along with County commissioner Jack Allen. There might have been others but I did not see them. There were no representatives present from the Alabama Department of Conservation, ADEM or the TVA at last nights meeting.

The mission statement of the group was expressed as follows: "Encourage the TVA to meet their legal and moral obligations to stake holders. Supplement TVA work to eliminate exotic, nuisance species of aquatic plants." Roseberry Rescue Group is a 501 (c), not for profit organization. The organization of concerned citizens spokesman, retired Judge Wallace Haralson, stated the group was formed as a result of TVA's recent statements concerning aquatic plant control. The TVA has recently stated they will only control nuisance aquatic plants around public boat docks and keep the navigation channels open. They will not control the nuisance plants around private boat docks and areas of private or commercial concern. (Unfortunately, the TVA is once again displaying its negligence and deceit as they are not keeping secondary navigation channels in tributaries open. They are not meeting their stewardship responsibilities.)

It was reported recently that TVA had offered matching funds to assist in any aquatic nuisance species control project. This was stated to be unacceptable by State Representative Jeff McLaughlin of Marshall County in a recent closed door meeting with the TVA in Guntersville. Mr. McLaughlin is the Chairman of the Tennessee River Caucus of the Alabama House of Representatives.

It has been estimated the control project will cost approximately $200,000. Judge Haralson has approached the Jackson County Commission and requested $60,000 and the City of Scottsboro's request was for $90,000. Judge Haralson also commented that the Jackson County Legislative Delegation would be requested to provide funds for this project.

It was reported that area fisherman and guides had been consulted in this project.

Mr. Terry Goldsby, previous TVA contractor for this area for aquatic plant control, and Mr. Craig Smith, Aquatic Products Manager, spoke concerning the application procedures and testing during application. It was reported that 5-20 parts per billion, ppb, was the desired application level to control weeds. Mr. Goldsby stated that the procedure would not harm other aquatic flora and fauna. He further stated this is a very controlled application and not all areas of the Roseberry and Dry Creek area would be treated. Apparently TVA does not use the product, Fluidone, which will be utilized for the Roseberry Creek control project. Fluridone is not effective in bodies of moving water nor will it be utilized on broad scope application for this project.

Dr. Joe Cooney spoke concerning mosquito control and aquatic plants. Dr. Cooney is retired from the TVA as an Entomologist. He stated the control of the nuisance species would have a positive result in controlling the mosquito population in the lake area of treatment.

Information was presented concerning lakeside home owner tax contributions. It was stated that lake shore home owners pay 10 times more property taxes than others. Also stated, lakeside property owners "deserve" the contributions by the city ($90K) and county ($60K)governments for aquatic plant control as they had paid their taxes year after year and pay more taxes than others. One citizen did not agree with their philosophy on the groups deserving the contributions from local government. The citizen spoke during the question and answer session, stating that, "we need jobs in Scottsboro before aquatic plant control." The concerned citizen stated $150,000 would go along way to bring jobs to Jackson County.

I asked a question concerning permissions from the TVA, ADEM, and Alabama Department of Conservation. It was reported by Mr. Goldsby that no permits or permissions are required. This is contradictory to literature found concerning the Safe Drinking Water Act. In order to comply with this Federal Law a discharge permit is required as stated in the act. Citizens of Jackson County and the City of Scottsboro have not heard any comment from the Alabama Department of Conservation, ADEM concerning this proposed project. I hope our local governmental leadership checks with these agencies to determine if there is a problem. Judge Haralson commented that Ms. Sue Robertson of the TVA stated to him that no controls/permits are required or necessary.

HYDRILLA and The ANS Task Force, TVA Denies Responsibility to Control Aquatic Nuisance Species

Hydrilla has the potential of "choking off" bodies of water. Cover is necessary for a healthy fishery. Unfortunately hydrilla becomes the only plant present sub-surface, becoming so thick fish and other aquatic species can't exist.
Hydrilla, sounds like Godzilla, it is a monster aquatic plant, choking off waterways and lakes. This aquatic plant has the possibilities of utterly destroying a body of water. It is extremely invasive and almost impossible to kill. It is a serious problem in TVA's lakes.
